Sethi.\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">SETHI,J.\n<\/p>\n<p id=\"p_1\">L&#8230;I&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<\/p>\n<p>    The\t criminal  complaint  under Section 5(4)  read\twith<br \/>\nSections  5(2)\t&amp;  (3)\tof the <a href=\"\/doc\/61492784\/\" id=\"a_1\">Official\t Secrets  Act<\/a>,\t1923<br \/>\n(hereinafter  called  &#8220;the  Act&#8221;)   was\t filed\tagainst\t the<br \/>\npetitioner  in\tthe Court of Chief Metropolitan\t Magistrate,<br \/>\nDelhi by the Union of India through Deputy Superintendent of<br \/>\nPolice,\t  Central  Bureau  of\tInvestigation,\t SPE,\tAnti<br \/>\nCorruption  Unit,  New\tDelhi.\t  The  petitioner  filed  an<br \/>\napplication  under  <a href=\"\/doc\/1568411\/\" id=\"a_1\">Section  245<\/a>  of the  Code\tof  Criminal<br \/>\nProcedure  in  the Trial Court for being discharged  on\t the<br \/>\ngrounds\t that  the  order of the prosecution  had  not\tbeen<br \/>\npassed\tby an appropriate authority and that the  cognizance<br \/>\ncould  not have been taken as according to him the complaint<br \/>\nwas  barred  by\t limitation.  The  Magistrate  rejected\t the<br \/>\napplication  by\t his order dated 17.3.1995 and the  revision<br \/>\nfiled  in  the\tHigh  Court was\t dismissed  vide  the  order<br \/>\nimpugned  in  this  appeal.  Relying on\t the  provisions  of<br \/>\n<a href=\"\/doc\/150398711\/\" id=\"a_2\">Section\t 13(3)<\/a>\tof the Act, the Trial Magistrate as well  as<br \/>\nthe  High Court held that <a href=\"\/doc\/150398711\/\" id=\"a_3\">Section 13(3)<\/a> of the Act  provided<br \/>\nthe   taking  of  previous  consent   or  sanction  of\t the<br \/>\nappropriate  Government and the time required for  obtaining<br \/>\nsuch  consent  or  sanction was to be excluded in  terms  of<br \/>\n<a href=\"\/doc\/601565\/\" id=\"a_4\">Section 470(3)<\/a> of the Code of Criminal Procedure.  It may be<br \/>\nnoticed at this stage that limitation in the instant case is<br \/>\nstated\tto  have  started  from 24th  April,  1985  and\t the<br \/>\ncomplaint  was\tfiled  in  the\t Court\ton  19th  May,\t1988<br \/>\napparently  beyond  25\tdays  of the  period  of  limitation<br \/>\nprescribed.   The plea of the complainant was that period of<br \/>\n79  days required for obtaining the sanction order should be<br \/>\nexcluded  in  computing the period of  limitation.   Pointed<br \/>\nreference  was\tmade  to the order of  sanction\t dated\t21st<br \/>\nApril,\t1988, copy of which has been placed on the paperbook<br \/>\nof  this appeal.  Accepting the plea of the complainant, the<br \/>\ncomplaint filed against the petitioner was held to be within<br \/>\ntime.\n<\/p>\n<p id=\"p_2\">    Mr.Vijay  Bahuguna,\t Senior Advocate appearing  for\t the<br \/>\npetitioner  submitted  that  as no sanction or\tconsent\t was<br \/>\nprovided to be taken from the Government under <a href=\"\/doc\/150398711\/\" id=\"a_5\">Section 13(3)<\/a><br \/>\nof  the Act, the complaint admittedly filed after the period<br \/>\nof  limitation was required to be dismissed and the  accused<br \/>\ndischarged  in terms of <a href=\"\/doc\/1568411\/\" id=\"a_6\">Section 245<\/a> of the Code of  Criminal<br \/>\nProcedure.   He did not urge any other point.  In support of<br \/>\nhis contention he has relied upon the judgment of this Court<br \/>\nin  <a href=\"\/doc\/1887149\/\" id=\"a_7\">Electrical\tManufacturing Co.  Ltd.\t v.  D.D.   Bhargava<\/a><br \/>\n[1968  (1)  SCR\t 394].\t Shri\tKirit  N.   