Justice R.BASANT\n\n Dated :13\/07\/2007\n\n O R D E R\n                                   R.BASANT, J\n\n                         ------------------------------------\n\n                             B.A.No.4015 of 2007\n\n                         -------------------------------------\n\n                     Dated this the 13th day of July, 2007\n\n\n                                      ORDER\n<\/pre>\n<p id=\"p_1\">       Application for anticipatory bail.   The petitioners are accused 1<\/p>\n<p>and 2.  They are son-in-law of the defacto complainant and brother of<\/p>\n<p>the son-in-law of the defacto complainant.  The crux of the allegations<\/p>\n<p>is that on 23.5.07 at 7 p.m, the accused persons along with two others<\/p>\n<p>trespassed into the house of the defacto complainant and attacked the<\/p>\n<p>defacto   complainant,   his   son   and   his   employee   with   dangerous<\/p>\n<p>weapons.     The   defacto   complainant   suffered   fairly   serious   injuries.<\/p>\n<p>The incident took place at 7  p.m  and  at 7.45  p.m the injured was  at<\/p>\n<p>hospital and  had  narrated  to  the doctor the alleged  cause as  assault<\/p>\n<p>by   the   son   in   law.     F.I   statement   was   registered   when   the   defacto<\/p>\n<p>complainant   was   undergoing   treatment   on   29.05.2007   only.<\/p>\n<p>Investigation   is   in   progress.     The   petitioners   apprehend   imminent<\/p>\n<p>arrest.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       2.     The   learned   counsel   for   the   petitioners   submits   that   the<\/p>\n<p>petitioners   are   absolutely   innocent.     He   submits   that   actually   a<\/p>\n<p>different  incident had taken place  on 22.5.07  and apprehending that<\/p>\n<p>action may be taken in respect of that incident in which the son of the<\/p>\n<p>defacto   complainant   is   the   aggressor,   the   present   false   allegations<\/p>\n<p>have been raised.   Actually the incident had taken place on 22.05.07<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.4015 of 2007                           2<\/span><\/p>\n<p>and   no   incident   at   all   had   taken   place   on   23.05.07.     Both   the<\/p>\n<p>petitioners   are   well   employed.     Arrest   and   incarceration   is   likely   to<\/p>\n<p>affect   the   prospectus   of   their   continuing   in   employment.     In   these<\/p>\n<p>circumstances it is prayed that directions under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> Cr.P.C in<\/p>\n<p>favour of the petitioner may be issued.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">       3.      The   learned   Public   Prosecutor     opposes   the   application.<\/p>\n<p>The   learned   Public   Prosecutor     submits   that   the   allegations   are<\/p>\n<p>serious and grave.  Father-in-law\/defacto complainant was attacked at<\/p>\n<p>his house with dangerous weapons.   Fairly serious injuries have been<\/p>\n<p>caused   to   him.     The   wound   certificate   clearly   suggests   that   the<\/p>\n<p>injuries were suffered on 23.05.07  only and it is unlikely that having<\/p>\n<p>suffered   the   injuries   on   the   previous   date,   the   defacto   complainant<\/p>\n<p>would   have   waited   for   one   day   to   go   to   the   doctor.     Whatever   may<\/p>\n<p>have  happened on  the previous  day,  that  has   no bearing  whatsoever<\/p>\n<p>on   the   facts   in   controversy   in   the   present   case,   it   is   submitted.     In<\/p>\n<p>these   circumstances   it   is   prayed   that   anticipatory   bail   may   not   be<\/p>\n<p>granted   to   the   petitioners.     They   may   be   directed   to   resort   to   the<\/p>\n<p>ordinary   and   normal   course   of   appearing   before   the   investigator   or<\/p>\n<p>the learned Magistrate and seek regular bail.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">       4.      I   find   merit   in   the   opposition   of   the   learned   Public<\/p>\n<p>Prosecutor.     I   have   already   referred   to   the   skeletal   facts.     A   more<\/p>\n<p>detailed   reference   to   facts   or   an   attempt   to   resolve   the   facts   in<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.4015 of 2007                           3<\/span><\/p>\n<p>controversy   is   not   necessary   at   all.     I   am   satisfied   that   there   is   no<\/p>\n<p>justification   in   the   prayer   to   invoke   the   extraordinary   equitable<\/p>\n<p>discretion  under   <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section  438<\/a>   Cr.P.C.     The  petitioners  must   resort   to<\/p>\n<p>the ordinary and normal course of appearing before the Investigating<\/p>\n<p>Officer or the learned Magistrate having jurisdiction.  They must then<\/p>\n<p>seek bail.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">         5.
