Having   considered the rival<br \/>\nsubmissions made by the learned Advocates for the parties,  the role<br \/>\nattributed to the applicant as reflected in the FIR, police papers,<br \/>\nstatements of witnesses,  quantum of punishment, gravity of the<br \/>\noffences and the manner in which the alleged offences are committed<br \/>\nby the applicant, the application deserves to be allowed and the<br \/>\napplicant is ordered to be enlarged on bail in connection with<br \/>\naforesaid offences on executing a bond of Rs.20,000\/- [Rupees twenty<br \/>\nthousand only] with one surety of the like amount to the satisfaction<br \/>\nof the Trial Court and subject to the conditions that she shall:\n<\/p>\n<p id=\"p_2\">[a]\tnot<br \/>\ntake undue advantage of her liberty or abuse her liberty;\n<\/p>\n<p id=\"p_3\">[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_4\">[c]\tsurrender<br \/>\nher passport, if any, to the lower Court within a week;\n<\/p>\n<p id=\"p_5\">[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p id=\"p_6\">[e]\tfurnish<br \/>\nthe present address of her residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change her<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_7\">[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p id=\"p_8\">3.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_9\">4.\t\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p id=\"p_10\">5.\t\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_11\">6.\t\tRule<br \/>\nis made absolute to the aforesaid extent.\tDirect Service is<br \/>\npermitted.\n<\/p>\n<p id=\"p_12\">\t\t\t\t\t\t\t\t[H.B.ANTANI,<br \/>\nJ.]<\/p>\n<p>msp<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Shayera vs State on 8 July, 2010 Author: H.B.Antani,&amp;Nbsp;