Rawal,   learned<br \/>\nAdditional   Solicitor\tGeneral,   defending  the   impugned<br \/>\njudgment  has  submitted  that the judgment relied  upon  is<br \/>\ndistinguishable as the mandate of <a href=\"\/doc\/150398711\/\" id=\"a_8\">Section 13(3)<\/a> is clear and<br \/>\nunambiguous  providing\tthe  obtaining\tof  sanction  before<br \/>\nfiling\tthe  complaint.\t He drew our attention\ttowards\t the<br \/>\naverments  made in the petition and the order of sanction to<br \/>\nurge that even if no sanction was required, the complaint be<br \/>\ndeemed to have been filed within time as the complainant and<br \/>\nthe other officials bonafidely believed that such a sanction<br \/>\nwas necessary before the filing of the complaint.\n<\/p>\n<p id=\"p_3\">    In\torder  to  appreciate the rival submissions  of\t the<br \/>\nlearned\t counsel  appearing in the case, a cursory  look  at<br \/>\nsome of the provisions of the Act is necessary.\t <a href=\"\/doc\/61492784\/\" id=\"a_9\">The Act<\/a> has<br \/>\nbeen  enacted  to consolidate the law relating\tto  official<br \/>\nsecrets.    <a href=\"\/doc\/172911040\/\" id=\"a_10\">Section  5(2)<\/a>  provides   that  if\tany   person<br \/>\nvoluntarily  receives any secret official code or pass\tword<br \/>\nor  any\t sketch,  plan, model, article,\t note,\tdocument  or<br \/>\ninformation  knowing or having reasonable ground to believe,<br \/>\nat  the time when he receives it, that the code, pass  word,<br \/>\nsketch,\t plan, model, article, note, document or information<br \/>\nis  communicated  in contravention of the Act, he  shall  be<br \/>\nguilty\tof an offence under the section for which punishment<br \/>\nas provided under sub-section (4).  <a href=\"\/doc\/1872557\/\" id=\"a_11\">Section 6<\/a> deals with and<br \/>\nprovides  punishment  for  unauthorised\t  use  of  uniforms,<br \/>\nfalsification  of  reports, forgery, personation  and  false<br \/>\ndocuments.   <a href=\"\/doc\/33306274\/\" id=\"a_12\">Section 11<\/a> authorises a Presidency\t Magistrate,<br \/>\nMagistrate  of\tfirst class or Sub-divisional Magistrate  to<br \/>\nissue  such  warrants under the circumstances  as  specified<br \/>\ntherein.   <a href=\"\/doc\/31353479\/\" id=\"a_13\">Section 13<\/a> provides that no court other than that<br \/>\nof the Magistrate of First Class specially empowered in that<br \/>\nbehalf,\t shall\ttry any offence under the Act.\t Sub-section<br \/>\n(3) of <a href=\"\/doc\/31353479\/\" id=\"a_14\">Section 13<\/a>, reads:\n<\/p>\n<p id=\"p_4\">    &#8220;No\t court\tshall take cognizance of any  offence  under<br \/>\nthis  Act  unless upon complaint made by order of, or  under<br \/>\nauthority  from, the Appropriate Government or some  officer<br \/>\nempowered by the Appropriate Government in this behalf&#8221;\n<\/p>\n<p id=\"p_5\">    Sub-section\t (3)  provides\tthat cognizance\t of  offence<br \/>\nunder  the Act can be taken only upon complaint which is (a)@@<br \/>\n\t       JJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\nfiled  by  order  of appropriate government;  or  (b)  filed@@<br \/>\nJJJJJJJJJJJJJJJJJJJJ<br \/>\nunder  authority from the appropriate government;  or (c) by<br \/>\nsome  officer  empowered by the appropriate government.\t  No<br \/>\nconsent\t or sanction of the Government or any authority,  as<br \/>\ncontemplated  by  Explanation to Sub-section (3) of  <a href=\"\/doc\/321946\/\" id=\"a_15\">Section<br \/>\n470<\/a>  Cr.P.C., is required for filing the complaint under the<br \/>\nAct.   &#8216;Consent&#8217;  or &#8216;sanction&#8217; envisaged under <a href=\"\/doc\/321946\/\" id=\"a_16\">Section\t 470<\/a><br \/>\nCr.P.C.\t  cannot be equated with the &#8216;order&#8217; or\t &#8216;authority&#8217;<br \/>\nfor  the  purposes of filing the complaint as  envisaged  by<br \/>\nSub-section  (3)  of  <a href=\"\/doc\/31353479\/\" id=\"a_17\">Section  13<\/a>   of\tthe  Act.   Specific<br \/>\nprovisions  have  been\tmade in various\t statutes  requiring<br \/>\nprevious  consent or sanction for the purposes of  launching<br \/>\nof  prosecution against the accused under those\t enactments.<br \/>\nExplanation  to\t Sub-section  (3)  of  <a href=\"\/doc\/321946\/\" id=\"a_18\">Section\t470<\/a>  Cr.P.C.<br \/>\nobviously  refers to such consents and sanctions and not the<br \/>\norder  or  authority as required under the Act.\t Consent  or<br \/>\nsanction  as are referred to in the <a href=\"\/doc\/1331755\/\" id=\"a_19\">Prevention of Corruption<br \/>\nAct<\/a>, <a href=\"\/doc\/32969400\/\" id=\"a_20\">Prevention of Food Adulteration Act<\/a>, various Foodgrains<br \/>\nControl\t Orders,  and other similar enactments envisage\t the<br \/>\napplication  of\t mind  before the grant of such\t consent  or<br \/>\nsanction  which\t is a quasi-judicial function,\twhereas\t the<br \/>\npassing\t of  order, individual or general, or conferment  of<br \/>\nauthority  individually or generally, or empowering a person<br \/>\nfor   the  purposes  of\t filing\t a  complaint  is  only\t  an<br \/>\nadministrative\t action\t facilitating  in  identifying\t the<br \/>\ncomplainant  before the court for the purposes of filing and<br \/>\nprosecuting the case under the Act.  The Legislature, in its<br \/>\nwisdom,\t thought it appropriate to exclude only such  period<br \/>\nwhich  is  required  for obtaining the previous\t consent  or<br \/>\nsanction   of\tthe  Government\t  for  institution  of\t any<br \/>\nprosecution  of\t an offence and not obtaining of  orders  or<br \/>\nauthority  or naming a person for the purpose of filing\t the<br \/>\ncomplaint.\n<\/p>\n<p id=\"p_6\">    This  Court in Electrical Manufacturing Co.\t Ltd.&#8217;s case<br \/>\n(Supra)\t while\tdealing\t with <a href=\"\/doc\/1717620\/\" id=\"a_21\">Section 6<\/a> of  the\t Import\t and@@<br \/>\n\t JJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\nExport\t(Control)  Act,\t 1947 which provided that  no  Court@@<br \/>\nJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\nshall  take  cognizance of any offence punishable under\t the<br \/>\nAct  except  upon  complaint in writing made by\t an  officer<br \/>\nauthorised  in\tthat  behalf by the Central  Government,  by<br \/>\ngeneral\t  or  special  order,\theld  that  the\t  principles<br \/>\napplicable  to cases requiring sanction have no\t application<br \/>\nto  filing  of complaints under the Act.  <a href=\"\/doc\/1872557\/\" id=\"a_22\">Section 6<\/a> of\tthat<br \/>\nAct  only insisted that complaint was to be made in  writing<br \/>\nand  must  have been filed by an officer authorised in\tthat<br \/>\nbehalf.\t In that case the Court relied upon the observations<br \/>\nmade  in  <a href=\"\/doc\/811423\/\" id=\"a_23\">S.A.\tVenkataraman v.\t The State<\/a> [1958  SCR  1037]<br \/>\nwherein it was held:\n<\/p>\n<p id=\"p_7\">    &#8220;In\t construing  the  provisions  of  a  statute  it  is<br \/>\nessential for a court, in the first instance, to give effect<br \/>\nto  the natural meaning of the words used therein, if  those<br \/>\nwords  are  clear  enough.  