In<br \/>\n\tthis matter, application has been made by petitioner to Motor<br \/>\n\tAccident Claims Tribunal, Sabarkantha at Himmmatnagar with a prayer<br \/>\n\tto permit withdrawal of amount, which has been deposited by Motor<br \/>\n\tAccident Claims Tribunal at relevant time. Now petitioner has<br \/>\n\tattained majority and having age of more than 22 years. Therefore,<br \/>\n\tconsidering this evidence, produced on record, Motor Accident Claims<br \/>\n\tTribunal permitted withdrawal of 30% of amount and rest of 70% of<br \/>\n\tamount was ordered to be invested by way of FDR in any nationalised<br \/>\n\tbank nearest to residence of petitioner in his name for a period of<br \/>\n\tfive years.\n<\/p>\n<p id=\"p_1\">Today,<br \/>\n\tlearned advocate Mr.Suthar submitted before this Court that<br \/>\n\tpetitioner is likely to arrange for marriage and petitioner also<br \/>\n\trequires money for repairing or constructing house, for that he<br \/>\n\trequested to grant withdrawal of total amount by petitioner.\n<\/p>\n<p id=\"p_2\">It<br \/>\n\tis necessary to note that, at time of preferring an application<br \/>\n\tbefore Motor Accident Claims Tribunal by petitioner on 03.08.2010,<br \/>\n\tthese facts were not put on notice of Court that petitioner requires<br \/>\n\tmoney for marriage purpose and also for repairing or constructing of<br \/>\n\thouse, therefore, let petitioner may again file afresh application<br \/>\n\tbefore Motor Accident Claims Tribunal giving aforesaid facts and<br \/>\n\tdetails to Motor Accident Claims Tribunal that he requires total<br \/>\n\tamount for marriage purpose as well as for repairing or constructing<br \/>\n\thouse by producing relevant records before Motor Accident Claims<br \/>\n\tTribunal.\n<\/p>\n<p id=\"p_3\">Petitioner<br \/>\n\tmay file such an application before Motor Accident Claims Tribunal<br \/>\n\twithin a period of 2(Two) weeks from the date of receiving a copy of<br \/>\n\tthis order. As and when such an application is received by Motor<br \/>\n\tAccident Claims Tribunal from petitioner, it is directed to Motor<br \/>\n\tAccident Claims Tribunal, Sabarkantha at Himmatnagar to consider<br \/>\n\treasons for withdrawal of entire amount and also to consider one<br \/>\n\tfact that Manharbhai Somabhai Patel has died in accident, at that<br \/>\n\toccasion, mother of present petitioner Manjulaben has filed a claim<br \/>\n\tpetition before Motor Accident Claims Tribunal being Motor Accident<br \/>\n\tClaim Petition No.136 of 1987 and Motor Accident Claims Tribunal has<br \/>\n\tawarded Rs.1,02,000\/- and out of that Rs.76,500\/- was ordered to be<br \/>\n\tpaid to Manjulaben and Rs.16,500\/- was disbursed in favour of<br \/>\n\tManjulaben and remaining Rs.60,000\/- was deposited in FDR.<br \/>\n\tThereafter, Manjulaben has also died on 02.12.1989. Father of<br \/>\n\tpetitioner, Maheshbhai Shivabhai Patel is alive and after death of<br \/>\n\tMajulaben FDR has been transferred in name of minor i.e. present<br \/>\n\tpetitioner and father of petitioner was taken as Guardian under<br \/>\n\tSection 7 of Guardian and <a href=\"\/doc\/1608688\/\" id=\"a_1\">Wards Act<\/a>. Therefore, amount remained in<br \/>\n\tFDR in name of petitioner, who has now become major and he is having<br \/>\n\tage more than 22 years. Therefore, let Motor Accident Claims<br \/>\n\tTribunal may consider this aspect while considering such an<br \/>\n\tapplication filed by petitioner to the effect that except<br \/>\n\tpetitioner, there is no other person, who is entitled for this<br \/>\n\tamount.
