The present writ petition has been preferred for the\n                  following reliefs:-\n                  1) For an appropriate writ in the nature of Certiorari for quashing\n                     the order dated 13.3.2002 passed by the Commissioner-cum-\n                     Secretary, Department of Labour, Employment &amp; Training,\n                     Government of Bihar, Patna whereby and whereunder the\n                     punishment has been inflicted upon the petitioner whereby it\n                     has been decided that the petitioner will not get his salary for\n                     the period 30.10.1999 to 08.12.1999, i.e. for the period in\n                     which the petitioner was in custody and further it has been\n                     decided that the said period will be treated as a break in his\n                     service and a further punishment has been inflicted that 10% of\n                     his pension be deducted with cumulative effect,\n                  2) For a further writ of or in the nature of mandamus be issued\n                     from this Hon'ble Court directing the concerned respondents to\n                     pay the entire retiral benefits of the petitioner forthwith and\n                     immediately without giving effect to the order impugned.\n                         The facts in brief are stated as under:-\n                         The petitioner joined as Inspector of Factories pursuant to\n                  selection through Bihar Public Service Commission on 1.9.1965 and\n                  his services were confirmed on 1.11.1974. On 30.10.1989 the\n                  petitioner was involved in a criminal case for demand and taking\n                  bribe and he was accordingly arrested and later on 9.12.1999 he\n                  was released on bail. However, on 18.3.2000 final form was\n                  submitted in the criminal case with an observation that the case\n                  was false and accordingly on 24.5.2000 the criminal case was\n                  dropped.     On       16.12.1999   the      Commissioner-cum-Secretary,\n                  Department of Labour, Employment and Training, Government of\n                                   2\n\n\nBihar, suspended the petitioner under Rule 9 of the Bihar Service\nCode from the date of his arrest till further order. On 31.8.2000 the\nHon'ble High Court, Ranchi Bench in C.W.J.C. No. 1036 of 2000\nquashed the suspension order with a liberty to pass fresh order of\nsuspension under Rule 100 of the Bihar Service Code. Petitioner\njoined his duty after bail and informed his joining to the authorities\nvide letter No. 258\/C, dated 10.12.1999 which was received on\n14.12.1999<\/pre>\n<p id=\"p_1\">.\n<\/p>\n<p id=\"p_1\">       It appears that the suspension order was withdrawn on<br \/>\n24.10.2001 but the salary for the period of custody was withheld<br \/>\nand a departmental proceeding was initiated and memorandum of<br \/>\ncharge was handed over. The petitioner preferred C.W.J.C. No. 342<br \/>\nof 2001 before this Court and a direction was issued to conclude<br \/>\nthe departmental proceeding within three months. On 26.4.2001<br \/>\nthe petitioner was informed by letter dated 3.3.2001 that the<br \/>\ndepartmental proceeding was being converted under Rule 43(B) of<br \/>\nthe Bihar Pension Rules.\n<\/p>\n<p id=\"p_2\">       The main contention raised by the counsel for the petitioner<br \/>\nis that once the criminal case was dropped and closed there was no<br \/>\nneed for initiation of disciplinary proceeding. It has further been<br \/>\ncontended that the order was illegal, without any reason and<br \/>\nshowed a total non-application of mind.\n<\/p>\n<p id=\"p_3\">       It has also been alleged that no second show-cause notice<br \/>\nwas given before inflicting such punishment and further a double<br \/>\nproceeding on the self same charges could not continue in view of<br \/>\nthe criminal case having been dropped. More so when the<br \/>\npetitioner has already retired.\n<\/p>\n<p id=\"p_4\">       The respondent in their counter-affidavit have submitted<br \/>\nthat the criminal case was dropped since the informant stopped<br \/>\ntaking interest and the department was fully empowered to initiate<br \/>\ndepartmental proceeding against the delinquent employee for the<br \/>\ncharge which has not been decided by the criminal court. It has<br \/>\nalso been stated that the full opportunity was given and after<br \/>\nconsidering the enquiry report the order impugned and memo No.<br \/>\n84 dated 13.3.2002 was passed.\n<\/p>\n<p id=\"p_5\">       I have considered the rival contention and the submission<br \/>\nand at the very outset it would be relevant to clarify that the law<br \/>\nwith regard to parallel proceeding are well settled and both the<br \/>\ncriminal proceedings as well as the departmental proceeding can<br \/>\ncontinue simultaneously.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                  3<\/span><\/p>\n<p id=\"p_6\">       In the instant case the departmental proceeding was<br \/>\ninitiated against the petitioner before his superannuation on<br \/>\n31.1.2001 and after his retirement the same was converted into a<br \/>\nproceeding under section 43(B) of the Bihar Pension Rules-1950<br \/>\nwhich has the provisions to deal with the retired employee against<br \/>\nwhom the enquiry is pending or even contemplated for the charges<br \/>\nof misconduct causing pecuniary loss to the Government or any<br \/>\ncriminal charge. It is also clear that the criminal case was dropped<br \/>\non technical ground and the petitioner was not honorably<br \/>\ndischarged. In any case even acquittal in a criminal case does not<br \/>\nbar domestice \/disciplinary enquiry.\n<\/p>\n<p id=\"p_7\">       The fact remains that proper opportunity was given and<br \/>\nthere was full compliance of the principles of natural justice.<br \/>\nHowever, the petitioner did not cooperate in the departmental<br \/>\nproceeding inspite of orders passed by this Court and it was in<br \/>\nthese background that the proceeding was ex-parte.\n<\/p>\n<p id=\"p_8\">       The impugned order dated 13.3.2002 has been passed after<br \/>\nthorough and careful examination of the facts and after considering<br \/>\nthe enquiry report.
