BHASKAR SHANKAR, AC TO GPXII<\/p>\n<p>3   28.06.2010            Heard learned counsels for the petitioner, the State and<\/p>\n<p>                 the Accountant General.\n<\/p>\n<p id=\"p_1\">                          A counter affidavit has been filed on behalf of the<\/p>\n<p>                 respondent no.9 copy of which has been served on the counsel for<\/p>\n<p>                 the petitioner today in Court.\n<\/p>\n<p id=\"p_2\">                          The grievance of the petitioner is that the present writ<\/p>\n<p>                 application was filed by the petitioner no.1 who is widow of the<\/p>\n<p>                 deceased employee and the petitioner no.2 being the son for<\/p>\n<p>                 payment of the death-cum-retiral dues of the deceased employee<\/p>\n<p>                 who died in harness while working on the post of Teacher.<\/p>\n<p id=\"p_3\">                          It is submitted that except some part payment of group<\/p>\n<p>                 insurance no other death-cum-retiral dues including the pension<\/p>\n<p>                 has been sanctioned and paid. Petitioners are poor persons<\/p>\n<p>                 although approached the authorities all the time, but it did not<\/p>\n<p>                 result anything in their favour. From the statements made in the<\/p>\n<p>                 counter affidavit as also the letters annexed to the counter<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                -2-<\/span><\/p>\n<p>           affidavit as Annexures-A &amp; B it appears that the matter with<\/p>\n<p>           regard to settling the claim are under consideration by the<\/p>\n<p>           authorities and the petitioners were directed by the respondent-<\/p>\n<p>           District Superintendent of Education, Buxar as per the letter<\/p>\n<p>           dated 21st April, 2010 (Annexure-B) for approaching him in<\/p>\n<p>           person and furnishing the required information as mentioned in<\/p>\n<p>           the letter. Learned counsel for the petitioner further submits that<\/p>\n<p>           pursuant to the above letter petitioners have already submitted<\/p>\n<p>           the necessary information.\n<\/p>\n<p id=\"p_4\">                    Notwithstanding the above, for expeditious disposal of<\/p>\n<p>           the claims, petitioners propose to present themselves in person<\/p>\n<p>           again and file their pending claims by way of a representation<\/p>\n<p>           within a period of three weeks stating details of the unpaid claims<\/p>\n<p>           as also copy of the relevant documents, if any, in support of their<\/p>\n<p>           claim available with the petitioners.\n<\/p>\n<p id=\"p_5\">                    The respondent no.9, the District Superintendent of<\/p>\n<p>           Education, Buxar on receipt of the representation and on<\/p>\n<p>           presentation of the petitioners in person shall get the necessary<\/p>\n<p>           formalities completed by the widow and thereafter expedite the<\/p>\n<p>           sanction for payment of the retiral dues including the family<\/p>\n<p>           pension expeditiously preferably within a period of four months<\/p>\n<p>           on receipt of such representation and the admissible payment<\/p>\n<p>           shall be made thereafter with interest permissible under the rules.<\/p>\n<p id=\"p_6\">                    The writ application stands disposed of with the above<\/p>\n<p>           observations\/directions.\n<\/p>\n<p id=\"p_7\">\n<pre id=\"pre_1\">Manish\/-                                 ( Shailesh Kumar Sinha,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sheo Kumari Devi &amp;Amp; Anr vs The State Of Bihar &amp;Amp; Ors on 28 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.3447 of 2006 1.
