Ravi Chandran                              ...Petitioner\n\n\n                         Versus\n\n\nUnion of India &amp; Ors.                       ...Respondents\n\n                                  ORDER\n<\/pre>\n<p id=\"p_1\">R.M.LODHA, J<\/p>\n<p>           Should Central Bureau of Investigation be requested to<\/p>\n<p>trace the minor child Master Adithya Chandran in the Habeas Corpus<\/p>\n<p>petition filed by the father is the question presently before us?\n<\/p>\n<p id=\"p_1\">2.         Dr. Ravi Chandran -petitioner and Vijayashree Voora &#8211;\n<\/p>\n<p id=\"p_2\">respondent no. 6    got married on December 14, 2000 at Tirupathi,<\/p>\n<p>Andhra Pradesh according to Hindu rites. On July 1, 2002, a son &#8211;\n<\/p>\n<p id=\"p_3\">Adithya was born out of the wedlock in United States of America.\n<\/p>\n<p id=\"p_4\">The matrimonial discord arose between the petitioner and respondent<\/p>\n<p>no. 6 soon thereafter.     Respondent no. 6 approached the State of<\/p>\n<p>New York Supreme Court in the month of July, 2003 for divorce and<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                       1<\/span><br \/>\ndissolution of marriage.   On April 18, 2005, the State of New York<\/p>\n<p>Supreme Court passed a consent order governing the issues of the<\/p>\n<p>custody and guardianship of the minor Adithya. The Court granted<\/p>\n<p>joint custody to the petitioner and respondent no. 6 and it was also<\/p>\n<p>stipulated in the order to keep the other party informed about the<\/p>\n<p>whereabouts of the child. On July 28, 2005, a separation agreement<\/p>\n<p>was entered into between the petitioner and respondent no. 6 relying<\/p>\n<p>on various provisions of Domestic Relations Law for distribution of<\/p>\n<p>marital property, spouse maintenance and child support. As regards<\/p>\n<p>custody of the minor son Adithya and parenting time, the parties<\/p>\n<p>consented to the order dated April 18, 2005. On September 8, 2005,<\/p>\n<p>the marriage between the petitioner and respondent no. 6        was<\/p>\n<p>dissolved by the State of New York Supreme Court. Child Custody<\/p>\n<p>order dated April 18, 2005 was incorporated in the order. Later on a<\/p>\n<p>consent order was passed by the Family Court, State of New York<\/p>\n<p>on June 18, 2007 whereby the petitioner and respondent no. 6 were<\/p>\n<p>to have legal and physical custody of the minor child jointly. The<\/p>\n<p>consent order provided that parties shall have alternative physical<\/p>\n<p>custody of the minor child on a weekly basis.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                   2<\/span><\/p>\n<p id=\"p_5\">3.              On June 28, 2007, respondent no. 6 brought minor<\/p>\n<p>Adithya to India informing the petitioner that she will be residing with<\/p>\n<p>her parents in Chennai.      The petitioner approached Family Court,<\/p>\n<p>State of New York for violation of the order by respondent no. 6<\/p>\n<p>pertaining to visitation and custody of minor child.    He also filed a<\/p>\n<p>petition for modification of the custody order.     By an order dated<\/p>\n<p>August 16, 2007, the Family Court, State of New York granted sole<\/p>\n<p>legal and physical custody of the minor Adithya to the petitioner<\/p>\n<p>temporarily and by a further order dated August 8, 2007 ordered<\/p>\n<p>respondent no. 6 to hand over custody of Master Adithya to the<\/p>\n<p>petitioner. It transpires that the Family Court, State of New York has<\/p>\n<p>issued child abuse non-bailable warrants against respondent no. 6.\n<\/p>\n<p id=\"p_6\">4.          In the month of September, 2007, the petitioner filed a<\/p>\n<p>writ petition before this Court praying for a writ of Hebeas Corpus for<\/p>\n<p>the production of minor son Adithya and for handing over the custody<\/p>\n<p>with his passport to the petitioner. The petitioner has alleged that<\/p>\n<p>the child has been illegally and unlawfully detained        beyond his<\/p>\n<p>motherland, USA in blatant violation of orders of US Courts.