M. SAHAI)<\/p>\n<p id=\"p_1\">1.\tWe have<br \/>\nheard learned counsel Mr. K.B. Pujara for the appellant, learned<br \/>\nAssistant Government Pleader Mr. N.J. Shah for respondent Nos.1 and<br \/>\n2, and learned counsel Mr. H.S. Munshaw for respondent No.3.\n<\/p>\n<p id=\"p_2\">2.\tThese<br \/>\nLetters Patent Appeals have been filed challenging order passed by<br \/>\nlearned Single Judge dated 14.5.2008, passed in Special Civil<br \/>\nApplication No.7388 of 2008 and Special Civil Application No.7389 of<br \/>\n2008.\n<\/p>\n<p id=\"p_3\">3.\tThe<br \/>\nfacts are that the appellants are blind. They applied for recruitment<br \/>\nfor the post of Vidhyasahayak (Music) pursuant to the advertisement<br \/>\ndated 17\/19.4.2007. Pursuant to the said advertisement, blind<br \/>\ncandidates were eligible and they were to be given priority over the<br \/>\nother candidates. The appellants filled in their forms, wherein they<br \/>\nclaimed that they belonged to Socially &amp; Economically Backward<br \/>\nClass (SEBC).  But, in support of their claims,  the appellants did<br \/>\nnot file any certificate as the appellants were under impression that<br \/>\nsince blind persons have got priority, as per the advertisement, they<br \/>\nwould be selected. However, since the appellants did not submit their<br \/>\ncaste certificate along with the applications, the respondents<br \/>\ntreated the appellants to be in Open General category and there, the<br \/>\nappellants could not succeed.\n<\/p>\n<p id=\"p_4\">4.\tIt is<br \/>\nadmitted to the counsel  for the respondents that had they been<br \/>\nconsidered in SEBC category, they would have secured first  and<br \/>\nsecond position respectively.\n<\/p>\n<p id=\"p_5\">5.\tThe<br \/>\nlearned counsel for the appellants has alleged in para 5 of the writ<br \/>\npetitions that other less meritorious candidates have been given<br \/>\nappointment in SEBC category. It has been stated that the appellants<br \/>\nclaimed that five candidates had also not submitted their SEBC<br \/>\ncertificates along with their applications, but their certificates<br \/>\nwere  subsequently accepted by the respondents at the time of<br \/>\ninterview on 2.5.2008. This fact was denied by learned counsel Mr.<br \/>\nH.S. Munshaw in the affidavit-in-reply filed on behalf of respondent<br \/>\nNo.3, which is taken on record. But, in para 2 itself, respondent<br \/>\nNo.3 has admitted that one candidate Mr. Bakul Dhrangi belonging to<br \/>\nScheduled Tribe category had also not submitted his caste<br \/>\ncertificate, but he was permitted to produce his caste certificate of<br \/>\nScheduled Tribe category at the time of interview.\n<\/p>\n<p id=\"p_6\">6.\tOn the<br \/>\nargument of the learned counsel for the parties, we are of the<br \/>\nconsidered opinion that once the respondents permitted Mr. Bakul<br \/>\nDhrangi to submit his caste certificate at the time of interview,<br \/>\nthough he had not submitted the caste certificate along with his<br \/>\napplication, similar being the case of the appellants in SEBC<br \/>\ncategory, the respondents were required to accept the caste<br \/>\ncertificates submitted by the appellants at the time of interview and<br \/>\nthey could not discriminate the appellants only on the ground that<br \/>\nthe caste certificate of  Scheduled Tribe category could be accepted<br \/>\nat the time of  interview. This reason given by the respondents is<br \/>\nnot acceptable to us and the action of the respondents is violative<br \/>\nof <a href=\"\/doc\/367586\/\" id=\"a_1\">Article 14<\/a> of the Constitution of India in view of the fact that<br \/>\nin SEBC category, the appellants have received the highest marks and<br \/>\nas a matter of fact, they are first two toppers who are blind but<br \/>\nhave topped even in SEBC category in spite of their handicap.\n<\/p>\n<p id=\"p_7\">7.\tIn the<br \/>\nresult, both these appeals succeed and are allowed. Order of the<br \/>\nlearned Single Judge dated 14.5.2008 passed in Special Civil<br \/>\nApplication No.7388 of 2008 and Special Civil Application No.7389 of<br \/>\n2008 is set aside. The respondents are directed to consider the caste<br \/>\ncertificates of the appellants in SEBC category and accept their<br \/>\ncaste certificates and adopt the same procedure for selection which<br \/>\nhas been adopted in the cases of other candidates. In case, the<br \/>\nappellants are found successful, they shall be considered for<br \/>\nappointment.
