PUBLIC PROSECUTOR\nfor Respondent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 17\/11\/2011\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">By<br \/>\n\tway of present application, wife of the prisoner, has prayed to<br \/>\n\trelease her husband on parole leave for a period of 30 days on the<br \/>\n\tground of marriage of her daughter.\n<\/p>\n<p id=\"p_1\">Heard<br \/>\n\tYasminben Imtiazbhai, Party-in-Person and Ms.C.M. Shah, learned<br \/>\n\tAdditional Public Prosecutor for the respondent-State and also<br \/>\n\tperused papers produced before me.\n<\/p>\n<p id=\"p_2\">Ms.Yasminben,<br \/>\n\twife of the prisoner, has contended that marriage of his daughter is<br \/>\n\tfixed on 25 and 26th November, 2011 and as a father,<br \/>\n\tpresence of the prisoner is necessary. She has further contended<br \/>\n\tthat his son is out of India. She, therefore, prayed to release the<br \/>\n\tprisoner on parole for a period of 30 days.\n<\/p>\n<p id=\"p_3\">It<br \/>\n\tappears from the jail report that earlier when he was released on<br \/>\n\tparole, he had never surrendered himself on time. The conduct of the<br \/>\n\tapplicant shows that he is a habitual offender and therefore, there<br \/>\n\tare chances of absconding if the prisoner be released on parole.<br \/>\n\tHence, the present application deserves to be dismissed and is<br \/>\n\thereby dismissed.\n<\/p>\n<p id=\"p_4\">(Z.\n<\/p>\n<p id=\"p_5\">K.