\n<\/p>\n<p id=\"p_7\">5.          In the Hebeas Corpus petition,         the petitioner has<\/p>\n<p>impleaded    Union of India,    States of    Tamil Nadu and Andhra<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                                       3<\/span><br \/>\nPradesh,       Director General of Police of these two States, wife &#8211;\n<\/p>\n<p id=\"p_8\">Vijayashree Voora and her parents as party respondents.\n<\/p>\n<p id=\"p_9\">6.             On September 17,       2007, notice was issued to the<\/p>\n<p>respondents. Subsequently the petitioner informed the Court that on<\/p>\n<p>March 15, 2008, the respondent no. 6 abandoned her residence in<\/p>\n<p>Dehradun and traveled in a rented car towards New Delhi and on the<\/p>\n<p>way redirected herself to Agra. The next day she was last seen at<\/p>\n<p>the entrance of Agra Cantonment Railway Station. Based on that,<\/p>\n<p>this   Court    issued   directions   on   April   28,   2008   to   Senior<\/p>\n<p>Superintendent of Police, Agra and Senior Superintendent of Police,<\/p>\n<p>Union Territory of Chandigarh to trace the child and produce him in<\/p>\n<p>this Court.\n<\/p>\n<p id=\"p_10\">7.               In the affidavit filed by the Senior Superintendent of<\/p>\n<p>Police, Agra on September 16, 2008, it is stated that for tracing the<\/p>\n<p>minor child Adithya and respondent no. 6,            a massive       search<\/p>\n<p>operation was carried through out Agra and all hotels, guest houses<\/p>\n<p>and other similar areas were checked but they could not be found<\/p>\n<p>residing anywhere in Agra. He also stated that through District Crime<\/p>\n<p>Record Bureau and all SHOs and SOs of police stations of District<\/p>\n<p>Agra efforts have been made to trace out minor child and her<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                                                          4<\/span><br \/>\nmother and their photographs have also been published along with<\/p>\n<p>their description in newspapers having wide circulation all over the<\/p>\n<p>country but no clue of their whereabouts could be found.\n<\/p>\n<p id=\"p_11\">8.         Shri S.S. Srivastava, Senior Superintendent of Police,<\/p>\n<p>Union Territory, Chandigarh      has filed his affidavit on August 13,<\/p>\n<p>2008. He has stated:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>           &#8220;&#8230;All Station House Officers of Police Stations in<br \/>\n           Chandigarh have been issued instructions vide letter<br \/>\n           No. 1057-5A\/Crime Branch, U.T. Chandigarh dated<br \/>\n           3.8.2008 in which the photographs and description of<br \/>\n           Smt. Vijayasree Voora and her son Adithya have<br \/>\n           been mentioned and they have been directed to make<br \/>\n           efforts to trace the whereabouts of the above<br \/>\n           mentioned persons and see if they are residing in any<br \/>\n           residential area, hotel, guest house, sarai. Though<br \/>\n           beat system all such places in Chandigarh have been<br \/>\n           got thoroughly checked and no such persons has<br \/>\n           been found to be residing in Chandigarh.