We\u00a0had\u00a0fixed\u00a0this\u00a0case\u00a0for\u00a0hearing\u00a0today\u00a0through\u00a0video\u00a0conferencing.\u00a0<\/p>\n<p>The\u00a0Appellant\u00a0did\u00a0not\u00a0turn\u00a0up\u00a0in\u00a0the\u00a0Patna\u00a0studio\u00a0of\u00a0the\u00a0NIC\u00a0in\u00a0spite\u00a0of\u00a0notice.\u00a0<\/p>\n<p>The\u00a0Respondents\u00a0were\u00a0present\u00a0in\u00a0our\u00a0chamber.\u00a0We\u00a0heard\u00a0their\u00a0submissions.<\/p>\n<p id=\"p_1\">3.      The \u00a0 Appellant\u00a0 had \u00a0 sought\u00a0 two \u00a0 items \u00a0 of \u00a0 information \u00a0 relating \u00a0 to \u00a0 some\u00a0<\/p>\n<p>reference \u00a0 made \u00a0 by \u00a0 the \u00a0 DOPT\u00a0 to \u00a0 the \u00a0 CVC \u00a0 and \u00a0 also \u00a0 about \u00a0 the \u00a0 file \u00a0 notings\u00a0<\/p>\n<p>CIC\/WB\/A\/2010\/00190\u00adSM<br \/>\n relating \u00a0 to \u00a0 a \u00a0 disciplinary \u00a0 matter \u00a0 against \u00a0 some \u00a0 employee. \u00a0 The \u00a0 CPIO \u00a0 had\u00a0<\/p>\n<p>informed\u00a0him\u00a0that\u00a0the\u00a0CVC\u00a0had\u00a0taken\u00a0no\u00a0action\u00a0on\u00a0the\u00a0reference\u00a0of\u00a0the\u00a0DOPT\u00a0<\/p>\n<p>and,\u00a0as\u00a0far\u00a0as\u00a0the\u00a0second\u00a0item\u00a0of\u00a0information\u00a0was\u00a0concerned,\u00a0he\u00a0had\u00a0denied\u00a0it\u00a0<\/p>\n<p>by\u00a0invoking\u00a0the\u00a0provisions\u00a0of\u00a0Section\u00a08(1)\u00a0(h)\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0<\/p>\n<p>Act\u00a0on\u00a0the\u00a0plea\u00a0that\u00a0the\u00a0investigation\u00a0in\u00a0the\u00a0matter\u00a0was\u00a0not\u00a0yet\u00a0complete.\u00a0The\u00a0<\/p>\n<p>Appellate\u00a0Authority\u00a0had\u00a0endorsed\u00a0the\u00a0decision\u00a0of\u00a0the\u00a0CPIO.<\/p>\n<p id=\"p_2\">4.      After \u00a0 hearing \u00a0 the \u00a0 submissions \u00a0 of \u00a0 the \u00a0 Respondents \u00a0 and \u00a0 carefully\u00a0<\/p>\n<p>considering\u00a0the\u00a0facts\u00a0of\u00a0the\u00a0case,\u00a0we\u00a0find\u00a0no\u00a0reason\u00a0for\u00a0not\u00a0disclosing\u00a0the\u00a0file\u00a0<\/p>\n<p>notings\u00a0as\u00a0sought\u00a0by\u00a0the\u00a0Appellant.\u00a0The\u00a0CVC\u00a0is\u00a0not\u00a0a\u00a0disciplinary\u00a0authority\u00a0on\u00a0<\/p>\n<p>the \u00a0 matter \u00a0 and \u00a0 whatever \u00a0 file \u00a0 notings \u00a0 might \u00a0 have \u00a0 been \u00a0 recorded \u00a0 by \u00a0 the\u00a0<\/p>\n<p>Secretary,\u00a0CVC\u00a0in\u00a0this\u00a0case\u00a0would\u00a0contain\u00a0material\u00a0in\u00a0the\u00a0nature\u00a0of\u00a0advice\u00a0to\u00a0be\u00a0<\/p>\n<p>tendered.\u00a0Therefore,\u00a0the\u00a0provisions\u00a0of\u00a0Section\u00a08(1)\u00a0(h)\u00a0would\u00a0not\u00a0apply\u00a0in\u00a0this\u00a0<\/p>\n<p>case.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">5.      In \u00a0 the \u00a0 light\u00a0 of \u00a0 the \u00a0 above,\u00a0 we \u00a0 now\u00a0 direct\u00a0 the \u00a0 CPIO\u00a0 to \u00a0 provide\u00a0 to \u00a0 the\u00a0<\/p>\n<p>Appellant\u00a0within\u00a010\u00a0working\u00a0days\u00a0of\u00a0receiving\u00a0this\u00a0order\u00a0the\u00a0photocopies\u00a0of\u00a0the\u00a0<\/p>\n<p>relevant\u00a0file\u00a0notings\u00a0and\u00a0other\u00a0information\u00a0sought\u00a0by\u00a0the\u00a0Appellant\u00a0in\u00a0part\u00a0B\u00a0of\u00a0<\/p>\n<p>his\u00a0RTI\u00a0application.\u00a0In\u00a0respect\u00a0of\u00a0the\u00a0part\u00a0A\u00a0of\u00a0the\u00a0RTI\u00a0application,\u00a0the\u00a0CPIO\u00a0is\u00a0<\/p>\n<p>directed\u00a0to\u00a0inform\u00a0him\u00a0about\u00a0the\u00a0latest\u00a0status\u00a0on\u00a0the\u00a0reference\u00a0made\u00a0by\u00a0the\u00a0<\/p>\n<p>DOPT.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">6.      The\u00a0appeal\u00a0is\u00a0disposed\u00a0off\u00a0accordingly.\n<\/p>\n<p id=\"p_7\">7.
