Appellants\n                                       Versus\nSant Singh and another\n                                                                ...Respondents\n\nCORAM : HON'BLE MRS.JUSTICE SABINA\n\nPresent:     Mr.Ashwani Talwar, Advocate for the appellants.\n\n\n\nSabina, J.\n<\/pre>\n<p id=\"p_1\">             Vide this judgment, the above mentioned two appeals i.e. RSA<\/p>\n<p>No.4692 of 2009 tilted Bharat Sanchar Nigam Ltd. and another Vs. Sant<\/p>\n<p>Singh and another and RSA No.4692 of 2009 titled as Bharat Sanchar<\/p>\n<p>Nigam Ltd. and another Vs. Sant Singh and another would be disposed of<\/p>\n<p>as they have arisen out of one suit.\n<\/p>\n<p id=\"p_1\">             The plaintiffs had filed a suit for damages and for recovery of<\/p>\n<p>Rs.5,00,000\/- as compensation on account of death of Rajinder Singh and<\/p>\n<p>Rs.30,000\/- in lieu of death of two buffalos). The suit of the plaintiffs was<\/p>\n<p>decreed by Civil Judge (Jr.Divn.), Patiala vide judgment and decree dated<\/p>\n<p>18.04.2007 for recovery of Rs.1 lac as damages along with interest at the rate<\/p>\n<p>of 8% per annum and Rs.29,000\/- on account of death of two buffalos. The<\/p>\n<p>plaintiffs as well as defendant-appellant filed separate appeals against the said<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> RSA No.4692 of 2009 (O&amp;M)                                                  2<\/span><\/p>\n<p>judgment and decree. The appeal filed by the appellant was dismissed and the<\/p>\n<p>appeal filed by the plaintiffs was allowed vide separate judgment and decree<\/p>\n<p>dated 25.8.2009 passed by Additional District Judge, Patiala, Fast Tract<\/p>\n<p>Court. The damages were enhanced from Rs.1 lac to Rs.2 lac by the learned<\/p>\n<p>Additional District Judge, Patiala. Hence, the present appeals by defendants<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">No.3 and 4<\/span><\/p>\n<p>             The facts of the case as noticed by the trial Court in paras 2 to 4<\/p>\n<p>of its judgment read as under:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>             &#8220;2.    The brief facts of the case of the plaintiffs are that the<br \/>\n                    plaintiffs are parents of Rajinder Singh who along with<br \/>\n                    his two buffalos died on 6.7.2000 due to electric shock\/<br \/>\n                    electric current. The brief facts are that on 6.7.2000 at<br \/>\n                    about 3 PM Rajinder Singh left his house along with<br \/>\n                    buffalos to his fields. When the buffalos reached near the<br \/>\n                    Railway Crossing of Damanheri two buffalos were inside<br \/>\n                    the water pond (Chappar) and started drinking water.<br \/>\n                    Both these buffalos fell down in the Chappar after<br \/>\n                    shivering. Rajinder Singh presumed that buffalos might<br \/>\n                    have some problem he just to save the buffalos also went<br \/>\n                    inside the Chappar, he received electric shock from the<br \/>\n                    hanging telephone wires, which were hanging after<br \/>\n                    touching electric wire through which electric current<br \/>\n                    passed and the same passed into telephone wires, one of<br \/>\n                    the corner of which were lying in the pond\/Chappar.<br \/>\n                    Rajinder Singh died their buffalos also died there. Sardar<br \/>\n                    Singh, Bant Singh and plaintiff no.1 reached immediately<br \/>\n                    at the spot and removed buffalos and Rajinder Singh from<br \/>\n                    the Chappar. It is further averred that Rajinder Singh and<br \/>\n                    his buffalos died due to the negligence of technical staff<br \/>\n                    of defendant No.2 and defendant No.3 and due to<br \/>\n                    improper maintenance of electric wires and telephone<br \/>\n                    wires meant for supply electricity and telephone service,<br \/>\n                    moreover there was no regular checking and maintenance<br \/>\n<span class=\"hidden_text\" id=\"span_2\"> RSA No.4692 of 2009 (O&amp;M)                                               3<\/span><\/p>\n<p>                by the staff of defendants as required under the Indian<br \/>\n                Electricity Rules and Telephone Rules near the place of<br \/>\n                present accident. It is further averred that at the time of<br \/>\n                death Rajinder Singh was aged about 27 years and was<br \/>\n                unmarried, he was earning Rs.15,000\/- p.m. from the<br \/>\n                business of Diary farming and agricultural business. The<br \/>\n                plaintiff being parents of Rajinder Singh were dependent<br \/>\n                upon his income.          