He came to be discharged<br \/>\nfrom service, somewhere in the year 2005, after holding a<br \/>\ndepartmental inquiry. The charges against him were of unauthorized<br \/>\nabsence for a long period. To challenge the order of his discharge<br \/>\nfrom services, with all benefits of superannuation, dated 19.10.2005,<br \/>\nthe petition was preferred.\n<\/p>\n<p id=\"p_3\">3.\t\tThe learned Single<br \/>\nJudge found that the petitioner-appellant remained absent<br \/>\nunauthorizedly, for a long period, repeatedly.  The petitioner did<br \/>\nnot participate in the departmental inquiry, though, opportunities<br \/>\nwere given to him, for four times, and therefore, was discharged from<br \/>\nservices.  Hence, this appeal.\n<\/p>\n<p id=\"p_4\">4.\t\tHeard, learned<br \/>\nAdvocate, Ms. G. Vijayalakshmi, for the petitioner-appellant and<br \/>\nlearned Advocate, Mr. K.J. Macwan, for the respondents.\n<\/p>\n<p id=\"p_5\">5.\t\tMs. Vijayalakshmi,<br \/>\nlearned Advocate for the appellant submitted that the appellant was<br \/>\nunable to attend the office because of his mental and physical<br \/>\nailment. She has relied on the document produced at  Annexure-A<br \/>\nto the petition, which is a certificate issued by a Doctor, to show<br \/>\nthat there was some damage to his brain. The said certificate was<br \/>\nissued in the year 1999. The learned Advocate for the appellant<br \/>\nsubmitted that the appellant has recovered fully and he is, now, not<br \/>\nsuffering from any disorder.\n<\/p>\n<p id=\"p_6\">6.\t\tFrom the record we<br \/>\nfind that the appellant has been a habitual absentee.  In the year<br \/>\n2001-2002, he remained  absent from the duty from 29.10.2001 to<br \/>\n31.10.2002, for 316 days, where he was imposed a minor penalty, after<br \/>\na due inquiry. But, thereafter, he again remained absent from duty,<br \/>\nfrom 18.06.2003 to 08.05.2005 and from 24.12.2004 to 21.04.2005, on<br \/>\ntwo occasions, for a period of 216 days and 119 days, respectively.<br \/>\nIt appears that the petitioner appellant did not participate in the<br \/>\nDepartmental Proceedings,<br \/>\nalthough opportunities, on four occasions, were given to him.  This<br \/>\nwould indicate his negligence and lack of discipline. In this set of<br \/>\ncircumstances, we do not think that the punishment imposed, of<br \/>\ndischarging him with all retiral benefits, is unduly harsh, which<br \/>\nwould call for judicial intervention.\n<\/p>\n<p id=\"p_7\">7.\t\tThe learned Civil<br \/>\nJudge was justified in passing the impugned order.\n<\/p>\n<p id=\"p_8\">8.\t\tWe<br \/>\ndo not find any merit in the appeal.
