Justice K.T.SANKARAN\n\n Dated :16\/07\/2007\n\n O R D E R\n\n\n                    H.L.DATTU, C.J. &amp; K.T.SANKARAN,J.\n\n                   ----------------------------------------------------\n\n                        W.P.(C) NO.  26714  OF  2006 S\n\n                   ----------------------------------------------------\n\n                         Dated this the 16th  July,   2007\n\n\n                                            JUDGMENT\n<\/pre>\n<p id=\"p_1\">H.L.DATTU, C.J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       A   public   spirited   citizen   and   a   tax   payer   is   before   us   for   the<\/p>\n<p>following reliefs:\n<\/p>\n<p id=\"p_3\">\n<blockquote id=\"blockquote_1\"><p>       &#8220;i)      issue   a   writ   of   mandamus   or   any   other<\/p>\n<p>                appropriate   writ,   order   or   direction,   directing   the<\/p>\n<p>                respondents   to   take   urgent   and   effective   control<\/p>\n<p>                measures   to   eradicate   mosquitoes   and<\/p>\n<p>                mosquitoe   larvae   which   is   causing   Chikungunya<\/p>\n<p>                and   Dengue   fever   etc.   by   the   use   of   proper<\/p>\n<p>                insecticides purchased from approved sources of<\/p>\n<p>                manufactures  under the <a href=\"\/doc\/1313723\/\" id=\"a_1\">Insecticides Act<\/a>, 1968;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>       ii)      issue   a   writ   of   mandamus   or   any   other<\/p>\n<p>                appropriate   writ,   order   or   direction,   directing   the<\/p>\n<p>                respondents   1   to   6   to   conduct   an   enquiry<\/p>\n<p>                regarding   misuse   of   public   funds   of   various<\/p>\n<p>                Municipalities   and   Corporations   in   the   State<\/p>\n<p>                towards   purchase   and   use   of   Fenthion   larvicide<\/p>\n<p>                for mosquitoe  control  for  the  last  3 years and  to<\/p>\n<p>                take appropriate action against the erring officials<\/p>\n<p>                for dereliction of duty;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>       iii)     issue   a   writ   of   mandamus   or   any   other<\/p>\n<p>                appropriate   writ,   order   or   direction,   directing   the<\/p>\n<p>                7th     respondent   to   start   fogging   operations,<\/p>\n<p>                spraying   of   insecticides,   garbage   disposal   etc.<\/p>\n<p>                forthwith   in   the   Kochi   Corporation   area   to   save<\/p>\n<p>                the people from the grip of the epidemic disease<\/p>\n<p>                by   using   proper   insecticides   purchased   from<\/p>\n<p>                Government   approved   sources   only   under   the<\/p>\n<p>                <a href=\"\/doc\/1313723\/\" id=\"a_1\">Insecticides Act<\/a>, 1968;<\/p><\/blockquote>\n<p id=\"p_4\">\n<p id=\"p_5\">       iv)      issue   a   writ   of   mandamus   or   any   other<\/p>\n<p>                appropriate   writ,   order   or   direction,   directing   the<\/p>\n<p>                7th  respondent   to   file   a   statement   regarding   the<\/p>\n<p>                amount   spent   towards   mosquito   control<\/p>\n<p>W.P.(C). NO.26714 OF 2006<\/p>\n<p>                                                ::  2  ::\n<\/p>\n<p id=\"p_6\">\n                 measures   in the  Kochi  Corporation  for the last  3<\/p>\n<p>                 years including purchase of insecticides;<\/p>\n<p id=\"p_7\">        v)       issue   a   writ   or   mandamus   or   any   other<\/p>\n<p>                 appropriate   writ,   direction   or   order,   directing   the<\/p>\n<p>                 7th  respondent to file a report before  this Hon&#8217;ble<\/p>\n<p>                 Court   detailing   the   steps   taken   by   the   Kochi<\/p>\n<p>                 Corporation to eradicate mosquitoe ad mosquitoe<\/p>\n<p>                 larvae   and   the   funds   outlayed   and   spent   for   the<\/p>\n<p>                 same   for   the   last   3   years   towards   purchase   of<\/p>\n<p>                 insecticides   and   the   source   of   purchase   of   the<\/p>\n<p>                 insecticides   whether   it   is   purchased   from<\/p>\n<p>                 approved   agencies   of   the   Government   of   India<\/p>\n<p>                 under the <a href=\"\/doc\/1313723\/\" id=\"a_2\">Insecticides Act<\/a>, 1968;  and<\/p>\n<p id=\"p_8\">        vi)      issue such other and further relief as this Hon&#8217;ble<\/p>\n<p>                 Court   deems   fit   and   proper   to   grant   in   the   facts<\/p>\n<p>                 and circumstances of this case.&#8221;\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">        2.   In the petition, it is stated that the Corporation has failed in<\/p>\n<p>its   attempt   to   eradicate   mosquitoes   and   mosquitoe   larvae     and<\/p>\n<p>because   of   that   there   is   spread   of   epidemic   disease   in   and   around<\/p>\n<p>Kochi City and also other parts of the City.<\/p>\n<p id=\"p_11\">        3.   A detailed  counter affidavit is filed by the respondents.    In<\/p>\n<p>that,   they   have   stated   the   serious   steps   taken   by   them   to   eradicate<\/p>\n<p>mosquitoes and mosquitoe larvae.  Along with the affidavit, they have<\/p>\n<p>also produced enough and more materials in support of the assertions<\/p>\n<p>made in the counter affidavit.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">        4.   At the time   of  hearing  of  this Writ  Petition,  they have  also<\/p>\n<p>produced   the   minutes   of   the   Executive   meetings   held   in   the<\/p>\n<p>Collector&#8217;s   office   on   different   dates,   wherein   steps   taken   by   the<\/p>\n<p>Corporation   authorities   for   eradication   of   the   mosquitoes   and<\/p>\n<p>W.P.(C). NO.26714 OF 2006<\/p>\n<p>                                                 ::  3  ::\n<\/p>\n<p id=\"p_14\">\nmosquitoe larvae have been monitored from time to time.<\/p>\n<p id=\"p_15\">        5.     Having   gone   through   the   counter   affidavit   filed   by   the<\/p>\n<p>respondents   and   also   the   documents   produced   along   with   the<\/p>\n<p>affidavit,   we   are   fully   satisfied   that   the   Corporation   is   taking   some<\/p>\n<p>effective   steps   to   eradicate   the   mosquitoes   and   mosquitoe   larvae   in<\/p>\n<p>and   around   the   City   of   Kochi.     In   that   view   of   the   matter,   in   our<\/p>\n<p>opinion,   for   the   present,   we   need   not   have   to   issue   the   directions<\/p>\n<p>sought   for  by the   petitioners   in this  Writ   Petition.     Therefore,   for   the<\/p>\n<p>present,   the   Writ   Petition   is   disposed   of.
