Justice K.HEMA\n\n Dated :29\/10\/2008\n\n O R D E R\n                              K.HEMA, J.\n                 -------------------------------------------------\n                          B.A.No.6238 of 2008\n                 -------------------------------------------------\n             Dated this the 29th day of October, 2008\n\n\n                                 O R D E R\n<\/pre>\n<p id=\"p_1\">      This petition is for anticipatory bail.<\/p>\n<p id=\"p_1\">      2.   The alleged offences are under <a href=\"\/doc\/1599401\/\" id=\"a_1\">Sections 341<\/a>, <a href=\"\/doc\/222396\/\" id=\"a_1\">427<\/a> and<\/p>\n<p><a href=\"\/doc\/4266\/\" id=\"a_2\">308<\/a> IPC. According to prosecution, on 16.9.2008, at about 8.30<\/p>\n<p>a.m., the defacto complainant&#8217;s car was stopped by the accused<\/p>\n<p>and the rear view mirror and wind screen glass were broken by<\/p>\n<p>the accused with a weapon.\n<\/p>\n<p id=\"p_2\">      3.   Learned counsel for petitioner submitted that the<\/p>\n<p>allegations made are false. The actual accident occurred while<\/p>\n<p>the defacto complainant was overtaking the motor cycle driven<\/p>\n<p>by petitioner. Some damage caused and the car was stopped<\/p>\n<p>and there was an altercation. It is not correct to say that any<\/p>\n<p>weapon was used by defacto complainant. The offence under<\/p>\n<p><a href=\"\/doc\/4266\/\" id=\"a_3\">Section 308<\/a> IPC is included only with a view to harass<\/p>\n<p>petitioner.  The only injury sustained is an abrasion on the<\/p>\n<p>forearm and it is unlikely that if there is an attack as alleged<\/p>\n<p>such an injury alone will be caused, it is submitted.<\/p>\n<p id=\"p_3\">      On hearing both sides, considering the facts pointed out, I<\/p>\n<p>find that anticipatory bail can be granted on conditions. Hence,<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">BA No.6238\/08                    2<\/span><\/p>\n<p>the following order is passed:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>       (1) Petitioner shall surrender before the Investigating<\/p>\n<p>           Officer within seven days from today and make<\/p>\n<p>           himself available for interrogation and co-operate<\/p>\n<p>           with the investigation.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>       (2) In the event of arrest of petitioner, he shall be<\/p>\n<p>           produced before the Magistrate Court concerned in<\/p>\n<p>           accordance with law.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>       (3) On production of petitioner before the Magistrate<\/p>\n<p>           court, petitioner shall be released on bail on his<\/p>\n<p>           executing bond for Rs.25,000\/- with two solvent<\/p>\n<p>           sureties each for the like sum to the satisfaction of the<\/p>\n<p>           arresting officer on the following conditions:<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_3\"><p>           (i)   Petitioner shall report before the Investigating<\/p>\n<p>                 Officer on every Monday between 10 a.m. to 1<\/p>\n<p>                 p.m. until further orders.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>            (ii) Petitioner shall not influence or intimidate any<\/p>\n<p>                 witness or commit any offence while on bail.<\/p>\n<p>     The petition is allowed.<\/p><\/blockquote>\n<p id=\"p_4\">\n<p id=\"p_5\">                                               K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Alex T.
