\nrespondent, it is   a period of 11<\/p>\n
months included days of the absence
\ntreated   Vpaliowance, while active service
\nwas 28?-yearstt  26 days. On the date of<\/p>\n
r_etirerr1cnt, th'e\u00ab3Td_. respondent was drawing a basic pay<\/p>\n
'  and reckoning the number of years of<\/p>\n
ti syeryicepbrienldered, the petitioner calculated gratuity<\/p>\n
 payable as Rs.2,03,061\/– in tenns of the Gratuity<\/p>\n
"ti Viiegjuiations of the Corporation as against Rs.1,42,-447\/–<\/p>\n
__?determined under the Act. '1' hat amount was received<\/p>\n

by the 3td respondent immediately on retirement during<\/p>\n
the year 1998 without any demure.<\/p>\n
3. The 3′-\ufb01responderit, during the year <\/p>\n
an application under Rule 10 before <\/p>\n
Authority claiming of Rs.69,49E__3\/.: as  i <\/p>\n
having served the Corporation  32. <\/p>\n
admitting the receipt of gratuity  by his’<\/p>\n
ernployer–the petitioner. Th-e “respondent did neither
\nfile an application ‘nor sufficient cause to<\/p>\n
condone the..:delay\u00a7:”in_l  V’ application claiming<\/p>\n

showilng sufficient cause for the delay, nevertheless<\/p>\n
   Adwvallowed the application by the order dated 22-03-2007<\/p>\n

and  the Ina~l<in_g'g'.over of the gratuity to the 3rd<\/p>\n

mandatory for the Controlling Authority”to::condone  <\/p>\n
delay if the application is \ufb01led lbeyrinrl’  time<\/p>\n
limit and thereafter adjudicatei’v-upon  on’<\/p>\n
merits.\n<\/p>\n
6. In that View of the  it to state that<\/p>\n
the Controlli’n:g:’.Authority  condoned the<\/p>\n
inordinate  preferring the application
\nunder-Rule  respondent, did not have the<\/p>\n
jurisdiction _:to a’dju’dic’ate the claim on the merits. As a<\/p>\n

   order of the Controlling Authority is<\/p>\n
