No. I &#8211; 15 of 2010  registered with  Gondal City Police<br \/>\nStation, Rajkot for the offence punishable under <a href=\"\/doc\/764237\/\" id=\"a_1\">sections 394<\/a>, <a href=\"\/doc\/1119707\/\" id=\"a_2\">395<\/a>,<br \/>\n<a href=\"\/doc\/958439\/\" id=\"a_3\">396<\/a>, <a href=\"\/doc\/1865117\/\" id=\"a_4\">397<\/a>, <a href=\"\/doc\/1560742\/\" id=\"a_5\">302<\/a>, <a href=\"\/doc\/1128948\/\" id=\"a_6\">120(B)<\/a>, <a href=\"\/doc\/386021\/\" id=\"a_7\">201<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_8\">114<\/a> of the Indian Penal Code and<br \/>\n<a href=\"\/doc\/1961417\/\" id=\"a_9\">Section 25<\/a>(1-B)<a href=\"\/doc\/1934415\/\" id=\"a_10\">(A) of Arms Act<\/a> and Section 135 of the Bombay Police<br \/>\nAct.\n<\/p>\n<p id=\"p_1\">\tLearned<br \/>\nadvocate for the applicants submitted that the applicants are<br \/>\ninnocent persons and a false case is foisted on them. He has<br \/>\nsubmitted that the co-accused have been released by this Court in<br \/>\nCriminal Misc. Application No.9623 of 2010 dated 26.08.2010, Criminal<br \/>\nMisc. Application No.9764 of 2010 dated 25.08.2010, Criminal Misc.<br \/>\nApplication No.6855 of 2010 dated 29.07.2010 and Criminal Misc.<br \/>\nApplication No.8696 of 2010 dated 10.08.2010. He submitted that<br \/>\nconsidering the roles attributed to the applicants and reflected in<br \/>\nthe FIR at Annexure &#8216;A&#8217; to the application, this is a fit case to<br \/>\nenlarge the applicants on regular bail.\n<\/p>\n<p id=\"p_2\">\tAs against<br \/>\nthe aforesaid, learned APP submitted that considering the role played<br \/>\nby the applicants, no discretionary relief can be granted to the<br \/>\napplicants, and the application deserves to be dismissed.\n<\/p>\n<p id=\"p_3\">\tHaving<br \/>\nheard the rival submissions of learned advocates and having<br \/>\nconsidered the role attributed to the applicants and reflected in the<br \/>\nFIR at Annexure A,  the quantum of punishment etc. and  the<br \/>\nco-accused is released by this Court, I am of the view that the<br \/>\napplicants are required to be enlarged on regular bail at this stage<br \/>\non stringent conditions, without entering into the merits of the case<br \/>\nand  without discussing the evidence in detail.\n<\/p>\n<p id=\"p_4\">\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p id=\"p_5\">\tIn the<br \/>\nfacts and circumstances of the case, the application is allowed and<br \/>\nthe applicants  are ordered to be enlarged on bail in connection with<br \/>\n C.R. No. I &#8211; 15 of 2010  registered with  Gondal City Police<br \/>\nStation, Rajkot, on their executing a bond of Rs.10,000\/-  [Rupees<br \/>\nTen thousand only] each with one surety of the like amount to the<br \/>\nsatisfaction of the trial court and subject to the conditions that<br \/>\nthey shall:\n<\/p>\n<p id=\"p_6\">[a]\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p id=\"p_7\">[b].\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_8\">[c].\tsurrender<br \/>\ntheir passports, if any, to the lower court within a week;\n<\/p>\n<p id=\"p_9\">[d].\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p id=\"p_10\">[e].\tmark<br \/>\ntheir presence at the concerned Police Station on 15th day<br \/>\nof each English calendar month between 9.00 AM and 2.00 PM. till the<br \/>\ntrial is over;\n<\/p>\n<p id=\"p_11\">[f].\tfurnish<br \/>\nthe present addresses of their residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change their<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_12\">[g].\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p id=\"p_13\">\tIf breach<br \/>\nof any of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or to take appropriate action<br \/>\nin the matter.\n<\/p>\n<p id=\"p_14\">\tBail bond<br \/>\nto be executed before the lower Court having jurisdiction to try the<br \/>\ncase.\n<\/p>\n<p id=\"p_15\">\tAt the<br \/>\ntrial, the trial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicants on bail.\n<\/p>\n<p id=\"p_16\">\tRule is<br \/>\nmade absolute to the aforesaid extent.
