RAMKUMAR, J.\n                   = = = = = = = = = = = = =\n                     R.S.A.No.1294 of 2008\n                  = = = = = = = = = = = = = =\n            Dated this the 4th day of February, 2009\n\n                            JUDGMENT\n<\/pre>\n<p id=\"p_1\">     The plaintiffs in O.S.No.1 of 2005 on the file of the<\/p>\n<p>Principal Munsiff&#8217;s Court, Kozhikode-I are the appellants in<\/p>\n<p>this second appeal. The said suit was one for a declaration<\/p>\n<p>that the plaintiffs have acquired right over the plaint schedule<\/p>\n<p>property by adverse possession and limitation and also for a<\/p>\n<p>perpetual    injunction    restraining   the   defendants    from<\/p>\n<p>constructing a compound wall or doing any acts of waste in<\/p>\n<p>the plaint schedule property.\n<\/p>\n<p id=\"p_1\">     2. The suit was resisted by the defendants contending,<\/p>\n<p>inter alia, that the plaintiffs had not perfected title by adverse<\/p>\n<p>possession, that the possession of the plaintiffs was<\/p>\n<p>permissive and that the rights of the defendants were not<\/p>\n<p>extinguished by adverse possession.\n<\/p>\n<p id=\"p_2\">     3.     During the stage of evidence, the 5th plaintiff<\/p>\n<p>examined as PW1 admitted that the plaint schedule properties<\/p>\n<p>R.S.A.No.1294 of 2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               2<\/span><\/p>\n<p>have been used for the purpose of the deities of the temple as<\/p>\n<p>permitted by the predecessors of the defendants 1 and 2 and<\/p>\n<p>that the permission given to the plaintiffs by Sundararajan,<\/p>\n<p>Sarala,Vimala etc. was only on certain important days such as<\/p>\n<p>Navarathri Pooja, Mandala Maholsavam, Sivarathri etc.         It<\/p>\n<p>was this permissive possession which was claimed to be<\/p>\n<p>possession satisfying the requirements of nec vi, nec clam and<\/p>\n<p>nec precario and to contend that the rights of the defendants<\/p>\n<p>were lost by adverse possession and limitation.       Both the<\/p>\n<p>courts below have held that the permissive possession, if any,<\/p>\n<p>of the plaintiffs could not extinguish the title of the<\/p>\n<p>defendants. That apart, the courts below have observed that<\/p>\n<p>the plaintiffs have failed to establish open, exclusive, hostile<\/p>\n<p>and uninterrupted possession with requisite animus so as to<\/p>\n<p>constitute acquisition of title by adverse possession within<\/p>\n<p>the meaning of Section 27 read with <a href=\"\/doc\/948485\/\" id=\"a_1\">Article 65<\/a> of the<\/p>\n<p><a href=\"\/doc\/1317393\/\" id=\"a_1\">Limitation Act<\/a>.   The said finding is a pure finding of fact and<\/p>\n<p>is in complete accord with the decisions of the Apex Court in<\/p>\n<p><a href=\"\/doc\/1228547\/\" id=\"a_2\">T.Anjanappa and others v. Somalingappa and another<\/p>\n<p>R.S.A.No<\/a>.1294 of 2008<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                       3<\/span><\/p>\n<p>(2006(7) SCC 570), M.Durai v. Muthu and others (2007(3)<\/p>\n<p>SCC 114); <a href=\"\/doc\/663164\/\" id=\"a_3\">P.T Munichikkanna Reddy v. Revamma<\/a> (2007(6)<\/p>\n<p>SCC 59)           and <a href=\"\/doc\/702009\/\" id=\"a_4\">Hemaji Waghaji Jat v. Bhikhabhai<\/p>\n<p>Khengarbhai Harijan and others<\/a> (2008(7) Supreme 11) .<\/p>\n<p>No question of law, much less any substantial question of law<\/p>\n<p>arises for consideration in this second appeal. The questions<\/p>\n<p>of law formulated in the memorandum of appeal also do not<\/p>\n<p>arise for consideration in this second appeal which is<\/p>\n<p>accordingly dismissed in limine.\n<\/p>\n<p id=\"p_3\">Dated this the 4th day of February, 2009.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                                       V.