Plaintiffs also suffered loss of<br \/>\n                Rs.30,000\/- due to the death of two buffalos, the price has<br \/>\n                been assessed by senior veterinary officer who conducted<br \/>\n                post mortem examination of buffalos. It is further averred<br \/>\n                that the plaintiffs made representation to the defendants<br \/>\n                through their Advocate S.Subeg Singh Sandhu but the<br \/>\n                defendants made one or the other excuse and has not paid<br \/>\n                any compensation to the plaintiffs. The plaintiffs also<br \/>\n                lodged report with the police of P.S. City Rajpura. The<br \/>\n                police after making investigation has registered case U\/S<br \/>\n                304-A, 428 <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a> against the concerned officer of<br \/>\n                defendants . Hence, the present suit.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                3.    Upon notice defendants No.1 &amp; 2\/PSEB put in<br \/>\n                appearance through counsel and filed written statement in<br \/>\n                which denied all the averments of the plaint besides<br \/>\n                taking preliminary objections that the suit of the plaintiffs<br \/>\n                is time barred; the suit is bad due to non-joinder of<br \/>\n                necessary parties; the plaintiffs have no cause of action<br \/>\n                against the answering defendants to file the present suit<br \/>\n                and the plaintiffs have not complied with the provisions<br \/>\n                of the <a href=\"\/doc\/261195\/\" id=\"a_1\">Indian Electricity Act<\/a>. On merits, all the averments<br \/>\n                of the plaint were specifically denied. It was denied that<br \/>\n                DDR was lodged by Shri Sant Singh son of Tarlok Singh<br \/>\n                on 6.7.2000 in which he had alleged that incident had<br \/>\n                took place due to the negligence of the telephone<br \/>\n                department    and   the    electricity   department.    The<br \/>\n                allegations of the DDR were totally denied. It was further<br \/>\n                submitted that the correct facts of this case are that the<br \/>\n                telephone lines had broken from one end and had fallen<br \/>\n<span class=\"hidden_text\" id=\"span_3\"> RSA No.4692 of 2009 (O&amp;M)                                               4<\/span><\/p>\n<p>                on the electricity wires of the Board. The other end of<br \/>\n                telephone lines had fallen in the Pond (Chappar). No<br \/>\n                electricity line of the Board had broken. The Electricity<br \/>\n                Board has only to right and authority to maintain the<br \/>\n                electricity lines and not the telephonic lines of the Union<br \/>\n                of India. The telephonic department\/Union of India are<br \/>\n                responsible for maintaining their telephonic lines. In any<br \/>\n                case if any telephonic lines had fallen on the electricity<br \/>\n                lines as has taken place in the present case, then the entire<br \/>\n                liability is of telephone department and not of P.S.EB. It<br \/>\n                was further denied if deceased was earning Rs.15,000\/- at<br \/>\n                the time of his death and further submitted that in fact<br \/>\n                said Rajinder Singh was un-employed and was not doing<br \/>\n                any work at that time and he was depended upon his<br \/>\n                parents and other family members. He was not doing<br \/>\n                agricultural work or diary farm business and lastly it was<br \/>\n                prayed that the suit of the plaintiffs be dismissed with<br \/>\n                costs.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>          4.    