DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/11\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tRule.\n<\/p>\n<p id=\"p_1\">Learned APP, waives service of notice of Rule for respondent &#8211; State.\n<\/p>\n<p id=\"p_2\">2.\tThis<br \/>\napplication is filed under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-89\/2010 with Thara Police Station, District: Banaskantha, for<br \/>\nthe offences punishable under <a href=\"\/doc\/1146308\/\" id=\"a_1\">Sections 366<\/a>, <a href=\"\/doc\/445276\/\" id=\"a_2\">504<\/a>, <a href=\"\/doc\/445276\/\" id=\"a_3\">506(2)<\/a> and <a href=\"\/doc\/989759\/\" id=\"a_4\">114<\/a> etc.<br \/>\nof<a href=\"\/doc\/1569253\/\" id=\"a_5\"> the Indian Penal Code<\/a>.\n<\/p>\n<p id=\"p_3\">3.\tLearned<br \/>\ncounsel for the applicant submits that the applicant is Uncle of the<br \/>\naccused No.1 [Yogeshbhai Waghjibhai Thakkar] and allegations are to<br \/>\nthe extent that the applicant had abused the complainant and<br \/>\nthreatened him with dire consequences.  It is further submitted that<br \/>\naccused No.1 and daughter of the complainant had entered into<br \/>\nmatrimonial relationship and certificate to that extent issued by<br \/>\nArya Samaj Mumbai dated 25.7.2010 is produced on record.<br \/>\nConsidering the above, the applicant may be granted anticipatory<br \/>\nbail.\n<\/p>\n<p id=\"p_4\">4.\tHeard<br \/>\nLearned APP for the respondent &#8211; State.\n<\/p>\n<p id=\"p_5\">5.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and considering the above facts,  I am inclined to grant<br \/>\nanticipatory bail to the applicant.\n<\/p>\n<p id=\"p_6\">5.1.\tIt<br \/>\nis further stated that, by an order dated 14.10.2010 further<br \/>\ninvestigation to the FIR is stayed by this Court.  In case, if the<br \/>\nstay granted in the Criminal Misc. Application No.12358 of 2010 is<br \/>\nvacated or modified or confirmed, I.O. shall take action in<br \/>\naccordance with law and if the applicant is called, he may report to<br \/>\nthe investigating officer if required.\n<\/p>\n<p id=\"p_7\">6.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_8\">7.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicant herein being arrested pursuant to FIR being CR<br \/>\nNo.I-89\/2010 with Thara Police Station, District: Banaskantha, the<br \/>\napplicant shall be released on bail on furnishing a bond of<br \/>\nRs.5,000\/- (Rupees Five Thousand only) with one surety of like amount<br \/>\non following conditions :-\n<\/p>\n<p id=\"p_9\">shall<br \/>\n\tcooperate with the investigation and make available for whenever<br \/>\n\trequired;\n<\/p>\n<p id=\"p_10\">shall<br \/>\n\tnot hamper the investigation in any manner nor shall directly or<br \/>\n\tindirectly make any inducement, threat or promise to any witness so<br \/>\n\tas to dissuade them for disclosing such facts to the Court or to any<br \/>\n\tPolice Officer;\n<\/p>\n<p id=\"p_11\">at<br \/>\n\tthe time of execution of bond, furnish the address to  the<br \/>\n\tInvestigating Officer and the court concerned and shall not change<br \/>\n\tthe residence till the final disposal of the case of till further<br \/>\n\torders;\n<\/p>\n<p id=\"p_12\">will<br \/>\n\t not  leave India without the permission of the Court and, if is<br \/>\n\tholding a passport, shall surrender the same before the trial Court<br \/>\n\twithin a week;\n<\/p>\n<p id=\"p_13\">it<br \/>\n\twould be open to the Investigating Officer to file an application<br \/>\n\tfor remand, if he considers it just and proper and the concerned<br \/>\n\tMagistrate would decide it on merits;\n<\/p>\n<p id=\"p_14\">this<br \/>\n\torder will be operative if the applicant is arrested at any time<br \/>\n\twithin a period of 90 days;\n<\/p>\n<p id=\"p_15\">within<br \/>\n\ta period of ten days from the date of arrest, the applicant shall<br \/>\n\tapply for regular bail which application shall be decided by the<br \/>\n\tcompetent Court in accordance with law without being influenced by<br \/>\n\tthe fact that anticipatory bail was granted.\n<\/p>\n<p id=\"p_16\">8.\tWith<br \/>\nthese directions, this Criminal Misc.
