Application No.<br \/>\n210 of 2010 and has further prayed to transfer Regular Civil Suit No.<br \/>\n153\/2007 from the court of Civil Judge (S.D.) Rajkot to Family Court,<br \/>\nRajkot.\n<\/p>\n<p id=\"p_1\">2.\tIt<br \/>\nis the case of the petitioner that the present petitioner and<br \/>\nrespondent got married on 12.01.2006.  However, due to certain<br \/>\nreasons, the petitioner was driven out of the matrimonial house.  It<br \/>\nis further the case of the petitioner that she filed Civil Suit No.<br \/>\n153 of 2007 in the Court of Civil Judge (S.D.), Rajkot for<br \/>\ncancellation of Marriage Registration.  The petitioner on 03.12.2009<br \/>\npreferred application to transfer the said case to Family Court,<br \/>\nRajkot but the said application was rejected on the ground that the<br \/>\nFamily Court does not have jurisdiction.\n<\/p>\n<p id=\"p_2\">3.\tMr.\n<\/p>\n<p id=\"p_3\">Chudasama, learned advocate appearing for the petitioner has<br \/>\nsubmitted that since 2008 the Family Court has been established in<br \/>\nRajkot and therefore all the cases related to family disputes have<br \/>\nbeen transferred to the Family Court, Rajkot.  He has submitted that<br \/>\nit is apparently clear from the prayer of the Civil Suit filed by the<br \/>\nrespondent that the said suit is relating to family dispute and<br \/>\ntherefore the Civil Court has no jurisdiction.\n<\/p>\n<p id=\"p_4\">4.\tAs<br \/>\na result of hearing and perusal of records, this court is of the<br \/>\nopinion that considering <a href=\"\/doc\/642406\/\" id=\"a_1\">Section 8<\/a> of the Family Court Act, while<br \/>\ndeciding the application below Ex. 11 on 30.06.2010, the trial court<br \/>\nhas committed an error in not transferring the case to the Family<br \/>\nCourt. In that view of the matter, the petition deserves to be<br \/>\nallowed.\n<\/p>\n<p id=\"p_5\">5.\tFor<br \/>\nthe foregoing reasons, petition is allowed.  The order dated<br \/>\n30.06.2010 is hereby quashed and set aside.
