Therefore, till it is remanded and decided again,<br \/>\n\tmerely because the decision is awaited, such petition cannot be<br \/>\n\tentertained on the ground of malafide as alleged.\n<\/p>\n<p id=\"p_2\">Learned<br \/>\n\tcounsel, Mr.Vaghela has stated that it is the Sarpanch, who has<br \/>\n\tissued the instruction without any basis or foundation for such<br \/>\n\tallegations.\n<\/p>\n<p id=\"p_3\">In<br \/>\n\tthe circumstances, the present petition cannot be entertained as<br \/>\n\tdiscretionary jurisdiction under <a href=\"\/doc\/1712542\/\" id=\"a_3\">Article 226<\/a> of the Constitution<br \/>\n\tof India cannot be exercised as it does not<br \/>\n\tcall for exercise of such discretion.\n<\/p>\n<p id=\"p_4\">Therefore,<br \/>\n\tthe present petition deserves to be dismissed and is accordingly<br \/>\n\tdismissed in limine.\n<\/p>\n<p id=\"p_5\">(RAJESH<br \/>\nH.SHUKLA, J.)<\/p>\n<p>\/patil<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Mohammadbhai vs Collector on 2 May, 2011 Author: Rajesh H.Shukla,&amp;Nbsp;