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                  A special look out notice alongwith the<br \/>\n           photographs Smt. Vijayasree Voora and her son<br \/>\n           Aditya has been issued vide No. 17011-<br \/>\n           17030\/MOB\/UT\/A-III\/dated, Chandigarh the 5.8.2008<br \/>\n           in which directions were issued to all SDPO&#8217;s and<br \/>\n           Station House Officers to maintain a sharp look out to<br \/>\n           trace out the whereabouts of the above mentioned<br \/>\n           woman and her son and to send their report on<br \/>\n           weekly basis about the details of the efforts made to<br \/>\n           trace the above mentioned persons. A copy of the<br \/>\n           lookout notice is annexed and marked ANNEXURE<br \/>\n           R-1 . All SHO&#8217;s of Police Station in Chandigarh have<br \/>\n           submitted their reports after      having thoroughly<br \/>\n           checked the area under their jurisdiction and the<br \/>\n           whereabouts of the above mentioned woman and her<br \/>\n           child could not be traced out in Chandigarh.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_4\">                                                                     5<\/span><\/p>\n<blockquote id=\"blockquote_2\"><p>                  On 8.8.2008      the photographs of Smt.<br \/>\n           Vijaysree Voora and her son Adithya alongwith their<br \/>\n           description has been got published in Times of India,<br \/>\n           one of the leading newspapers having wide circulation<br \/>\n           all over India.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                  The photographs and description of Smt.<br \/>\n           Vijaysree Voora and her son Aditya have also been<br \/>\n           got displayed in Bharat Sarkar Doordarshan Kendra,<br \/>\n           Chandigarh and Delhi, TV Channels having coverage<br \/>\n           throughout the country.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>                  A team of police officers have been especially<br \/>\n           deputed from Crime Branch, Chandigarh Police for<br \/>\n           tracing the whereabouts of Smt. Vijayasree Voora and<br \/>\n           her son Aditya, who are regularly checking all the<br \/>\n           hotels, schools and other places where there could be<br \/>\n           possibility of finding the above mentioned woman and<br \/>\n           her child.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_12\">9.         Parents of respondent no. 6 have filed counter affidavit.\n<\/p>\n<p id=\"p_13\">They have totally denied any knowledge or idea about whereabouts<\/p>\n<p>of respondent no. 6 and minor child. In the counter affidavit they<\/p>\n<p>stated thus:\n<\/p>\n<blockquote id=\"blockquote_5\"><p>                  &#8220;11. I submit that in view of the information<br \/>\n           narrated by her about the harassment and cruelty<br \/>\n           (mental torture) caused by the petitioner she had left<br \/>\n           my house without disclosing her whereabouts and I<br \/>\n           sincerely state that I am not aware           of her<br \/>\n           whereabouts and I am not able to communicate with<br \/>\n           her.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>                  12.    I state from the annexures filed<br \/>\n           particularly annexure P-10 Colly dated 11.8.2007<br \/>\n           refers to that in response to conversation with this<br \/>\n           respondent mentioned in E-mail in para `I&#8217; or after. I<br \/>\n           submit that in one of the E-mail at annexure P-10<br \/>\n           Colly the petitioner addressed to Respondent No. 7<br \/>\n           that:-\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_5\">                                                                    6<\/span><\/p>\n<p id=\"p_14\">                  &#8220;I have been trying to reach Aditya for the past<br \/>\n           several weeks and Viji has completely cut me off<br \/>\n           from the life of Aditya. Mrs. Voora (Your wife)<br \/>\n           informs me that she does not know where Viji and<br \/>\n           Aditya are&#8221;\n<\/p>\n<p id=\"p_15\">                  I submit that this respondent from September<br \/>\n           itself had no knowledge or awareness of the<br \/>\n           whereabouts of respondent no. 6 and her minor child<br \/>\n           and that from ever since she left, he has no<br \/>\n           information at all about her whereabouts nor he had<br \/>\n           any contacts or connection with this respondent, and<br \/>\n           we are not able to trace her out and her minor child.