Tripathi\n\nHon'ble Devendra Pratap Singh,J.\n<\/pre>\n<p id=\"p_1\">      Heard        learned     counsel       for   the    petitioner        and     the<br \/>\nrespondent caveator.\n<\/p>\n<p id=\"p_1\">      This     petition        by     the    tenants     is     directed         against<br \/>\nconcurrent orders dated 7.7.2006 and 5.7.2010 by which both<br \/>\nthe courts below have allowed the release application of the<br \/>\nrespondent landlord.\n<\/p>\n<p id=\"p_2\">      It appears that the respondent landlord along with his<br \/>\nwife filed a release application no. 21 of 2004 under <a href=\"\/doc\/1490821\/\" id=\"a_1\">Section<br \/>\n21(1)(a)<\/a> of U.P. Act No. 13 of 1972 (hereinafter referred to<br \/>\nas the Act) for the release of the disputed accommodation on<br \/>\nthe ground that the premises in their occupation was very<br \/>\nmeagre and a family about 13 people they had to accommodate<br \/>\nthemselves in three rooms and therefore, it was required for<br \/>\ntheir     personal       need.         The    tenant      contested        the     said<br \/>\napplication        on    the   ground       that   the        landlord     had    other<br \/>\npremises available and they were living comfortably in their<br \/>\nhouse. Both the courts below after considering all the facts<br \/>\nhave recorded a categorical finding of fact that there was no<br \/>\ngenuine bona fide need and comparative hardship.\n<\/p>\n<p id=\"p_3\">      It is urged that since the application was filed within<br \/>\n3 years of the purchase by the landlord, the application was<br \/>\nincompetent and further the landlord had purchased a large<br \/>\npiece of vacant land, therefore, he could make arrangements<br \/>\nfor his accommodation.\n<\/p>\n<p id=\"p_4\">      Both these arguments were considered by the courts below<br \/>\nand   they    have      recorded categorical findings of fact                      that<br \/>\nthough the purchase was made in 2001, the release application<br \/>\nwas filed in 2004 after giving six months notice to the<br \/>\ntenant.      The    courts     have    also    gone      on    to   hold    that    the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                            2<\/span><\/p>\n<p>application was entertained after expiry of three years. The<br \/>\ncourts have also found that the tenant cannot dictate terms<br \/>\nto the landlord. The courts have found that the landlord has<br \/>\na family of about 13 persons and they have to manage in only<br \/>\nthree rooms and therefore, have rightly held the need to be<br \/>\ngenuine and bona fide.\n<\/p>\n<p id=\"p_5\">    For     the   reasons   above,   this   is   not   a    fit   case   for<br \/>\ninterference under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of India.<br \/>\nRejected.\n<\/p>\n<p id=\"p_6\">    After the order had been dictated, learned counsel for<br \/>\nthe petitioner, upon instruction of his client, has stated<br \/>\nthat some reasonable time may be granted by which he will<br \/>\nhandover the peaceful vacant possession without creating any<br \/>\nthird party rights to the respondent landlord and also pay<br \/>\nrent till that period.\n<\/p>\n<p id=\"p_7\">    Accordingly,      the   petitioner      is   directed    to   handover<br \/>\npeaceful vacant possession to the respondent landlord on or<br \/>\nbefore 30.10.2010 without creating any third party rights. He<br \/>\nwill also deposit rent uptill that date within a period of<br \/>\nfour weeks.
