SINGLE No. - 4226 of 2010\n\nPetitioner :- Shailesh Bala Gautam And Others\nRespondent :- State Of U.P.Thro.Its Principal Secy.Medical Edu.Lucknow\nPetitioner Counsel :- Ram Prakash Verma\nRespondent Counsel :- C.S.C.,Shishir Jain\n\nHon'ble Rajiv Sharma,J.\n<\/pre>\n<p id=\"p_1\">Heard Mr. Ram Prakash Verma, learned Counsel for the petitioners and Mr.<br \/>\nShishir Jain, learned Counsel for the University.\n<\/p>\n<p id=\"p_1\">Brief facts of the petitioners&#8217; case are that the Central Council of<br \/>\nHomeopathy, New Delhi vide notification dated 24.9.2003 had prepared a<br \/>\nprogramme for BHMS Degree Course. All the petitioners were selected in<br \/>\nCPMT Batch &#8211; 2005 and after their counselling, they were allotted BHMS<br \/>\nBranch at Government Dr. Brij Kishore Homeopathic Medical College &amp;<br \/>\nHospital, Devkali, District Faizabad. In pursuance of the aforesaid allotment,<br \/>\nall the petitioners deposited the requisite fee and took admission in the<br \/>\naforesaid College on 5.10.2005. As the petitioners were declared successful in<br \/>\n3rd BHMS examination, they deposited fees and and since then, they are<br \/>\ntaking classes regularly.\n<\/p>\n<p id=\"p_2\">Petitioners&#8217; Counsel submits that according to notification dated 24.9.2003,<br \/>\nCentral Council of Homeopathy has prepared a programme for BHMS Degree<br \/>\ncourse in which para 10 (11) of Regulation provides that those students who<br \/>\nhave completed 54 months from the date of admission, are entitled to appear<br \/>\nin fourth BHMS examination. Though they are eligible to appear in<br \/>\nexamination, yet the authorities are not providing examination forms. The<br \/>\nanxiety of the petitioners is that the fourth year examinations are likely to<br \/>\ncommence on 30th July, 2010. Lastly, he submits that the petitioners&#8217;<br \/>\ninstitution has been ignored, whereas in six other Medical Colleges from<br \/>\nwhere the students are pursing BHMS Degree Course, dates for examination<br \/>\nhave also been notified.\n<\/p>\n<p id=\"p_3\">Mr. Shishir Jain, learned Counsel for the University, on the basis of<br \/>\ninstructions, submits that the examination notification in which the petitioners<br \/>\nare pursing BHMS Degree Course has not yet been notified. Further, he<br \/>\nsubmits that as and when the examinations are notified, the case of the<br \/>\npetitioners shall be considered, in accordance with the provisions of bye-laws<br \/>\nand Government Orders issued from time to time. Next, he states that<br \/>\nnotification in any College, as alleged by the petitioners, has been issued.\n<\/p>\n<p id=\"p_4\">At this stage, learned Counsel for the petitioners submits that the petitioners<br \/>\nmoved a representation before the authority concerned and the same is<br \/>\npending disposal. He prays that ends of justice would be secured, if the<br \/>\nopposite party No.4 is directed to decide the representation dated 12.4.2010,<br \/>\nexpeditiously, to which Mr. Shishir Jain, learned Counsel for the University<br \/>\nhas no objection.\n<\/p>\n<p id=\"p_5\">Accordingly, without entering into the merits of the case, the opposite party<br \/>\n No. is directed to decide the representation of the petitioners dated 12.4.2010<br \/>\nwithin a maximum period of two months from the date of presentation of a<br \/>\ncertified copy of this order.