<br \/>\n           Inspite of knowing all       these facts that these<br \/>\n           respondents are completely oblivious and in complete<br \/>\n           darkness about her whereabouts even on today&#8230;.&#8221;\n<\/p>\n<p id=\"p_16\">10.              In the affidavit filed by the Director General of<\/p>\n<p>Police, Tamilnadu, it is stated that the respondent no. 6 and the<\/p>\n<p>minor chilld were not found residing at No. 47, B.N. Road (North<\/p>\n<p>Boag Road), T. Nagar, Chennai, and on that address, the parents of<\/p>\n<p>respondent no. 6 are only residing.\n<\/p>\n<p id=\"p_17\">11.              The petitioner has filed a Misc. Petition (Crl.\n<\/p>\n<p id=\"p_18\">M.P.3401 of 2009) on February 23, 2009 stating therein that as per<\/p>\n<p>the Deccan Herald newspaper report dated February 18, 2009,<\/p>\n<p>respondent no. 6 and the child were last seen in Bangalore. They<\/p>\n<p>stayed at KES Lodge in Rajajinagar, Bangalore. On February 23,<\/p>\n<p>2009, accordingly, this Court directed the Director General of Police,<\/p>\n<p>Karnataka and Commissioner of Police, Bangalore to trace the child<\/p>\n<p><span class=\"hidden_text\" id=\"span_6\">                                                                     7<\/span><br \/>\nand produce before him this Court on the next date.              By a further<\/p>\n<p>order dated May 8, 2009, this Court directed the State of Karnataka<\/p>\n<p>and particularly,    Director General of Police, Karnataka            to take<\/p>\n<p>appropriate steps to trace the child.        A copy of this order was also<\/p>\n<p>sent to the Chief Secretary, State of Karnataka.\n<\/p>\n<p id=\"p_19\">12.                 Shri S.N.Bidari, Commissioner of Police, Bangalore<\/p>\n<p>city has filed his affidavit stating therein that all necessary steps<\/p>\n<p>required in order to trace the missing child Master Adithya Chandran<\/p>\n<p>and his mother Mrs. Vijayashree Voora have been taken but without<\/p>\n<p>any success.    In the affidavit, the details of the efforts made by<\/p>\n<p>Karnataka Police have been set out thus:\n<\/p>\n<blockquote id=\"blockquote_7\"><p>           &#8220;2)    It is submitted that the Police Inspector and his<br \/>\n           team of Rajajinagar Police Station of Banagalore City<br \/>\n           visited KES Residency, 50th Cross, 3rd Block,<br \/>\n           Rajajinagar on 5.3.2009 and the said lady and master<br \/>\n           Adithya were not found. On enquiry with one Shri<br \/>\n           Prabhakar, Manager of the said Residency, it was<br \/>\n           learnt that Smt. Vijayashree Voora, mother of the<br \/>\n           child had left the residency alongwith the child on<br \/>\n           17.2.2009 and had not returned. &#8230;..<\/p><\/blockquote>\n<p id=\"p_20\">           3)     It is submitted that the enquiry revealed that<br \/>\n           she went to Shiva Temple, Old Airport Road,<br \/>\n           Bangalore in a private Qualais Vehicle from KES<br \/>\n           Residency on 17.2. 2009.        The enquiry revealed<br \/>\n           that she requested the manager for help and she was<br \/>\n           told to come after Shivarathri festival. She left her<br \/>\n           luggage in the temple and took shelter in the<br \/>\n           Manager&#8217;s residence for the night. The next day i.e.