It is only in the  case  of\t any<br \/>\nambiguity  that\t a  court  is\tentitled  to  ascertain\t the<br \/>\nintention of the legislature by construing the provisions of<br \/>\nthe  statute as a whole and taking into consideration  other<br \/>\nmatters\t and the circumstances which led to the enactment of<br \/>\nthe statute.&#8221;\n<\/p>\n<p id=\"p_8\">    Though  Sub-Section (3) of <a href=\"\/doc\/31353479\/\" id=\"a_24\">Section 13<\/a> of the Act is\t not<br \/>\npari materia to <a href=\"\/doc\/1717620\/\" id=\"a_25\">Section 6<\/a> of the Import and Export (Control)<br \/>\nAct,  1947, yet we find that the insistence of the order  or<br \/>\nauthority  is  intended\t to  ascertain\tthe  filing  of\t the<br \/>\ncomplaint  under the Act without requiring giving consent or<br \/>\nsanction to prosecute.\tLearned Additional Solicitor General<br \/>\nwanted\tto  impress upon us that Sub-section (3) was in\t two<br \/>\nparts  &#8211;  one  dealing with the passing of the\torder  which<br \/>\nnecessarily meant consent or sanction and the second dealing<br \/>\nwith  the  person  authorised  to file\tthe  complaint.\t  On<br \/>\ncritical  examination of the plain words of the\t sub-section<br \/>\nand  the  object  underlying it, we do not  agree  that\t the<br \/>\naforesaid sub-section has two parts, as argued.\t We conceive<br \/>\nno  doubt that sub-section (3) of <a href=\"\/doc\/586546\/\" id=\"a_26\">Section 13<\/a> envisages\tonly<br \/>\nthe  filing of the complaint, by order of or under authority<br \/>\nfrom  the appropriate government or by an officer  empowered<br \/>\nby such Government.  If the intention of the Legislature was<br \/>\nto have the section in two parts, one dealing with the grant<br \/>\nof  consent  or sanction by way of order and the other\tpart<br \/>\ndealing\t with  the  authority  of the  person  to  file\t the<br \/>\ncomplaint,  in that case after the words &#8220;made by order of&#8221;,<br \/>\nthere  should not have been a &#8220;comma&#8221; and the word &#8220;or&#8221;.  In<br \/>\nthat  event for the word &#8220;or&#8221; the Legislature must have used<br \/>\nthe  word  &#8220;and&#8221; and omitted the comma.\t The High Court\t was<br \/>\nnot  justified\tin  reading  between   the  lines  to  hold:@@<br \/>\n\t\t\t\t\t\t       JJJJJ<br \/>\n&#8220;&#8230;.that  the requirement in <a href=\"\/doc\/150398711\/\" id=\"a_27\">Section 13(3)<\/a> of the  Official<br \/>\nSecrets\t Act  amounts  to  taking  of  previous\t consent  or<br \/>\nsanction  of the appropriate Government.  One should not  go<br \/>\nby  the\t actual\t words\tused.  What should be  seen  is\t the<br \/>\nintention  of the legislature.\tThe purpose of providing for<br \/>\nprevious  consent,  sanction  or   authorisation  from\t the<br \/>\nappropriate  government or other authority before  launching<br \/>\nprosecution is for the protection of the alleged offender so<br \/>\nthat irresponsible prosecution is not launched.&#8221;\n<\/p>\n<p id=\"p_9\">    We,\t therefore,  agree  with  the  submissions  made  by<br \/>\nMr.Bahuguna  that  no sanction or consent is provided to  be<br \/>\ntaken from the Government under <a href=\"\/doc\/150398711\/\" id=\"a_28\">Section 13(3)<\/a> of the Act and<br \/>\nthe  period  spent  in obtaining the orders for\t filing\t the<br \/>\ncomplaint  cannot  be  excluded under  Explanation  to\tSub-<br \/>\nsection (3) of <a href=\"\/doc\/321946\/\" id=\"a_29\">Section 470<\/a> Cr.P.C.