Provisions regarding lift space and safety from fire and -do-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>         of the building.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>Ground of First Appeal:\n<\/p><\/blockquote>\n<p id=\"p_5\">No information received from the PIO.\n<\/p>\n<p id=\"p_6\"> First Appellate Authority (FAA) ordered:\n<\/p>\n<p id=\"p_7\">No hearing till date.\n<\/p>\n<p id=\"p_8\">Ground of the Second Appeal:\n<\/p>\n<p id=\"p_9\">Unsatisfactory information provided by the PIO.\n<\/p>\n<p id=\"p_10\">Relevant Facts emerging during Hearing:\n<\/p>\n<p id=\"p_11\">The following were present<br \/>\nAppellant: Mr. Gurjeet Singh;\n<\/p>\n<p id=\"p_12\">Respondent: Mr. H. S. Singh, EE(B-I) on behalf of Mr. Arun Kumar, PIO &amp; SE;\n<\/p>\n<p id=\"p_13\">        The PIO has taken a correct position that Right to Information means providing the<br \/>\ninformation based on records available. The Appellant is actually seeking clarification and<br \/>\ninterpretation of the building rules. Whereas it would be desirable that various public authorities<br \/>\ninteracting with citizens have their rules in a manner which can be easily understood by the<br \/>\ncitizens, RTI cannot provide this by itself. During the discussion it emerged that the appellant<br \/>\nwas seeking information about the FAR in case where the plot size is 104.5Sq.meters. The PIO<br \/>\nhas provided the information verbally that rule 4.4.3.(5)-(A-2) of MPD-2021 would apply. The<br \/>\nPIO is directed to provide a photocopy of this to the appellant.\n<\/p>\n<p id=\"p_14\">The RTI application had been filed on 29\/01\/2010 and the information provided was very simple<br \/>\nstating that the bye-laws of MPD-2021 would apply. To provide this simple information it has<br \/>\ntaken nearly three month and information was supplied on 09\/04\/2010.\n<\/p>\n<p id=\"p_15\">Decision:\n<\/p>\n<p id=\"p_16\">The Appeal is disposed.\n<\/p>\n<p id=\"p_17\">      The PIO is directed to provide a copy of the rule as mentioned above to the<br \/>\nAppellant before 10 June 2010.\n<\/p>\n<p id=\"p_18\">The issue before the Commission is of not supplying the complete, required information by<br \/>\nthe PIO within 30 days as required by the law.\n<\/p>\n<p id=\"p_19\">From the facts before the Commission it is apparent that the PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within<br \/>\n30 days, as per the requirement of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. It appears that the PIO&#8217;s actions attract the penal<br \/>\nprovisions of <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> (1). A showcause notice is being issued to him, and he is directed give<br \/>\nhis reasons to the Commission to show cause why penalty should not be levied on him.\n<\/p>\n<p id=\"p_20\">He will present himself before the Commission at the above address on 29 June 2010 at 4.30pm<br \/>\nalongwith his written submissions showing cause why penalty should not be imposed on him as<br \/>\nmandated under <a href=\"\/doc\/1369783\/\" id=\"a_2\">Section 20<\/a> (1).
