DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/11\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\t\tRULE.\n<\/p>\n<p id=\"p_1\"> Learned APP waives service of notice of Rule for the<br \/>\nrespondent-State.\n<\/p>\n<p id=\"p_2\">2.\t\tThis<br \/>\nis an application preferred under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\nProcedure by the applicants who came to be arrested in connection<br \/>\nwith I- CR No. 14 of 2010  registered   with   Nakhatrana Police<br \/>\nStation,  for the offences punishable under <a href=\"\/doc\/1127741\/\" id=\"a_1\">Sections 4<\/a> <a href=\"\/doc\/1317063\/\" id=\"a_2\">465<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_3\">468<\/a>, <a href=\"\/doc\/1466184\/\" id=\"a_4\">471<\/a>,<br \/>\n<a href=\"\/doc\/988620\/\" id=\"a_5\">406<\/a>, <a href=\"\/doc\/1436241\/\" id=\"a_6\">420<\/a>, <a href=\"\/doc\/1897847\/\" id=\"a_7\">120B<\/a>  and <a href=\"\/doc\/112749\/\" id=\"a_8\">114<\/a>  of the IPC.\n<\/p>\n<p id=\"p_3\">3.\t\tLearned<br \/>\nAdvocate appearing for the applicants submits that the present<br \/>\napplicants-accused are alleged to have taken particular person before<br \/>\nthe Sub Registrar Office for execution of the document and has<br \/>\nidentified and thus about 34 sale deeds have been executed.  Learned<br \/>\nAdvocate further states that as all the sale deeds have been<br \/>\ncancelled by the  Civil Court and now the charge sheet is filed,<br \/>\npresent application may be allowed.\n<\/p>\n<p id=\"p_4\">4.\t\tLearned<br \/>\nAPP resisted the application referring to his role and submitted that<br \/>\nhe wished to take the person to the Sub Registrar Office for the<br \/>\nalleged transactions which have been cancelled.\n<\/p>\n<p id=\"p_5\">5.\t\tHaving<br \/>\nconsidered the rival submissions and perusal of the role attributed<br \/>\nto the applicants as reflected in the FIR and considering the nature<br \/>\nof offence and also the fact that now the charge sheet is filed and<br \/>\nthe case is based on  documentary evidence, present application<br \/>\ndeserves to be allowed and  is accordingly allowed. The applicants<br \/>\nare ordered to be enlarged on bail in connection with aforesaid<br \/>\noffences on executing a bond of Rs. 10,000\/- each [Rupees ten<br \/>\nthousand only] with one surety each of the like amount to the<br \/>\nsatisfaction of the Trial Court and subject to the conditions that<br \/>\nthey shall:\n<\/p>\n<p id=\"p_6\">[a]\tnot<br \/>\ntake undue advantage of they liberty or abuse their liberty;\n<\/p>\n<p id=\"p_7\">[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_8\">[c]\tsurrender<br \/>\ntheir passport, if any, to the lower Court within a week;\n<\/p>\n<p id=\"p_9\">[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p id=\"p_10\">[e]\tmark<br \/>\ntheir presence at the concerned Police Station on any day of every<br \/>\nfirst week of English calendar month between 9.00 AM and 2.00 PM.<br \/>\ntill the trial is over;\n<\/p>\n<p id=\"p_11\">[f]\tfurnish<br \/>\nthe present address of their residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change their<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_12\">[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p id=\"p_13\">[h]\tThe<br \/>\nauthorities will release the applicants only if they are not<br \/>\n\trequired in connection \twith any other offence for the time being.\n<\/p>\n<p id=\"p_14\">[I]\tIf<br \/>\nbreach of any of the above conditions is committed, the \tSessions<br \/>\nJudge concerned will be free to issue warrant or to take \tappropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_15\">4.\t\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p id=\"p_16\">5.\t\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicants on bail.\n<\/p>\n<p id=\"p_17\">6.\t\tRule<br \/>\nis made absolute to the aforesaid extent.\tDirect Service is<br \/>\npermitted.\n<\/p>\n<p id=\"p_18\">\t\t\t\t\t\t\t\t[ANANT<br \/>\nS.
