The certi\ufb01ed copy of the order which was. on<\/p>\n<p>18-1\u00bb-&#8220;2006 and delivered on 26&#8211;1-2006  a<\/p>\n<p>conlpensatien of Rs.I,O0.000\/-f_,i$_ ozvjefe&#8217;ci_&#8217;;V  <\/p>\n<p>Whereas the counsel fer the  J<\/p>\n<p>produced a xerex cepy of<br \/>\nwhich a correction hare. _&#8221; \ufb01ade to read<br \/>\nas compensation payebleis  (ten Iakhs) . The<br \/>\ncopy (if the  f11ef:1&#8243;&#8221;  eeaexllo is taken on<br \/>\nrecord and :_.t:.&#8211;&#8216;1e     ae&#8217;\u00a31&#8243;ue and correct order<br \/>\npassed    ~  V <\/p>\n<p>  herein had participated in a<br \/>\ntende:\u00a7_for &#8220;iaddu Prasadam and Sugar Candy<\/p>\n<p> *   12\u20aceS&#8221;a&#8221;successfL\ufb02 bidder for the supply of the<\/p>\n<p> Temple, Nanjangud. Towards<\/p>\n<p>t1&#8217;1e.\ufb02bid  she was due in a sum of Rs.4,63,864\/-<\/p>\n<p> &#8216;tewartie  Prasadam and Rs.4,65,627\/- for the supply<\/p>\n<p>&#8216;   ef  Candy Prasadam and as such she issued cheques<\/p>\n<p> H12-4-2000 and I5-5-.2000 respectively for the said<\/p>\n<p>&#8216;V V   Etmounts. The cheques so issued were presented for<\/p>\n<p>encashment on 20-3-2009. Both the cheques  and<\/p>\n<p>13.2 were returned with bankers endorseziierif <\/p>\n<p>ixisu\ufb02icient. Exs.F&#8217;.3 and R5 are the  <\/p>\n<p>The eheques so returned were re&#8217;preeeiited&#8217;-fer. f3:I.1C&#8217;.&#8217;i:!i:.&#8217;SI&#8221;.liA1;Zlil\u20ac*_I1t &#8216;A i<\/p>\n<p>as the petitioner\/accused Vi&#8217;e\u00a7e.este\u00a3i the<br \/>\nreyresentation of the eagle. iiievpreaientation of<br \/>\ncheques again they} _wei*a  with bankers<br \/>\nendorsement    by the bankers.\n<\/p>\n<p id=\"p_3\">As the  honour, a legal notice<br \/>\ncame tcibe  accused on 16-8-2000<br \/>\ncalling Vliipdii eceueed to make goed the<\/p>\n<p>amount coveted&#8217; :.1V1:ecler. t:}1~e&#8217;\u00bbiV two cheques. Despite the service<\/p>\n<p> &#8216; of  V&#8217;\u00e931\u20acx&#8217;*P.8, the petitioner failed to make good<\/p>\n<p>  under the said two cheques. As such a<\/p>\n<p>eoi\ufb01\ufb01i\u00e9hlt  to be filed against the petitioner\/accused for<\/p>\n<p> an offeiieei-punishable tinder Section 138 of the N.I.Ae1:.<\/p>\n<p> P.W.1 S.RaIna111urthy, executive o\ufb01ieer of<\/p>\n<p>ii :&#8217;.4:V&#8221;SI1&#8242;.VSn&#8217;ikanteshwara Tempie, Nanjangud had deposed that<\/p>\n<p>V &#8216;4 &#8220;the petitioner] accused had participated 1&#8217;11 the tender. She<\/p>\n<p>was a successful bidder and towards the tender. she<\/p>\n<p>had issued Ex.P.1 and I-3.2 and the chwuee-&#8216;  eretfc<\/p>\n<p>presented for encashment and the&#8230;s;_m1e_*<\/p>\n<p>and were returned with bankers endorsement  tneufiieient  it<\/p>\n<p>funds. Despite service of noti:ce__whieh:__is<br \/>\nthe production :31&#8217;  10    eerti\ufb01cate of<br \/>\nposting Ex.P.9, the  failed to pay the<\/p>\n<p>amount in question.\n<\/p>\n<p id=\"p_4\">5.    it first appellate Court<br \/>\nappreci\u00e9itiiigi&#8217; * 35. _&#8211; record held that the<br \/>\npetitionewfaecosed&#8217;  of an offence punishable<\/p>\n<p>under    of N.I.Act.