<br \/>\n           on 18.2.2009, she left the temple and after two days,<br \/>\n           she collected her baggage. Thereafter, there is no<br \/>\n           information about her whereabouts and the child. The<\/p>\n<p><span class=\"hidden_text\" id=\"span_7\">                                                                            8<\/span><br \/>\nstaff continued search in several places in Banagalore<br \/>\nCity, but the child could not be traced.\n<\/p>\n<p id=\"p_21\">4)      It is submitted that the Police Sub -Inspector,<br \/>\nSubramanaya Nagara Police station went to Chennai<br \/>\non 4.3.2009 alongwith his staff and enquired with<br \/>\nSmt. A. Poornima and her husband Shri A. Ramesh<br \/>\nR\/o No. 13, North Bhoug Road, G.N. Shetty Road,<br \/>\nChennai- 600 017.          Smt. A. Poornima sister of<br \/>\nVijayashree Voora said that her sister Vijayashree<br \/>\nVoora had married one Sathya Narayana 18 years<br \/>\nback. After 5 years of marriage, she divorced her<br \/>\nhusband and again married one Dr. V. Ravichandra<br \/>\n(Petitioner) in a love marriage and they have one<br \/>\nmale child name Master Aditya Chandran. Five years<br \/>\nback, both of them got mutual divorce in USA (where<br \/>\nthey were staying together_ and Smt. Vijashree<br \/>\nVoora returned from America. At that time, she came<br \/>\nto Poornima&#8217;s residence and she and her husband<br \/>\nadvised herand even her father also advised her, but<br \/>\nshe refused to heed to their advice to reconcile with<br \/>\nher husband and left the house and till today she had<br \/>\nnot returned to their residence.        Thereafter, her<br \/>\nwhereabouts are not known. The statement of Smt.<br \/>\nA. Poornima and her husband were recorded by the<br \/>\nPolice Sub-Inspector,        Subramanyanagara Police<br \/>\nStation.       The report of the Police Sub-Inspector,<br \/>\nSubramanyanagara Police Station is produced and<br \/>\nmarked as ANNEXURE-R-2 AND R-2a. As per the<br \/>\ninstructions of Police Inspector, Mahalakshmi Police<br \/>\nStation, the Police Sub-Inspector, Rajajinagar Police<br \/>\nStation visited Tumkur on 5.3.2009 and enquired at\n<\/p>\n<p id=\"p_22\">1)       VARIN International Residential School,<br \/>\nDoddahosur Gate,         Kunigal Road,     Gulur Post,<br \/>\nTumkur 0572 118, 2) Prudence International School,<br \/>\nHirehalli, Next to TVS Electronics, Tumkur, 3)<br \/>\nMaruthi Vidya Kendra, Belagumba Road, Tumkur,\n<\/p>\n<p id=\"p_23\">4) Sri. Sri. Ravishankar Vidya Mandir, Belagumba<br \/>\nRoad,       Near TUD Office,       Tumkur,    5)    Sri.<br \/>\nSiddaganga Mutt, Tumkur and also enquired with the<br \/>\nconcerned persons of Samuka Residency,              Sai<br \/>\nResidency, Vigneshwara Comforts and showed the<br \/>\nphoto of the child, but no useful information was<br \/>\nobtained. &#8230;..\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_8\">                                                           9<\/span><\/p>\n<p id=\"p_24\">5)    It is submitted that on 5.3.2009, Police Sub-\n<\/p>\n<blockquote id=\"blockquote_8\"><p>      Inspector, Srirampura Police Station visited<br \/>\n      Veda Vignan Maha Vidya Peeta and met Mr.<br \/>\n      Narendra Lamba, the Administrator, Art of<br \/>\n      Living International Centre and showed photo<br \/>\n      of Adithya Chandran. However, it was found<br \/>\n      that no such persons was stayng in the<br \/>\n      Ashram. &#8230;..\n<\/p><\/blockquote>\n<p id=\"p_25\">6)    It is submitted that on 6.3.2009, the Poilice<br \/>\n      Sub-Inspector, Mahalakshmi Layout Police<br \/>\n      Station, Bangalore alongwith staff visited Shri<br \/>\n      Sathya Sai Gokulam at Kadugodi, Bangalore<br \/>\n      District, in search of missing boy and enquired<br \/>\n      with Mr. Srinivas, Custodian of Ashram. It was<br \/>\n      reported that no such persons was staying in<br \/>\n      the Ashrama. The PSI also visited Sir.\n<\/p>\n<p id=\"p_26\">      Sathya Sai Institute of Medical Sciences,<br \/>\n      Whitefield and met Mr.Mohan Das,               Sr.