Chini Prasad,\n                                     Vill- Masoompur, Behri,\n                                     Dist- Baliya, U.P.\n\n\nName of the Public Authority     :   CPIO, Central Bank of India,\n                                     Behri Branch, Masoompur,\n                                     Dist- Baliya, U.P.\n\n\n       The Complainant was present along with Shri C.L. Verma.\n\n       No one was present on behalf of the Respondent in spite of notice.<\/pre>\n<p>       The brief facts of the case are as under.\n<\/p>\n<p>2.     In this case, the Appellant had sent two different applications, both<br \/>\ndated 29 August 2007 and addressed to the Branch Manager\/CPIO seeking<br \/>\ninformation about the PMRY loans and about the CC account number 2 of<br \/>\none Jayamani Fertilizers of which the Appellant was the proprietor. His<br \/>\nrequest was transferred to the relevant CPIO who replied on 27 September<br \/>\n2007 and provided the desired information in regard to one of the<br \/>\napplications, namely, concerning the PMRY loans. However, he received no<br \/>\nreply or information in respect of his other application of the same date. He<br \/>\nhad also sent a communication to the Headquarters of the Bank complaining<br \/>\nthat the desired information had not been provided to him. Simultaneously,<br \/>\nhe had sent an appeal to the SIC, Lucknow. That appeal has come to us on<br \/>\ntransfer.\n<\/p>\n<p>3.     During the hearing, the Appellant was present in person and made his<br \/>\nsubmissions. In spite of notice, the Respondent was not present. The case<\/p>\n<p>CIC\/PB\/C\/2008\/00776-SM<br \/>\n was heard in his absence. It is highly objectionable that the Respondent<br \/>\nshould not be present to assist the Commission in this hearing. We found<br \/>\nthat while the CPIO had provided the desired information in regard to one of<br \/>\nthe applications, he was silent on the other application. We now direct the<br \/>\nCPIO to provide to the Appellant within 10 working days from the receipt of<br \/>\nthis order the desired information regarding the CC account number 2 of the<br \/>\nJayamani Fertilisers in the Baheri Branch of the Bank in Balia District. A<br \/>\ncopy of the Complainant&#8217;s application dated 29 August 2007 be also sent as<br \/>\nan enclosure with our order for the information of the CPIO. We would also<br \/>\nlike the CPIO to explain in writing within 10 working days from the receipt<br \/>\nof this order the reasons for not responding to this application within the<br \/>\nstipulated period. If we do not receive his explanation in time, we will<br \/>\nproceed to decide on imposing penalty on him under Section 20 of the Right<br \/>\nto Information (RTI) Act.\n<\/p>\n<p>4.     With the above directions, the appeal is disposed off.\n<\/p>\n<p>5.