\n<\/p>\n<p id=\"p_10\">    The mere fact that the complaint was filed 25 days after<br \/>\nthe  expiry of the period of limitation, did not entitle the<br \/>\naccused\t to  seek  his discharge under <a href=\"\/doc\/1568411\/\" id=\"a_30\">Section\t245<\/a>  Cr.P.C.<br \/>\nbecause\t the complainant has, under law, a right to seek for<br \/>\nextension of time under <a href=\"\/doc\/1555290\/\" id=\"a_31\">Section 473<\/a> Cr.P.C.  The complainant<br \/>\ncould  satisfy the Magistrate on the facts and circumstances<br \/>\nof  the\t case  that  the delay\twas  explainable  which\t was<br \/>\noccasioned on account of their bonafide belief to obtain the<br \/>\nsanction  for  the purpose of filing the  complaint.   After<br \/>\nnoticing  the  averments made in the complaint and  perusing<br \/>\nthe  record  particularly order of the Government  of  India<br \/>\ndated  21st April, 1988, authorising Sh.K.N.  Tiwari, Deputy<br \/>\nSuperintendent\tof Police, Central Bureau of  Investigation,<br \/>\nNew Delhi to lodge the complaint, it can be safely held that<br \/>\nthe  complainant  was  entitled to extension  of  period  of<br \/>\nlimitation  under  <a href=\"\/doc\/1555290\/\" id=\"a_32\">Section  473<\/a> Cr.P.C.\t No  useful  purpose<br \/>\nwould  be  served  by  again directing\tthe  complainant  to<br \/>\napproach  the  Trial Magistrate for the purposes of  seeking<br \/>\nextension  of period of limitation.  The complainant is held<br \/>\nto  have  explained the delay in filing the complaint  which<br \/>\nrequired extension.  The complaint is, therefore, held to be<br \/>\nwithin\ttime  and  the\tpetitioner is  not  entitled  to  be<br \/>\ndischarged on this ground.\n<\/p>\n<p id=\"p_11\">    During  the arguments it was pointed out that as various<br \/>\ncomplaints  filed after obtaining sanction from the  Central@@<br \/>\n\t    JJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\nGovernment  and the courts having given the exclusion of the@@<br \/>\nJJJJJJJJJJJJJJJJJJJ<br \/>\nperiod in terms of Explanation to sub-section (3) of <a href=\"\/doc\/321946\/\" id=\"a_33\">Section<br \/>\n470<\/a>  Cr.P.C., this judgment of ours may amount to  upsetting<br \/>\nall  such orders and affect the pending on-going proceedings<br \/>\nunder  the Act.\t The accused in those cases, in such  event,<br \/>\nmay  be lured to raise similar pleas as have been raised  in<br \/>\nthis case for the purposes of quashing the proceeding on the<br \/>\nbasis  of this judgment.  Though the apprehension appears to<br \/>\nbe  misconceived,  yet\twe make it clear  that\tthe  present<br \/>\njudgment  would\t not,  in  any way,  affect  the  continuing<br \/>\nproceedings  in any court wherein the complaints, under\t the<br \/>\nAct, have been filed after obtaining sanction and the courts<br \/>\nhave  given remission of the period in terms of\t Explanation<br \/>\nto  Sub-Section\t (3)  of  <a href=\"\/doc\/321946\/\" id=\"a_34\">Section   470<\/a>\t Cr.P.C.   All\tsuch<br \/>\nextensions  shall  be deemed to be valid even under  <a href=\"\/doc\/1555290\/\" id=\"a_35\">Section<br \/>\n473<\/a> Cr.P.C.\n<\/p>\n<p id=\"p_12\">    There is no merit in this appeal which is dismissed with<br \/>\nthe  direction to the Trial Magistrate to deal with the case<br \/>\nin  accordance\twith  law and expedite the disposal  of\t the<br \/>\ncomplaint.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Rakesh Kumar Jain vs State Through Cbi on 8 August, 2000 Author: Sethi Bench: K.T.
