Justice K.HEMA\n\n Dated :25\/05\/2010\n\n O R D E R\n                             K.HEMA, J.\n           ----------------------------------------------\n               Bail Application No.2957 of 2010\n           ----------------------------------------------\n                       Dated 25th May, 2010.\n\n                              O R D E R\n<\/pre>\n<p id=\"p_1\">           This petition is for anticipatory bail.\n<\/p>\n<p id=\"p_1\">           2. The alleged offence is under Section 55(a) of the<\/p>\n<p>Kerala Abkari Act. According to prosecution, Preventive Officer<\/p>\n<p>and party found petitioner carrying 5 litres of arrack in a 5 litre<\/p>\n<p>can. Petitioner could not be arrested, since there was no woman<\/p>\n<p>Police Constable in the police party.\n<\/p>\n<p id=\"p_2\">           3. Learned counsel for the petitioner submitted that<\/p>\n<p>petitioner is a coolie and her husband is paralysed since 2007.<\/p>\n<p>She is the only person, who looks after her husband and she was<\/p>\n<p>not involved in the crime as alleged. Petitioner was available in<\/p>\n<p>the house and she was not absconding.             Petitioner was not<\/p>\n<p>arrested from the spot. The allegations made against petitioner<\/p>\n<p>are not correct, it is submitted. It is also submitted that petitioner<\/p>\n<p>was not even aware of registration of the crime against her.<\/p>\n<p id=\"p_3\">           4. Learned Public Prosecutor submitted that petitioner<\/p>\n<p>was not arrested since no woman Police Constable was present<\/p>\n<p>and thereafter, petitioner was not available in the house. It is also<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">BA NO.2957\/10                       2<\/span><\/p>\n<p>submitted that charge sheet has been filed.\n<\/p>\n<p id=\"p_4\">           5.   On hearing both sides and considering the non-<\/p>\n<p>arrest of petitioner for a long time, it appears to me that<\/p>\n<p>respondent does not intend to arrest petitioner. But while<\/p>\n<p>submitting the charge, she was shown as absconding. In case<\/p>\n<p>petitioner is arrested, it is likely that she will be remanded. There<\/p>\n<p>is no case that petitioner is involved in any other offence. In the<\/p>\n<p>peculiar facts and circumstances of the case, I am inclined to<\/p>\n<p>grant anticipatory bail to petitioner. Hence, the following order is<\/p>\n<p>passed :\n<\/p>\n<blockquote id=\"blockquote_1\"><p>           Petitioner shall surrender before the Magistrate Court<\/p>\n<p>           concerned within seven days from today and she shall<\/p>\n<p>           be released on bail, on her executing a bond for<\/p>\n<p>           Rs.25,000\/- (Rupees twenty five thousand only) with<\/p>\n<p>           two solvent sureties each for the like sum to the<\/p>\n<p>           satisfaction of the learned Magistrate, on the following<\/p>\n<p>           conditions :\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                  (i)    Petitioner    shall   report    before   the<\/p>\n<p>                        Investigating Officer       on every Monday<\/p>\n<p>                        between 10 a.m. and 1 p.m. until further<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">BA NO.2957\/10                  3<\/span><\/p>\n<p>                     orders.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>               (ii) In case petitioner is involved in any offence<\/p>\n<p>                     of similar nature, her bail is liable to be<\/p>\n<p>                     cancelled.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                         Petition is allowed.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\">\n<\/blockquote>\n<blockquote id=\"blockquote_5\"><p>                                           K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\">\n<\/blockquote>\n<blockquote id=\"blockquote_7\"><p>tgs<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court C.Paaru vs The State Of Kerala on 25 May, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 2957 of 2010() 1.
