Justice ANTONY DOMINIC\n\n Dated :23\/06\/2009\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ================\n                 W.P.(C) NO. 26907 OF 2004 (C)\n                 =====================\n\n            Dated this the 23rd day of June, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      First petitioner is the landlord and the second petitioner is<\/p>\n<p>the tenant. In the building, the tenant is running a hotel and is<\/p>\n<p>availing of supply of electricity with three consumer numbers.<\/p>\n<p id=\"p_1\">      2.    The Anti Power Theft Squad of the Board had<\/p>\n<p>conducted an inspection of the premises on 17\/10\/2001 and<\/p>\n<p>Ext.P1 series are the three mahazars prepared. In all the three<\/p>\n<p>consumer numbers, unauthorised additional load of 2 KW, 23KW<\/p>\n<p>and 12 KW respectively were found. Accordingly, Ext.P2 series of<\/p>\n<p>bills were issued and the 1st petitioner filed Ext.P3 appeal to the<\/p>\n<p>2nd respondent. The appeal was rejected as per Ext.P7.          It is<\/p>\n<p>challenging Ext.P7 the writ petition is filed.<\/p>\n<p id=\"p_2\">      3.    The contention raised by the counsel for the petitioners<\/p>\n<p>is confined to the levy of twice the energy charges as penalty in<\/p>\n<p>addition to fixed charges at 3 times. It is stated that such levy is<\/p>\n<p>not contemplated under Regulation 42 and 43 of the Conditions of<\/p>\n<p>Supply of Electrical Energy. Counsel also placed reliance on the<\/p>\n<p>judgment of this Court in <a href=\"\/doc\/591487\/\" id=\"a_1\">George Joseph v. K.S.E.B<\/a> (2008(4)<\/p>\n<p>WPC 26907\/04<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 :2 :<\/span><\/p>\n<p>KLT 610).\n<\/p>\n<p id=\"p_3\">      4.   On the other hand, the counsel for the Board referred<\/p>\n<p>me to the tariff order of 2002, in terms of which, according to her,<\/p>\n<p>fixed charge plus energy charge is leviable.        It is therefore<\/p>\n<p>submitted that energy charges cannot be separated from fixed<\/p>\n<p>charges when penalty is to be levied. Reference is also made to<\/p>\n<p>the judgment of the Apex Court in <a href=\"\/doc\/182288452\/\" id=\"a_1\">Municipal Corporation,<\/p>\n<p>Delhi v. Asian Art Printers (P) Ltd<\/a>. (AIR 1995 SC 196) where<\/p>\n<p>the Apex Court has accepted the contention identical to the one<\/p>\n<p>raised by the counsel for the Board referring to the tariff order<\/p>\n<p>issued by the Municipal Corporation, Delhi. Counsel for the Board<\/p>\n<p>also placed considerable reliance on the judgment rendered by<\/p>\n<p>the Division Bench of this Court in WA No.1231\/2003, where<\/p>\n<p>according to the counsel, the Division Bench has accepted the<\/p>\n<p>competence of the Board to levy twice the energy charges as<\/p>\n<p>penalty prior to 18\/9\/2002 when the Board issued a notification<\/p>\n<p>reducing the penalty on detection of unauthorised additional load.<\/p>\n<p id=\"p_4\">      5.   A reading of Ext.P2 series of invoices show that the<\/p>\n<p>petitioner has been penalised both by levying fixed charges and<\/p>\n<p>also energy charges. The dispute in this writ petition is confined<\/p>\n<p>WPC 26907\/04<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 :3 :<\/span><\/p>\n<p>to the levy of energy charges only.\n<\/p>\n<p id=\"p_5\">       6.  In so far as levy of penalty is concerned, that is<\/p>\n<p>governed by Clauses 42 and 43 of the Conditions of Supply of<\/p>\n<p>Electrical Energy. In the judgment in <a href=\"\/doc\/591487\/\" id=\"a_2\">George Joseph v. K.S.E.B<\/a><\/p>\n<p>(2008(4) KLT 610) referred to by the counsel for the petitioner<\/p>\n<p>interpreting Clause 43 of the Conditions of Supply, a learned<\/p>\n<p>Judge of this Court has held that such penalty is leviable only in<\/p>\n<p>the case of theft of energy.      In this case also, neither in the<\/p>\n<p>mahazar or elsewhere, is there a case for the Board that there has<\/p>\n<p>been theft of energy committed by the petitioners. If that be so,<\/p>\n<p>Clause 43 is inapplicable to the case of the petitioners.<\/p>\n<p id=\"p_6\">       7.  However Clause 42(d) of the Conditions of Supply of<\/p>\n<p>Electrical Energy provides that in cases where the consumer<\/p>\n<p>exceeds the contract load without the prior permission of the<\/p>\n<p>Board, that amounts to misuse of energy and the consumer is<\/p>\n<p>liable to be billed at thrice the rate applicable for the respective<\/p>\n<p>tariff. Regular energy bill having already been issued ,as per the<\/p>\n<p>impugned demand, twice the energy charges are demanded.<\/p>\n<p id=\"p_7\">       8.  In my view, this is a case where the contract load has<\/p>\n<p>been exceeded by the petitioner. If that be so, the levy of penalty<\/p>\n<p>WPC 26907\/04<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                  :4 :<\/span><\/p>\n<p>as done by Ext.P2 bill is permissible in terms of Clause 42(d) of<\/p>\n<p>the Conditions of Supply of Electrical Energy. However, illegality<\/p>\n<p>in the uniform levy of penalty as provided under Clause 42(d) of<\/p>\n<p>the Conditions of Supply has already engaged the attention of a<\/p>\n<p>Division Bench in the judgment in WA 1231\/2003 where the<\/p>\n<p>Division Bench has directed that the Board shall examine each of<\/p>\n<p>the cases and decide on the penalty to be levied depending upon<\/p>\n<p>the culpability of the consumer concerned.\n<\/p>\n<p id=\"p_8\">      9.   It is now informed that the benefit of this judgment has<\/p>\n<p>been uniformly made applicable by issuing general directions. If<\/p>\n<p>that be so, necessarily, the petitioner should also get the benefit<\/p>\n<p>of such reduction.
