Kavita Verma, who is a practicing Advocate at District Court, Kheri,<br \/>\nis the wife of petitioner. In the year 2006, the opposite party No.3-Smt.<br \/>\nKavita Verma left petitioner&#8217;s home and inspite of his best efforts,<br \/>\nopposite party No.3 did not come to his house and as such, the<br \/>\npetitioner has filed a suit, which was registered as Suit No. 349 of 2007<br \/>\nunder <a href=\"\/doc\/371013\/\" id=\"a_1\">Section 19<\/a> of the Hindu Marriage Act for restitution of conjugal<br \/>\nrights, before the Civil Judge (Senior Division), Kheri. He submits that<br \/>\nas and when the suit filed under <a href=\"\/doc\/371013\/\" id=\"a_1\">Section 19<\/a> of Hindu Marriage Act for<br \/>\nrestitution of conjugal rights was listed before the Court below, she<br \/>\nused to avoid the proceedings initiated under <a href=\"\/doc\/322349\/\" id=\"a_2\">Section 9<\/a> for restitution of<br \/>\nconjugal rights, on one hand and on the other hand, she filed an<br \/>\napplication under <a href=\"\/doc\/1449825\/\" id=\"a_3\">Section 24<\/a> of the Act for maintenance, in which, the<br \/>\nCourt below, vide order dated 16.4.2009, allowed the maintenance in<br \/>\nfavour of the opposite party No.3. Feeling aggrieved, the petitioner has<br \/>\nfiled a revision, which was dismissed by the Court below by the order<br \/>\ndated 14.9.2009. Hence the instant writ petition.\n<\/p>\n<p id=\"p_1\">This Court, vide order dated 19.1.2010, issued notice to the opposite<br \/>\nparty No.3 and liberty was given to the learned Counsel for the<br \/>\npetitioner to serve notice to the opposite party No.3 outside the Court.<br \/>\nIn compliance thereof, learned Counsel for the petitioner has filed an<br \/>\naffidavit of service, wherein in para 3, it has been stated that the dasti<br \/>\nnotice has been served upon the opposite party No.3 out of Court at<br \/>\nLakhimpur Kheri on 23.1.2010.\n<\/p>\n<p id=\"p_2\">On perusal of the records, it reflects that Sri Vijay Kumar, Advocate, has<br \/>\nfiled his power on behalf of opposite party No.3 on 2.2.2010 in the<br \/>\nRegistry of this Court. The name of Sri Vijay Kumar, learned Counsel<br \/>\nfor the opposite party No.3 has also been shown in the cause list but<br \/>\n neither he is present nor there is any request for pass over or<br \/>\nadjournment of the case.\n<\/p>\n<p id=\"p_3\">Learned Counsel for the petitioner submits that on one hand, counsel<br \/>\nfor the opposite party No.3 did not turn up before this Court and on the<br \/>\nother hand, opposite party No.3, who is a practicing Advocate in District<br \/>\nKheri, tried to execute the orders passed by the Court below.\n<\/p>\n<p id=\"p_4\">Let Chief Judicial Magistrate, Lakhimpur Kheri be ensured the presence<br \/>\nof opposite party No.3-Smt. Kavita Verma, wife of Dileep Kumar Verma,<br \/>\ndaughter of Manohar Lal Verma, resident of Mohalla Gangotri Nagar,<br \/>\nNear Naurangabad City, Lakhimpur Kheri, on 4.8.2010, at 10.15 A.M.<br \/>\nbefore this Court.\n<\/p>\n<p id=\"p_5\">List the matter on 4.8.2010.\n<\/p>\n<p id=\"p_6\">Till the next date of listing, the execution of the order dated 18.4.2009<br \/>\npassed by the Civil Judge (Senior Division), Lakhimpur Kheri in Case<br \/>\nNo. 358\/08 under <a href=\"\/doc\/1449825\/\" id=\"a_4\">Section 24<\/a> of the Hindu Marriage Act and the order<br \/>\ndated 14.9.2009 passed by the District Judge, Lakhimpur Kheri in<br \/>\nRevision No. 17\/09 as contained in Annexure Nos. 1 and 2,<br \/>\nrespectively, to the writ petition, shall be kept in abeyance.\n<\/p>\n<p id=\"p_7\">Registry is directed to send a copy of this order to the Chief Judicial<br \/>\nMagistrate, Lakhimpur Kheri, for compliance of this order through FAX<br \/>\nas well as registered post.\n<\/p>\n<p id=\"p_8\">Order Date :- 22.7.2010<br \/>\nAjit\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Dileep Kumar Verma vs District Judge Lakhimpur Kheri &#8230; on 22 July, 2010 Court No. &#8211; 24 Case :- MISC.
