The Trial Court while<br \/>\nconsidering the application below Exhibits 7\/8 and 35\/36 has<br \/>\nconsidered the evidence as well as the documents on record and mainly<br \/>\nin paragraph No. 8, the Court has observed as under:-\n<\/p>\n<p id=\"p_2\">&#8230;..&#8221;Thus,the<br \/>\nprovisions of the Act empowers and stands vested all the properties<br \/>\nincluding lease hold rights in the central Government and Central<br \/>\nGovernment steps into the shoes of the sick unit and it has all<br \/>\nrights to transfer lease hold rights. Accordingly, BIFR has framed a<br \/>\nscheme and as per the scheme the property in dispute &#8211; the<br \/>\nlease hold rights were to be sold. For that purpose, the<br \/>\nadvertisement was also issued to which it appears that the plaintiff,<br \/>\nknowing fully well, has not objected. The tender document for sale of<br \/>\npermanent lease hold rights are also produced on record wherein the<br \/>\nsealed offers were invited for sale of permanent lease hold rights in<br \/>\nthe land belonging to Ahmedabad Jupiter Textile Mills on &#8220;as is<br \/>\nwhere is and As is what basis&#8221; in compliance of rehabilitation<br \/>\nscheme of the compnay sanctioned by the BIFR. Accordingly, the<br \/>\ndefendant No.4 has given his offer and ultimately the same has been<br \/>\naccepted. Therefore, now the plaintiff cannot claim any injunction<br \/>\nagainst the transfer of the property as only lease hold rights has<br \/>\nbeen transferred to the defendant No.4 on the terms of the lease<br \/>\ndeed, which is perpetual and permanent lease and no  any right to<br \/>\nre-entry in the land has been proved to the land owners&#8230;.&#8221;\n<\/p>\n<p id=\"p_3\">3.\tLearned<br \/>\nAdvocate for the petitioner is not able to point out anything from<br \/>\nthe record to take a different view of the matter. In view of this, I<br \/>\nam complete agreement with the findings recorded by the Trial Court,<br \/>\nthe appeal deserves to be dismissed.\n<\/p>\n<p id=\"p_4\">4.<br \/>\nAt this stage, learned counsel for the appellant has requested to<br \/>\ndirect the Trial Court to expedite the suit. The Trial Court is<br \/>\ndirected that if an application is filed by the present petitioners<br \/>\nto expedite suit, the trial Court shall expedite the suit.\n<\/p>\n<p id=\"p_5\">5.\tWith<br \/>\nthe aforesaid observations, the appeal stands disposed of.
