Jodha, Counsel for petitioner\nShri Ashok Prajapat, PP for the State\nShri Ajay Vyas, Advocate, for\nShri Bheem Kant Vyas, Counsel for complainant\n                      ####\n\n\nBy the Court:<\/pre>\n<p id=\"p_1\">       Heard learned counsel for petitioner as<\/p>\n<p>well as learned Public Prosecutor and perused<\/p>\n<p>the material made available to me during the<\/p>\n<p>arguments of the case.\n<\/p>\n<p id=\"p_1\">       Learned       counsel         for     petitioner           argued<\/p>\n<p>that    petitioner        is    an        employee      of   Citicorp<\/p>\n<p>Finance (India) Limited, which is a non-banking<\/p>\n<p>finance company; the complainant took a loan<\/p>\n<p>from     the    Company        to    purchase          the   vehicle,<\/p>\n<p>however,       the   payment        of     installment was           not<\/p>\n<p>regular, therefore, vehicle, in dispute, was<\/p>\n<p>seized     on    20th     November,             2008    with      prior<\/p>\n<p>information          to    the           police        and     further<\/p>\n<p>information was also sent to the police; there<\/p>\n<p>was no goods in the vehicle and now, after a<br \/>\n                                \/\/ 2 \/\/<\/p>\n<p>delay of more than five-and-a-half-month, the<\/p>\n<p>present FIR has been lodged on 6th April, 2009<\/p>\n<p>with the allegation that goods were lying in<\/p>\n<p>the vehicle and, on that basis, the FIR has<\/p>\n<p>been    registered       under      <a href=\"\/doc\/1101188\/\" id=\"a_1\">Section          379<\/a>    IPC.   The<\/p>\n<p>learned counsel for the petitioner contended<\/p>\n<p>that     no    reasonable           explanation            has     been<\/p>\n<p>mentioned      in    the      FIR        about      delay    in     its<\/p>\n<p>lodging,      however,        the    petitioner            will    make<\/p>\n<p>himself present for interrogation as and when<\/p>\n<p>called      upon    to   do    so        by   the    Investigating<\/p>\n<p>Officer;      he,    therefore,           contended         that   the<\/p>\n<p>petitioner may be granted indulgence of bail<\/p>\n<p>under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> Cr.P.C. in the matter.<\/p>\n<p id=\"p_2\">       The learned Public Prosecutor as well as<\/p>\n<p>the learned counsel for the complainant oppose<\/p>\n<p>the bail application.\n<\/p>\n<p id=\"p_3\">       Taking into consideration all the facts<\/p>\n<p>and    circumstances          of    the       case    and     without<\/p>\n<p>expressing any opinion on merits and demerits<\/p>\n<p>of    the   case,    I   allow      this       bail    application<\/p>\n<p>under <a href=\"\/doc\/1783708\/\" id=\"a_2\">Section 438<\/a> Cr.P.C.\n<\/p>\n<p id=\"p_4\">            Therefore,        the        S.H.O.\/I.O.         of    the<\/p>\n<p>Police Station Pratap Nagar (District Bhilwara)<\/p>\n<p>is directed that in the event of arrest of the<\/p>\n<p>petitioner Vabhav Napalia S\/o Narainlal Mathur,<\/p>\n<p>presently working in Citicorp Finance (India)<br \/>\n                              \/\/ 3 \/\/<\/p>\n<p>Limited, Office at 401, Ridhi Sidhi Complex,<\/p>\n<p>Madhuban,       Udaipur,         in      FIR    No.199\/2009<\/p>\n<p>registered     under    <a href=\"\/doc\/1101188\/\" id=\"a_3\">Section        379<\/a>   IPC,   he    shall<\/p>\n<p>enlarge him on bail, provided he furnishes a<\/p>\n<p>personal bond in the sum of Rs.25,000\/- (Rupees<\/p>\n<p>twenty five thousand only) with one surety of<\/p>\n<p>the    like   amount    to   his       satisfaction      on   the<\/p>\n<p>following conditions:-\n<\/p>\n<p id=\"p_5\">\n<blockquote id=\"blockquote_1\"><p>       (i) He shall make himself available<br \/>\n           for interrogation by Investigating<br \/>\n           Officer as and when required;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>       (ii)He    shall   not    directly   or<br \/>\n           indirectly make any inducement,<br \/>\n           threat or promise to any person<br \/>\n           acquainted with the facts of the<br \/>\n           case so as to dissuade him from<br \/>\n           disclosing such facts to the court<br \/>\n           or to any Police officer;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>       (iii)He shall not leave India without<br \/>\n           the previous permission of the<br \/>\n           Court.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                       (NARENDRA KUMAR JAIN), J.\n<\/p><\/blockquote>\n<p id=\"p_6\">\/\/Jaiman\/\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Vabhav Napalia vs State on 24 July, 2009 \/\/ 1 \/\/ IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT PRINCIPAL SEAT, JODHPUR ORDER In S.B.
