M. SAHAI)<\/p>\n<p id=\"p_1\">1.\tWe have<br \/>\nheard learned counsel Mr. D.G. Chauhan for the appellant and Mr.<br \/>\nYogen Pandya for the respondent.\n<\/p>\n<p id=\"p_2\">2.\tIn the<br \/>\nwrit petitions filed by learned counsel Mr. Yogen Pandya, interim<br \/>\norder has been passed, directing the present appellant to deposit the<br \/>\nentire amount of compensation awarded by the Industrial Court under<br \/>\nthe Bombay Industrial Relation Act, 1946.\n<\/p>\n<p id=\"p_3\">3.\tLearned<br \/>\ncounsel for the respondent has fairly stated that in his petitions,<br \/>\nthe respondent workmen were not claiming that they may be given the<br \/>\namount of compensation. What they were claiming before the learned<br \/>\nSingle Judge in the writ petitions was that they are entitled to<br \/>\nreinstatement in service along with back wages and they are not<br \/>\ninterested in compensation.\n<\/p>\n<p id=\"p_4\">4.\tLearned<br \/>\ncounsel Mr. D.G. Chauhan informed the Court that he has also filed<br \/>\nSpecial Civil Application Nos. 5162 of 2011, 5163 of 2011, 5165 of<br \/>\n2011, 5166 of 2011 and 5167 of 2011.\n<\/p>\n<p id=\"p_5\">5.\tTherefore,<br \/>\ninterest of justice demands that the writ petitions filed by the<br \/>\nlearned counsel for the parties be heard and decided together. Since<br \/>\nthe respondent workmen are not interested in compensation awarded by<br \/>\nthe Industrial Court, it will be futile to direct the appellant to<br \/>\ndeposit the amount of compensation as directed by the learned Single<br \/>\nJudge by interim order dated 27.6.2011.\n<\/p>\n<p id=\"p_6\">6.\tIn view<br \/>\nof the peculiar facts and circumstances of the case, the present<br \/>\nAppeals are allowed. The interim order granted by the learned Single<br \/>\nJudge on 27.6.2011 is set aside.
