BASANT, J.\n                 - - - - - - - - - - - - - - - - - - - - - -\n                   Crl.M.C.No. 457 of 2009\n                 - - - - - - - - - - - - - - - - - - - - - -\n            Dated this the 30th day of January, 2009\n\n                              O R D E R\n<\/pre>\n<p id=\"p_1\">     The petitioner is the complainant in a prosecution under<\/p>\n<p><a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of the N.I. Act. The Branch Manager at Tripunithura<\/p>\n<p>at Ernakulam has initiated proceedings on behalf of the<\/p>\n<p>complainant, a private limited company. In the complaint in<\/p>\n<p>paragraph 4, the learned AC.J.M., Ernakulam, before whom the<\/p>\n<p>complaint was filed, is shown to have jurisdiction as follows:<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;4. The cheque issued by the accused was<\/p>\n<p>      dishonoured due to insufficiency of funds in her<\/p>\n<p>      bank account.      The accused has not paid the<\/p>\n<p>      amount as per the above cheque so far, in spite of<\/p>\n<p>      the notice issued to her.              The cheque was<\/p>\n<p>      presented for collection by the complainant<\/p>\n<p>      through the Vijaya Bank, Thripunithura branch<\/p>\n<p>      which is within the jurisdiction of this Hon&#8217;ble<\/p>\n<p>      Court and the cause of action has arisen within the<\/p>\n<p>      jurisdiction of this Hon&#8217;ble Court.&#8221;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_1\"><p>                                         (emphasis supplied)<\/p>\n<p>Crl.M.C.No. 457 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                      2<\/span><\/p>\n<p>An affidavit was filed along with the complaint under <a href=\"\/doc\/138755618\/\" id=\"a_1\">Section 145<\/a> of<\/p>\n<p>the N.I. Act asserting that the court has jurisdiction to try the offence.<\/p>\n<\/blockquote>\n<p id=\"p_1\">The accused resides outside the the jurisdiction of the court and for<\/p>\n<p>that reason obviously, the matter was posted for enquiry under <a href=\"\/doc\/1149595\/\" id=\"a_2\">Section<\/p>\n<p>202<\/a> Cr.P.C. as per the amended <a href=\"\/doc\/1149595\/\" id=\"a_3\">Section 202<\/a> Cr.P.C.<\/p>\n<p id=\"p_2\">      2.   At that stage the complainant appears to have alertly noted<\/p>\n<p>that in view of the decision in <a href=\"\/doc\/912736\/\" id=\"a_4\">Santhoshkumar v. Mohanan<\/a> (2008<\/p>\n<p>(3) KLT 461) further elucidation is necessary to explain jurisdiction<\/p>\n<p>and a further affidavit was filed, wherein it was specifically asserted<\/p>\n<p>that the transaction with the accused was at the Tripunithura branch of<\/p>\n<p>the complainant situated within the jurisdiction of the ACJM. The<\/p>\n<p>learned ACJM by the impugned order held that the court has no<\/p>\n<p>jurisdiction in the light of the decision in Santhoshkumar (supra) and<\/p>\n<p>directed that the complaint be returned for re-presentation before<\/p>\n<p>proper court.\n<\/p>\n<p id=\"p_3\">      3. The learned counsel for the petitioner submits that the course<\/p>\n<p>adopted by the learned Magistrate is unjustified. Enquiry under <a href=\"\/doc\/1149595\/\" id=\"a_5\">section<\/p>\n<p>202<\/a> Cr.P.C. had to be conducted mandatorily in view of the<\/p>\n<p>Crl.M.C.No. 457 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                      3<\/span><\/p>\n<p>amendment.       In such enquiry the complainant had explained by<\/p>\n<p>additional affidavit filed how the learned ACJM has jurisdiction to try<\/p>\n<p>the case. It is not as though there were no averments earlier in the<\/p>\n<p>complaint and in the affidavit, it was specifically averred that the court<\/p>\n<p>has jurisdiction. But in the light of the decision referred above, which<\/p>\n<p>clarifies the position, the complainant become obliged to make further<\/p>\n<p>affidavit and stated before the court that the court is competent to<\/p>\n<p>entertain jurisdiction.\n<\/p>\n<p id=\"p_4\">      4. It is specifically asserted at the Bar that the complainant has<\/p>\n<p>no branch at Vaikom and the transaction between the parties was at<\/p>\n<p>Tripunithra branch of the complainant company.            The cheque was<\/p>\n<p>drawn and issued to the Tripunithura branch and therefore the court<\/p>\n<p>having jurisdiction over the Tripunithura branch does certainly have<\/p>\n<p>jurisdiction, it is asserted.\n<\/p>\n<p id=\"p_5\">      5. The learned Magistrate appears to have taken a view against<\/p>\n<p>the petitioner for the sole reason that it is only in the additional<\/p>\n<p>affidavit that the details of the transactions are narrated. That, I am<\/p>\n<p>afraid, is not a sufficient reason to justify return of the complaint. The<\/p>\n<p>Crl.M.C.No. 457 of 2009<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                    4<\/span><\/p>\n<p>averments in the additional affidavit clearly explains the further or<\/p>\n<p>additional basis on which it was asserted in paragraph 4 of the<\/p>\n<p>complaint that the learned ACJM has jurisdiction to deal with the<\/p>\n<p>matter. I am, in these circumstances, satisfied that the impugned order<\/p>\n<p>is not justified and the same does warrant interference invoking the<\/p>\n<p>extra ordinary inherent jurisdiction under <a href=\"\/doc\/1679850\/\" id=\"a_6\">Section 482<\/a> Cr.P.C.<\/p>\n<p id=\"p_6\">      6. In the result:\n<\/p>\n<p id=\"p_7\">      a) This Crl.M.C. is allowed.\n<\/p>\n<p id=\"p_8\">      b) The impugned order is set aside.\n<\/p>\n<p id=\"p_9\">      c) The learned Magistrate is directed to consider the matter<\/p>\n<p>afresh and pass appropriate orders under <a href=\"\/doc\/443138\/\" id=\"a_7\">Section 203<\/a>\/<a href=\"\/doc\/1827798\/\" id=\"a_8\">204<\/a> Cr.P.C.<\/p>\n<p id=\"p_10\">      d) The petitioner shall re-present the complaint before the ACJM<\/p>\n<p>forthwith &#8211; on or before 16.2.2009. The Registry shall forthwith return<\/p>\n<p>the original complaint and the affidavits to the petitioner for re-<\/p>\n<p>presentation before the Magistrate.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">                                              (R.