<br \/>\n      Personnel Officer and PRO who informed that<br \/>\n      no such persons, by name Smt. Vijayashree<br \/>\n      Voora or Master Aditya was admitted in the<br \/>\n      Hospital.      The report of the Police Sub-\n<\/p>\n<p id=\"p_27\">      Inspector, Mahalakshmi layout, Police Station,<br \/>\n      is produced and marked as Annexure-R5.\n<\/p>\n<p id=\"p_28\">      The Asstt. Commissioner of Police, City Crime<br \/>\n      Record Bureau, Office of the Comissioner of<br \/>\n      Police,      Infantry Road,      Bangalore was<br \/>\n      instructed on 18.3.2009 to get the photo of<br \/>\n      Aditya Chandra published in the Criminal<br \/>\n      Intelligence Gazette requesting all the<br \/>\n      concerned to trace the missing child. The<br \/>\n      Addl. Director General of Police, State Crime<br \/>\n      Record Bureau,           Bangalore was also<br \/>\n      requested to publish the photograph of Master<br \/>\n      Aditya Chandran in `Talash&#8217; and to transmit<br \/>\n      the said information to all the Police Stations in<br \/>\n      the State and to trace the said missing boy as<br \/>\n      early as possible.\n<\/p>\n<p id=\"p_29\">7)     The Respondent further submits that City crime<br \/>\nRecord Bureau on 31.3.2009 sent letter to the Deputy<br \/>\nInspector General of Police, State Crime Record<br \/>\nBureau to publish the details of the missing persons in<br \/>\ncriminal Intelligence Gazette.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_9\">                                                           10<\/span><\/p>\n<p id=\"p_30\">8)      The Respondent further submits that on<br \/>\n16.4.2009 the Police Inspector, Rajajinagar Police<br \/>\nStation, wrote a letter to the State Crime Record<br \/>\nBureau, Bangalore to verify and compare the<br \/>\nparticulars of the missing child in the Talash record<br \/>\nand on comparison a nil report was sent to<br \/>\nRajajinagar Police Station on 17.4.2009.             On<br \/>\n16.4.2009 the Assistant Commissioner of Police,<br \/>\nMalleshwaram, Bangalore wrote letter to the<br \/>\nCommissioner of Police, Bangalore requesting for<br \/>\npublication of the missing child Master Adithya<br \/>\nChandran in Kannada and English &#8220;daily news<br \/>\npapers&#8221;.        Further he also requested the<br \/>\nCommissioner of Police to send the details to all the<br \/>\nDistrict superintendents of Police and Commissioners<br \/>\nof Police of Hubli &#8211; Dharwad, Mysore and Railway<br \/>\nSuperintendent of Police.             Further, the Asstt.<br \/>\nCommissioner of Police. Malleshwaram, Bangalore,<br \/>\nwrote letter to Commissioner of Police with a request<br \/>\nto address a letter to Doordarshan to Broadcast the<br \/>\nparticulars of the missing child in Doordarshan.<br \/>\nDeputy Commissioner of Police North Divilsion,<br \/>\nBangalore City had sent e-mails to all Commissioners<br \/>\nof Police, all Range Inspectors General of Police, all<br \/>\nSuperintendents of Police including Railways all over<br \/>\nKarnataka State requesting them to look out for the<br \/>\nmissing child. An e-mail is also sent to the Director,<br \/>\nNational Crime Record Bureau, New Delhi requesting<br \/>\nfor look out of the missing child. &#8230;.\n<\/p>\n<p id=\"p_31\">9)     The respondent further submits that the<br \/>\nAssistant Commissioner of Police, Malleshwaram<br \/>\nwrote a letter to All India Radio, with a request to<br \/>\nBroadcast the particulars of the missing child on air.<br \/>\n&#8230;..\n<\/p>\n<p id=\"p_32\">10)    The     respondent further submits that on<br \/>\n18.4.2009 the Public Relation Officer in the Cadre of<br \/>\nDeputy Commissioner of Police in the office of<br \/>\nCommissioner of Police released press note to all the<br \/>\nElectronic Media and Print media requesting for<br \/>\npublication of the particulars of the missing child<br \/>\nMaster Adithya Chandran on Air.            