S A GOLAKIA, IAS &amp; 1 - Respondent(s)\n \n\n=========================================================\n\n\n \n\nAppearance\n: \nMR PJ\nKANABAR for\nPetitioner(s) : 1, \nMR PRANAV DAVE AGP for Respondent(s) : 1, \nNone\nfor Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/09\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThese<br \/>\ngroup of petitions involve common questions on law and facts and<br \/>\nhence, they are disposed of by this common order.\n<\/p>\n<p>1.\tBy<br \/>\nway of these petitions, the petitioners have prayed to quash the<br \/>\norder passed by respondent no.2 dated 07.04.2010 directing to file<br \/>\nthe application of the petitioner for the grant of land by way of<br \/>\nlease as also the order passed by respondent no.1 dated 11.08.2010 in<br \/>\nthe Revision Applications, whereby, the same have been rejected on<br \/>\nthe ground that it was premature.\n<\/p>\n<p>2.\tThe<br \/>\npetitioners herein are engaged in labour work. In pursuance of the<br \/>\nGovernment Resolution dated 10.10.2000 resolving to grant land by way<br \/>\nof lease, the petitioners made application before the<br \/>\nrespondent-authority requesting to grant the land along with<br \/>\nnecessary documents. The petitioner was informed by the<br \/>\nrespondent-authority that earlier one Shri Sukhdevbhai Nanjibhai<br \/>\nBambhania had made an application, which was rejected by the then<br \/>\nDistrict Collector and that being aggrieved by the said order, a<br \/>\nRevision Application had been preferred before the State Government<br \/>\nand that the concerned authority had directed to maintain status quo<br \/>\nover the land and therefore, nothing can be done on the application<br \/>\nof the petitioner and it may be filed.\n<\/p>\n<p>3.\tAgainst<br \/>\nthe said order, the petitioners preferred Revision Applications<br \/>\nbefore respondent no.1-authority along with application for interim<br \/>\nrelief. However, the said Revision Applications came to be rejected<br \/>\non the ground that they were premature. Hence, these petitions.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the petitioners and perused the documents on<br \/>\nrecord. In response to the application preferred by the petitioner,<br \/>\nthe respondent-District Collector had informed that earlier one Shri<br \/>\nSukhdevbhai Nanjibhai Bambhania, a resident of Jafrabad, District<br \/>\nAmreli, had made an application requesting to grant him land by way<br \/>\nof lease for the production of salt, which was rejected by the said<br \/>\nauthority vide order dated 22.05.2007.  Against the said order, said<br \/>\nShri Sukhdevbhai Nanjibhai Bambhania had preferred Revision<br \/>\nApplication before respondent no.1-authority along with an<br \/>\napplication for stay.  On the said application for stay, respondent<br \/>\nno.1-authority has passed the order dated 09.03.2010 directing to<br \/>\nmaintain status quo in all respects. In view of the above order<br \/>\npassed by the competent authority on the Revision Application filed<br \/>\nby said Shri Sukhdevbhai Nanjibhai Bambhania, the respondent<br \/>\nno.2-authority declined to entertain the application filed by the<br \/>\npetitioner and directed to file the same. The Revision Application<br \/>\nfiled against the order of respondent no.2 was treated as premature.\n<\/p>\n<p>5.\tLooking<br \/>\nto the facts and circumstances of the case, the authorities below<br \/>\nhave not committed any error in passing the impugned orders since the<br \/>\nissue is still pending before the competent authority, who has passed<br \/>\nthe order of status quo.  When the issue is still pending, the<br \/>\napplications of the petitioners could not be decided. In my opinion,<br \/>\nthe authorities below were completely justified in passing the<br \/>\nimpugned orders since the Revision Application filed by said Shri<br \/>\nSukhdevbhai Nanjibhai Bambhania is still pending.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above, I find no reasons to interfere in these petitions.<br \/>\nHence, the petitions are dismissed. It is, however, observed that<br \/>\nafter finalization of the application pending before the<br \/>\nrespondent-District Collector, if any land is available for lease,<br \/>\nthen after remanding the matter, the authority concerned may decide<br \/>\nthe applications of the petitioner, after issuing notice to the<br \/>\npetitioners. With the above observation, the petitions stand disposed<br \/>\nof.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
