1.We have heard the learned counsel for the petitioners and the<\/p>\n
  learned senior counsel appearing for the first respondent, who<\/p>\n
  was the applicant before the Tribunal in O.A.349\/09, from<\/p>\n
  which, this writ petition arises. We also record the appearance<\/p>\n
  of Adv.T.C.Govindaswamy on behalf of the second respondent.<\/p>\n
2.The writ petitioners (establishment) is aggrieved by order<\/p>\n
  dated 26.7.2010 of the Central Administrative Tribunal, which,<\/p>\n
  essentially, is an interim order directing the establishment to<\/p>\n
  pass    appropriate       orders         promoting            the applicant<\/p>\n
  (Padmanabhan), first respondent herein, with effect from 2005<\/p>\n
  and to report such matter to the Tribunal. Today, we are also<\/p>\n
  shown by the learned counsel appearing for Padmanabhan that<\/p>\n
WPC.24393\/10.\n<\/p>\n
                                 2<\/span><\/p>\n
  the Tribunal had passed yet another order subsequently on<\/p>\n
  4.8.2010 essentially reiterating the earlier stand.<\/p>\n
3.Padmanabhan had agitated a claim that he is eligible for being<\/p>\n
  considered for promotion. That issue was subject matter of<\/p>\n
  O.A.704\/06, which was disposed of by the Tribunal.          The<\/p>\n
  establishment filed a review petition against that decision.<\/p>\n
  That was also decided against the establishment. The matter<\/p>\n
  came to this Court. The Division Bench affirmed the decision<\/p>\n
  of the Tribunal, thereby the establishment stood obliged to<\/p>\n
  consider the case of Padmanabhan for promotion. Ultimately,<\/p>\n
  Padmanabhan      moved     the   Tribunal   alleging  that  the<\/p>\n
  establishment has courted contempt by disobeying the<\/p>\n
  directions. The establishment filed a counter affidavit. On the<\/p>\n
  basis of those materials, the Tribunal disposed of the contempt<\/p>\n
  application holding that no contempt is made out.        It was<\/p>\n
  specifically within the knowledge of the Tribunal at that point<\/p>\n
  of time that N.K.Balachandran, second respondent herein, had<\/p>\n
  been appointed in preference to the applicant Padmanabhan.<\/p>\n

4.We are clear in our mind that the closure of the contempt<\/p>\n
  proceedings does not deprive Padmanabhan of his right to sue,<\/p>\n
  if any, as against the appointment of Balachandran. He filed<\/p>\n
  O.A.349\/09 from which this writ petition arises.<\/p>\n
5.It is submitted by the learned senior counsel appearing for<\/p>\n
  Padmanabhan       as   also  the   learned   counsel   for   the<\/p>\n
  establishment that the parties had placed before the Tribunal<\/p>\n
  elaborate pleadings finalising their stand. It appears that the<\/p>\n
  establishment was sticking on to the statutory rules while the<\/p>\n
  applicant Padmanabhan tries to get the benefit of the earlier<\/p>\n
  judgment in O.A.704\/06. We are clear in our mind that in such<\/p>\n
  a situation, the issue before the tribunal was as to whether the<\/p>\n
  establishment was justified in preferring Balachandran over<\/p>\n
  Padmanabhan for being appointed as against the vacancy in<\/p>\n
  question. We are also told that the tribunal could have also<\/p>\n
  considered whether both Padmanabhan and Balachandran<\/p>\n
  could have been accommodated in the same category having<\/p>\n

  regard to the availability of vacancies, subject to the rules and<\/p>\n
  the decisions binding inter partis.\n<\/p>\n

6.In the aforesaid context, we are clear that the impugned order<\/p>\n
  dated 26.7.2010 of the tribunal and the subsequent order<\/p>\n
  issued on 4.8.2010, on which day, we had admitted this writ<\/p>\n
  petition, would not stand in the way of the tribunal deciding<\/p>\n
  the matter finally on merits.\n<\/p>\n

7.For the aforesaid reasons, we set aside the impugned order<\/p>\n
  Ext.P7 dated 26.7.2010. As a consequence, the tribunal will<\/p>\n
  treat its order dated 4.8.2010 as one that does not stand. It<\/p>\n
  would accordingly proceed to hear parties and dispose of the<\/p>\n
  matter on merits finally, the fundamental issue being the inter-<\/p>\n
  se dispute between Padmanabhan and Balachandran to<\/p>\n
  preferential treatment for appointment against the post. We<\/p>\n
  clarify that this judgment does no,t in any manner, answer any<\/p>\n
  of the contentions on merits and all issues are left open for the<\/p>\n
  tribunal to decide. Having regard to the nature of the case,<\/p>\n

                             5<\/span><\/p>\n
 the tribunal will make an endeavour to dispose of the matter<\/p>\n
 expeditiously.\n<\/p>\n
