However on not having received the<br \/>\ninformation within the mandated time, the Complainant filed a complaint under <a href=\"\/doc\/1083556\/\" id=\"a_1\">Section<br \/>\n18<\/a> of the RTI Act with the Commission. On this basis, the Commission issued a notice to<br \/>\nthe Respondent PIO on 11\/08\/2011 with a direction to provide the information to the<br \/>\nComplainant and further sought an explanation for not furnishing the information within<br \/>\nthe mandated time.\n<\/p>\n<p id=\"p_2\">       The Commission has neither received a copy of the information sent to the<br \/>\nComplainant, nor has it received any explanation from the PIO for not supplying the<br \/>\ninformation to the Complainant. Therefore, the only presumption that can be made is that<br \/>\nthe PIO has deliberately and without any reasonable cause refused to give information as<br \/>\nper the provisions of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. Failure on the part of the PIO to respond to the<br \/>\nCommission&#8217;s notice shows that there is no reasonable cause for the refusal of<br \/>\ninformation. The Commission also received a letter dated 15\/09\/2011 from the<br \/>\nComplainant alleging that till date no information has been received.\n<\/p>\n<p id=\"p_3\">Decision:\n<\/p>\n<p id=\"p_4\">The Complaint is allowed.\n<\/p>\n<p id=\"p_5\">        In view of the aforesaid, the PIO is hereby directed to provide the correct and<br \/>\ncomplete information in regard to the RTI Application dated 09\/03\/2011 to the<br \/>\nComplainant before 23\/11\/2011 with a copy to the Commission. From the facts before<br \/>\nthe Commission, it appears that you have not provided the correct and complete<br \/>\ninformation within the mandated time and has failed to comply with the provisions of the<br \/>\n<a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a>. The delay and inaction on the PIO&#8217;s part in providing the information amounts<br \/>\nto willful disobedience of the Commission&#8217;s direction as well and as raises a reasonable<br \/>\ndoubt that the denial of information may be malafide.\n<\/p>\n<p id=\"p_6\">         The PIO is hereby directed to send his written submissions to the Commission<br \/>\nbefore 28\/11\/2011 to show cause as to why penalty should not be imposed and<br \/>\ndisciplinary action be not recommended against him under <a href=\"\/doc\/1369783\/\" id=\"a_3\">Section 20<\/a> (1) and (2) of the<br \/>\n<a href=\"\/doc\/671631\/\" id=\"a_4\">RTI Act<\/a> for not providing the information to the Complainant within the stipulated time<br \/>\nperiod of 30 days.
