2      23\/06\/2011            The petitioners are aggrieved by the order dated<\/p>\n
                    29.02.2008 passed in Khagaria (Chitraguptanagar) Police<\/p>\n
                    Station Case No. 26 of 2005 (G.R. No. 63 of 2005) by<\/p>\n
                    which the Judicial Magistrate, Khagaria has rejected the<\/p>\n
                    discharge application filed on behalf of the petitioner<\/p>\n
                    under Section 239<\/a> of the Code of Criminal Procedure.<\/p>\n
                             The main contention of the petitioner is that the<\/p>\n
                    case has been instituted at the instance of an Assistant<\/p>\n
                    Teacher who had given his written report to the D.D.C.,<\/p>\n
                    Khagaria in order to pressurize the petitioners for calling<\/p>\n
                    of the strike. It is further submitted that the impugned<\/p>\n
                    order is mechanical and without application of mind.<\/p>\n
                             On perusal of the impugned order, it appears<\/p>\n
                    that the Court below has considered the materials in the<\/p>\n
                    case diary and has found that a prima facie case is made<\/p>\n
                    out against the petitioners and has, therefore, rejected<\/p>\n
                    their application under Section 239<\/a> of the Code of<\/p>\n
                    Criminal Procedure.\n<\/p>\n
                             I do not find any illegality in the order
\n                          2<\/span><\/p>\n
        impugned, and as such, this application is dismissed.<\/p>\n
