Justice T.R.RAMACHANDRAN NAIR\n\n Dated :28\/02\/2008\n\n O R D E R\n  C.N.RAMACHANDRAN NAIR &amp; T.R.RAMACHANDRAN NAIR JJ.\n\n                  ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~\n                       I.T.A No.170 of 2002\n                  ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~\n\n             Dated this the 28th day of February, 2008\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">C.N.RAMACHANDRAN NAIR, J.\n<\/p>\n<p id=\"p_1\">     Question raised is whether the processing charge received by<\/p>\n<p>the assessee from M\/s.I.T.C Ltd. for processing and supply of<\/p>\n<p>cashew nut is to be treated as turnover for the purpose of<\/p>\n<p>computation of deduction in respect of eligible export profit under<\/p>\n<p>Section 80 HHC.\n<\/p>\n<p id=\"p_2\">     2.   On going through the order of the Tribunal and after<\/p>\n<p>hearing the parties, we find that the tribunal has given a clear<\/p>\n<p>finding that the assessee has entered into contract with M\/s.I.T.C<\/p>\n<p>Ltd. for the processing of cashew nuts and the execution of the<\/p>\n<p>contract was, in turn, given on sub contract by the assessee to<\/p>\n<p>another party. In fact, the amount received is credited by the<\/p>\n<p>assessee and the amounts simultaneously given to the sub-<\/p>\n<p>contractors towards processing charges is debited in the accounts.<\/p>\n<p>Since the tribunal found that it is an independent transaction and<\/p>\n<p>that the assessee has not processed any cashew nuts but had<\/p>\n<p>directly purchased cashew kernels and exported the same,<\/p>\n<p>assessee was rightly treated as merchant-exporter. We find from<\/p>\n<p>I.T.A No.170 of 2002<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                -: 2 :-<\/span><\/p>\n<p>the order of the Tribunal that the entire transaction is not related<\/p>\n<p>to the export business but to be excluded from the computation of<\/p>\n<p>deduction in respect of eligible export profit under Section 80 HHC<\/p>\n<p>of the IT Act.\n<\/p>\n<p id=\"p_3\">       3.        However, the learned Standing Counsel pointed out<\/p>\n<p>that it is clear from the assessment order that the assessee has<\/p>\n<p>taken the contract amount towards business income of assessee in<\/p>\n<p>the computation of eligible export profit. If the contract receipt<\/p>\n<p>does not constitute turnover as claimed by the assessee in the<\/p>\n<p>computation of eligible deduction under Section 80HHC, then the<\/p>\n<p>profit from that contract also cannot be reckoned at all. We do not<\/p>\n<p>think that the Tribunal&#8217;s order entitles the assessee to reckon,<\/p>\n<p>either the profit or the turnover in respect of the contract business<\/p>\n<p>undertaken for processing of cashew for M\/s.I.T.C Ltd.
