Chahar, Advocate, for the respondent.\n\n\nRajesh Bindal J.\n<\/pre>\n<p id=\"p_1\">               The State has filed the present appeal against the award of the<br \/>\nlearned court below passed under <a href=\"\/doc\/1517117\/\" id=\"a_1\">Section 18<\/a> of the Land Acquisition Act, 1894<br \/>\n(for short, &#8216;the Act&#8217;) seeking reduction in the compensation for the acquired land.\n<\/p>\n<p id=\"p_1\">               Briefly, the facts of the case are that the State of Haryana vide<br \/>\nnotification dated 10.1.1983 issued under <a href=\"\/doc\/43654\/\" id=\"a_1\">Section 4<\/a> of the Act, acquired the land<br \/>\nsituated in revenue estate of Village Jharsa, Tehsil and District Gurgaon, for the<br \/>\ndevelopment and utilisation of land as residential, commercial and industrial area<br \/>\nat Gurgaon. The Land Acquisition Collector assessed the market value of the land<br \/>\nat Rs. 60,000\/- per acre for chahi, Rs. 50,000\/- per acre for magda and Rs. 40,000\/-<br \/>\nper acre for gair mumkin kind of land. On reference under <a href=\"\/doc\/1517117\/\" id=\"a_2\">Section 18<\/a> of the Act,<br \/>\nthe learned court below vide award dated 14.9.1991, determined the market value<br \/>\nof the acquired land @ Rs. 136\/- per square yard upto depth of 10 yards from the<br \/>\nNational Highway No. 8 and @ Rs. 68\/- per square yard for the rear portion<br \/>\nbeyond the said depth.\n<\/p>\n<p id=\"p_2\">               Learned counsel for the parties do not dispute that the claim made in<br \/>\nthe appeal is squarely covered by judgment of this court in R. F. A. No. 2 of 1991<br \/>\n<a href=\"\/doc\/428885\/\" id=\"a_3\">Azad Singh vs The State of Haryana and another<\/a>, decided on 30.9.1997, whereby<br \/>\naward of the Reference Court was upheld. The amount of compensation assessed<br \/>\nin the present case is also in the same terms.
