Justice M.N.KRISHNAN\n\n Dated :25\/05\/2007\n\n O R D E R\n                            M.N.KRISHNAN, J.\n\n                    -----------------------------\n\n                        WP(C)No.7913 OF 2007 P\n\n                    -----------------------------\n\n                   Dated this the 25th May, 2007.\n\n\n\n                                 JUDGMENT\n<\/pre>\n<p id=\"p_1\">      This   writ   petition   is   filed   to   set   aside   the   order   in<\/p>\n<p>I.A.103\/2007   in   O.P(Election)   47\/2005.                   It   is   an<\/p>\n<p>application   filed   by   the   first   respondent   in   the   Election<\/p>\n<p>O.P to call for the ledger extract from the Tirur Urban Co-\n<\/p>\n<p id=\"p_1\">Operative   Bank,   B.P.Angadi   Branch   with   respect   to   account<\/p>\n<p>No:2901   jointly   held   by   C.P.Bapputty   and   K.P.Muhammed<\/p>\n<p>Saleem.     The   trial   court   found   that   there   is   nothing   to<\/p>\n<p>show that they are relevant for the purpose of adjudicating<\/p>\n<p>the case and therefore disallowed the same.\n<\/p>\n<p id=\"p_2\">      2.  Heard counsel for both sides.\n<\/p>\n<p id=\"p_3\">      3.     The   purpose   of   summoning   the   document   is   to   the<\/p>\n<p>effect that how much amount had been received and withdrawn<\/p>\n<p>from   the   Panchayat   in   connection   with   the   construction   of<\/p>\n<p>Indore   Stadium   of   Thalakkad   Grama   Panchayat.     It   is   also<\/p>\n<p>averred   that   they   approached   the   bank   for   getting   a   ledger<\/p>\n<p>extract   but   the   bank   submitted   that   unless   there   is   an<\/p>\n<p>order   of   the   court   it   will   not   be   issued.     Taking   into<\/p>\n<p>consideration   the   relevant   facts   and   materials   is   is   only<\/p>\n<p>just   and   necessary   to   call   for   the   document   sought   for   by<\/p>\n<p>the   writ   petitioner.     Therefore,   the   writ   petition   is<\/p>\n<p>allowed   and   the   order   under   challenge   is   set   aside   and<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">WPC 7913\/2007                       2<\/span><\/p>\n<p>I.A.103\/2007   in   O.P(Election)   47\/2005   is   allowed.