The report<br \/>\nregarding the Broadcast of the particulars of the<br \/>\nmissing child in Doordarshan is also received. &#8230;&#8230;\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_10\">                                                            11<\/span><\/p>\n<p id=\"p_33\">           11)    It is also further submitted that on 16.4.2009<br \/>\n                  itself the details of the missing child were<br \/>\n                  uploaded on Internet on Karnataka State<br \/>\n                  Police web page. The copy of the Web page is<br \/>\n                  herewith      produced      and     marked      as<br \/>\n                  ANNEXURE-R20. It is also relevant to submit<br \/>\n                  that all relevant steps are taken to carry out the<br \/>\n                  upload of the particulars of the missing child<br \/>\n                  Master Adhitya Chandran on National Crime<br \/>\n                  Record Bureau with a request to send<br \/>\n                  information to all the state and Union Territory<br \/>\n                  and forward the information if any obtained in<br \/>\n                  this regard to the Commission of Police,<br \/>\n                  Bangalore.\n<\/p>\n<p id=\"p_34\">           12)    It is further submitted that the Police officials<br \/>\n           attached to Rajajinagar Police Station sent look out<br \/>\n           notices to Bangalore International Airport Authorities,<br \/>\n           Railway Station and KSRTC Bus Stand to keep a<br \/>\n           look out for the missing child. &#8230;&#8230;&#8221;\n<\/p>\n<p id=\"p_35\">13.        From the narration of aforesaid facts, it is abundantly<\/p>\n<p>clear that despite efforts made by police officers and officials of<\/p>\n<p>different States such as Senior Superintendent of Police, Agra,<\/p>\n<p>Senior Superintendent of Police, U.T. of Chandigarh, Director<\/p>\n<p>General of Police, Tamilnadu, Director General of Police, Karnataka<\/p>\n<p>and Commissioner of Police, Bangalore City, the minor child Adithya<\/p>\n<p>and respondent no. 6 could not be traced and their whereabouts<\/p>\n<p>could not be found. It is almost two years since the notice was issued<\/p>\n<p>by this Court but the child could not be produced. Respondent no. 6<\/p>\n<p>is said to be mentally unstable and running round with the child from<\/p>\n<p>one State to another. In the peculiar and extraordinary circumstances<\/p>\n<p><span class=\"hidden_text\" id=\"span_11\">                                                                       12<\/span><br \/>\nsuch as the present one, we are of the view that Central Investigating<\/p>\n<p>Agency i.e., Central Bureau of Investigation may be assigned the task<\/p>\n<p>of tracing minor Adithya Chandran and his production before this<\/p>\n<p>Court. This has become all the more necessary for the protection of<\/p>\n<p>health and safety of minor and because the police authorities of<\/p>\n<p>various States are clueless about the whereabouts of respondent<\/p>\n<p>no. 6 who has been moving with the child from one State to another.\n<\/p>\n<p id=\"p_36\">14.           We, accordingly, direct the registry of this Court to write a<\/p>\n<p>letter to the Director, Central Bureau of Investigation requesting him<\/p>\n<p>to trace minor Adithya Chandran. For the said purpose, he and the<\/p>\n<p>officer nominated by him will enjoy all the powers of Police Officer<\/p>\n<p>carrying out search and issue non-bailable warrants, if necessary,<\/p>\n<p>and pick up minor Adithya Chandran wherever he is found without<\/p>\n<p>interference from any one and to produce him before this Court with<\/p>\n<p>his report.\n<\/p>\n<p id=\"p_37\">15.
