PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 27\/08\/2010\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">\tThis<br \/>\n\tapplication is filed by the applicants under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of the Code<br \/>\n\tof Criminal Procedure, 1973 for granting anticipatory bail in<br \/>\n\tconnection with CR No.I-101 of 2010 registered with Chikhali Police<br \/>\n\tStation, District-Navsari, for the offence punishable under <a href=\"\/doc\/538436\/\" id=\"a_1\">Sections<br \/>\n\t498-A<\/a>, <a href=\"\/doc\/92983\/\" id=\"a_2\">306<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_3\">114<\/a> of the Indian Penal Code.\n<\/p>\n<p id=\"p_1\">\tHeard<br \/>\n\tMr.S.V. Raju, learned Senior Counsel with Mr.P.P. Majmudar, learned<br \/>\n\tcounsel for the applicants and Mr.A.J. Desai, learned Additional<br \/>\n\tPublic Prosecutor, for the respondent-State.\n<\/p>\n<p id=\"p_2\">\tMr.Raju,<br \/>\n\tlearned Senior Counsel for the applicants, has submitted that he is<br \/>\n\tnot pressing the present application for the applicant no.1-Vipul<br \/>\n\tDhayabhai Patel.\n<\/p>\n<p id=\"p_3\">\tIn<br \/>\n\tview of statement made by learned Senior Counsel for the applicants,<br \/>\n\tpresent application is dismissed qua applicant no.1 and accordingly,<br \/>\n\tRule is discharged qua the applicant no.1.\n<\/p>\n<p id=\"p_4\">\tHaving<br \/>\n\theard the learned counsel for the parties and perusing the record<br \/>\n\tand considering the facts of the case, I am inclined to grant<br \/>\n\tanticipatory bail to the applicant nos.2 and 3.\n<\/p>\n<p id=\"p_5\">\tIn<br \/>\n\tthe event of the arrest of the applicant nos.2 and 3 in connection<br \/>\n\twith CR No.I-101 of 2010 registered with Chikhali Police Station,<br \/>\n\tDistrict-Navsari, the applicant nos.2 and 3 shall be released on<br \/>\n\tanticipatory bail on their furnishing bond of Rs.10,000\/- (Rupees<br \/>\n\tTen Thousand Only) each with one surety of the like amount on<br \/>\n\tconditions that they shall:\n<\/p>\n<p id=\"p_6\">(a)\tremain<br \/>\n\tpresent before the trial Court\tregularly as \tand when directed on<br \/>\n\tthe\tdates fixed;\n<\/p>\n<p id=\"p_7\">(b)\tremain<br \/>\n\tpresent at Chikhali Police Station, District-\tNavsari, on 30th<br \/>\n\tAugust 2010 at 11:00 a.m.;\n<\/p>\n<p id=\"p_8\">(c)\tmake<br \/>\n\tthemselves available for interrogation by \tPolice Officer, whenever<br \/>\n\tand wherever\trequired;\n<\/p>\n<p id=\"p_9\">(d)\tnot<br \/>\n\tdirectly or indirectly make any\tinducement, threat or promise to any<br \/>\n\tperson\tacquainted with the fact of the\tcase so as to\tdissuade him<br \/>\n\tfrom disclosing such facts to the\tCourt or to any Police Officer;\n<\/p>\n<p id=\"p_10\">(e)\tnot<br \/>\n\tto obstruct or hamper the police\tinvestigation and not to play<br \/>\n\tmischief with the\tevidence collected or yet to be collected by the<br \/>\n\t\tpolice;\n<\/p>\n<p id=\"p_11\">(f)\tat<br \/>\n\tthe time of execution of bond, furnish the\taddress to the<br \/>\n\tInvestigating Officer and the Court \tconcerned, and shall not change<br \/>\n\ttheir residence\ttill the final disposal of the case or till<br \/>\n\tfurther\torders;\n<\/p>\n<p id=\"p_12\">(g)\tnot<br \/>\n\tleave India without the permission of the\tCourt and if having<br \/>\n\tpassport, shall deposit the\tsame before the trial Court\twithin a<br \/>\n\tweek;\n<\/p>\n<p id=\"p_13\">(h)\tit<br \/>\n\twould be open to the Investigating Officer to\tfile an application<br \/>\n\tfor remand if he considers it\tjust and proper, and the learned<br \/>\n\tMagistrate\twould decide it on merits.\n<\/p>\n<p id=\"p_14\">This<br \/>\n\torder will hold good if the applicant nos.2 and 3 are arrested at<br \/>\n\tany time within 90 days from today. The order for release on bail<br \/>\n\twill remain operative only for a period of TEN days from the date of<br \/>\n\ttheir arrest. Thereafter it will be open to the applicant nos.2 and<br \/>\n\t3 to make a fresh application for being enlarged on bail in usual<br \/>\n\tcourse which when it comes before the competent Court, will be<br \/>\n\tdisposed of in accordance with law, having regard to all the<br \/>\n\tattending circumstances and the materials available at the relevant<br \/>\n\ttime uninfluenced by the fact that anticipatory bail was granted.<br \/>\n\tRule is made absolute qua applicant nos.2 and 3.\n<\/p>\n<p id=\"p_15\">\t  Direct<br \/>\n\tservice is permitted.\n<\/p>\n<p id=\"p_16\">(Z.\n<\/p>\n<p id=\"p_17\">K.