Upon notice, counsel put in appearance on behalf of<br \/>\n                defendants No.3 and 4 (BSNL) and filed a separate<br \/>\n                written statement in which took preliminary objections<br \/>\n                that the present suit is not maintainable in the present<br \/>\n                form and that the plaintiff have not come to the court with<br \/>\n                clean hands. On merits, all the averments of the plaint<br \/>\n                were specifically denied. It was further submitted that no<br \/>\n                FIR\/DDR in respect of the alleged incident was ever<br \/>\n                lodged by the plaintiff not any intimation\/notice was ever<br \/>\n                sent to the defendants No.3 and 4 nor any complaint<br \/>\n                regarding the alleged incident was ever lodged. It was<br \/>\n                further submitted that the wire of the BSNL always on the<br \/>\n                right hand side of the Board and the wire of the Elecy.<br \/>\n                Board are always on the left hand side of the road, but the<br \/>\n                same are never in any case lying over and above on each<br \/>\n                side of the road, but in the rarest of rarest case, when in<br \/>\n                case of any emergency, when the wires crosses each other<br \/>\n                at a crossing (Chauraha) then the wires of the BSNL are<br \/>\n<span class=\"hidden_text\" id=\"span_4\"> RSA No.4692 of 2009 (O&amp;M)                                                   5<\/span><\/p>\n<p>                    always at a lower position i.e. at a height of 8 feet and the<br \/>\n                    wires of the PSEB at a height of 12 feet and more then it<br \/>\n                    and the wires of the BSNL always remain below the wires<br \/>\n                    of the PSEB.      It was further    submitted that neither<br \/>\n                    Rajinder Singh, nor his buffalos died due to the fault on<br \/>\n                    the part of the defendants No.3 and 4 and neither the<br \/>\n                    persons mentioned as alleged witnesses, were never<br \/>\n                    present at the place of alleged occurrence. It was further<br \/>\n                    submitted that the matter was never         reported to the<br \/>\n                    Panchayat, nor any resolution to this effect was passed by<br \/>\n                    the Gram Panchayat, in the presence of the B.D.&amp; P.O.<br \/>\n                    nor the same was ever sent to the concerned Police<br \/>\n                    Station and lastly it was prayed that the suit of the<br \/>\n                    plaintiffs may kindly be dismissed with costs.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">\n<p id=\"p_3\">             On the pleadings of the parties, the following issues were framed<\/p>\n<p>by the learned lower Court:-\n<\/p>\n<blockquote id=\"blockquote_3\"><p>             1.     Whether the suit is time barred? OPD\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>             2.     Whether the suit is bad for non-joinder of the necessary<br \/>\n                    parties? OPD\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>             3.     Whether the plaintiff is entitled to damages, if so its<br \/>\n                    effect? OPP<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_6\"><p>             4.     Relief.<\/p><\/blockquote>\n<p id=\"p_4\">\n<p id=\"p_5\">             After hearing learned counsel for the appellant, I am of the<\/p>\n<p>opinion that the instant appeals are devoid of any merit and deserve dismissal.<\/p>\n<p id=\"p_6\">             There is no force in the argument raised by learned counsel for<\/p>\n<p>the appellant that the wires affixed by the appellants were at the height of 8<\/p>\n<p>feet from the road whereas wires affixed by Punjab State Electricity Board<\/p>\n<p>were at the height of 12 feet or more from the road. The appellants have failed<\/p>\n<p>to substantiate this plea by leading cogent evidence that in fact, the wires<\/p>\n<p>affixed by electricity board had broken and fallen on the wires affixed by the<\/p>\n<p>appellant. Rather the finding of both the courts below after appreciating the<br \/>\n<span class=\"hidden_text\" id=\"span_5\"> RSA No.4692 of 2009 (O&amp;M)                                                  6<\/span><\/p>\n<p>evidence led by the parties on record is that the wires affixed by the appellant<\/p>\n<p>had broken and had fallen on the wires of affixed by the electricity board and<\/p>\n<p>due to this reason, Rajinder Singh had died and two buffalos belonging to the<\/p>\n<p>plaintiffs had also died. The said finding of fact cannot be interfered with in<\/p>\n<p>appeal by this Court.\n<\/p>\n<p id=\"p_7\">             No substantial question of law arises for consideration in these<\/p>\n<p>appeals.
