Manivasakam\nFor Respondents        :  Mr.Abudukumar Rajarathinam,\n                                           Government Advocate.\n\nPetition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India for  the  issuance  of\nwrit  of  habeas corpus directing the respondents to produce the detenu, viz.,\nSakthivel, S\/o.  Chinnappan before this Court, who  is  detained  as  per  the\norder  of  detention  passed  by the first respondent in Cr.M.P.No.58\/05 dated\n30.09.2005 and confined at Central Prison, Trichy and set him at  liberty  and\nfurther  direction  for  call for the records relating to the above said order\nand quash the same. \n:ORDER  \n<\/pre>\n<p id=\"p_1\">(Order of the Court was made by P.SATHASIVAM, J.)   <\/p>\n<p>        Son-in-law  of  the  detenu  challenges  the  detention  order   dated<br \/>\n30.09.2005,  detaining his father-in-law by name Sakthivel as Boot-legger as<br \/>\ncontemplated under Section 2(b) of the  Tamil  Nadu  Prevention  of  Dangerous<br \/>\nActivities  of Bootleggers, Drug Offenders, Forest Offenders, Goondas, Immoral<br \/>\nTraffic Offenders, Slum Grabbers and Video Pirates Act, 1982 <a href=\"\/doc\/195458\/\" id=\"a_1\">(Tamil  Nadu  Act<\/a><br \/>\n14 of 1982).\n<\/p>\n<p id=\"p_1\">        2.   Heard  learned  counsel  for  the  petitioner  as well as learned<br \/>\nGovernment Advocate for the respondents.\n<\/p>\n<p id=\"p_2\">        3.  At the foremost, learned counsel for the petitioner submitted that<br \/>\nthere was inordinate delay in disposal of the representation of the detenu.\n<\/p>\n<p id=\"p_3\">        The particulars furnished by the learned Government Advocate show that<br \/>\nthe representation  of  the  detenu  dated  29.10.2005  was  received  by  the<br \/>\nGovernment  on  08.11.2005, remarks were called for on 09.11.2005 and the same<br \/>\nwere received from the Sponsoring Authority on 17.11.2005 .   Thereafter,  the<br \/>\nFile was dealt with by the Under Secretary and Deputy Secretary on 17.11.2005.<br \/>\nFinally,  the Minister for Prohibition and Excise passed orders on 18.11.2005.<br \/>\nHowever, the rejection letter was prepared  only  on  29.11.2005.    The  said<br \/>\nletter  was sent to the Central Prison for service on 30.11.2005 and served to<br \/>\nthe detenu on 02.12.2005.\n<\/p>\n<p id=\"p_4\">        4.  As rightly pointed out by the learned counsel for the  petitioner,<br \/>\nthough  the  competent  authority,  viz., Minister for Prohibition and Excise,<br \/>\npassed orders  on  18.11.2005,  there  is  no  reason  for  taking  time  till<br \/>\n29.11.2005 for  preparation of the rejection letter.  In the absence of proper<br \/>\nexplanation, even if we exclude  the  intervening  holidays  on  Saturday  and<br \/>\nSunday as well as the public holidays, we hold that the delay is on the higher<br \/>\nside,  which  caused prejudice to the detenu in considering his representation<br \/>\neffectively.  On this ground, the impugned order of detention is quashed.\n<\/p>\n<p id=\"p_5\">        5.  Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and  the<br \/>\nimpugned order of detention is set aside.  The detenu is directed to be set at<br \/>\nliberty forthwith from the custody unless he is required in some other case or<br \/>\ncause.\n<\/p>\n<p id=\"p_6\">JI.<\/p>\n<pre id=\"pre_1\">\n\n\nTo\n\n1.
