Justice R.BASANT\n\n Dated :11\/04\/2008\n\n O R D E R\n                               R.BASANT, J\n                       ------------------------------------\n                        B.A.No.2260 of 2008\n                       -------------------------------------\n                Dated this the 11th day of April, 2008\n\n                                   ORDER\n<\/pre>\n<p id=\"p_1\">      Application for anticipatory bail.                   Petitioner is the 2nd<\/p>\n<p>accused.    Altogether there are 3 accused persons.                    They face<\/p>\n<p>allegations in a crime registered alleging the offence punishable<\/p>\n<p>under Section 420 r\/w 34 <a href=\"\/doc\/1569253\/\" id=\"a_1\">I.P.C<\/a>.\n<\/p>\n<p id=\"p_1\">      2.    The crux of the complaint is that the accused persons<\/p>\n<p>induced the defacto complaint, a B.A Degree holder, to part with<\/p>\n<p>an amount of Rs.1.25 lakhs as advance towards a total amount of<\/p>\n<p>Rs.5 lakhs to be paid as consideration for securing a teacher&#8217;s job<\/p>\n<p>in an institution run by the 1st accused. The amount was paid<\/p>\n<p>directly to the 1st accused in the presence of accused 2 and 3, it is<\/p>\n<p>alleged. The payment was made in January, 2005. Long later in<\/p>\n<p>2007, a compliant has been filed. Crime has been registered.<\/p>\n<p>Investigation is in progress. The petitioner apprehends imminent<\/p>\n<p>arrest.\n<\/p>\n<p id=\"p_2\">      3.    The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent.                He had no contumacious<\/p>\n<p>involvement in the alleged deception practiced on the defacto<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.2260 of 2008              2<\/span><\/p>\n<p>complainant by the 1st accused. In any view of the matter, the<\/p>\n<p>petitioner does not deserve to suffer the trauma of arrest and<\/p>\n<p>incarceration. He may be granted anticipatory bail, it is prayed.<\/p>\n<p id=\"p_3\">      4.   The learned Public Prosecutor     does not oppose the<\/p>\n<p>application, but only prays that appropriate conditions may be<\/p>\n<p>imposed. Even the case of the defacto complainant is only that<\/p>\n<p>the amount was directly handed over to the 1st accused. The role<\/p>\n<p>of the other accused in inducing the complainant to part with<\/p>\n<p>money deserves to be probed, submits the learned Public<\/p>\n<p>Prosecutor .\n<\/p>\n<p id=\"p_4\">      5.   In the result, this Bail Application is, allowed.   The<\/p>\n<p>following directions are issued under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> Cr.P.C.<\/p>\n<p id=\"p_5\">      i)   The petitioner shall appear before the learned<\/p>\n<p>Magistrate at 11 a.m on 21.04.2008. He shall be enlarged on<\/p>\n<p>regular bail on his executing a bond for Rs.50,000\/- (Rupees Fifty<\/p>\n<p>thousand only) with two solvent sureties each for the like sum to<\/p>\n<p>the satisfaction of the learned Magistrate;<\/p>\n<p id=\"p_6\">      ii)  The petitioner shall make himself available for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and<\/p>\n<p>1 p.m on 22.04.2008 and 23.04.2008. During this period, the<\/p>\n<p>Investigating Officer shall be at liberty to interrogate the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">B.A.No.2260 of 2008                3<\/span><\/p>\n<p>petitioner in custody and take all necessary steps for the proper<\/p>\n<p>conduct of the investigation. Thereafter the petitioner shall make<\/p>\n<p>himself available for interrogation before the Investigating Officer<\/p>\n<p>between 10 a.m and 12 noon on all Mondays and Fridays for a<\/p>\n<p>period of two months and subsequently as and when directed by<\/p>\n<p>the Investigating Officer in writing to do so;<\/p>\n<p id=\"p_7\">      iii)  If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to<\/p>\n<p>arrest the petitioner and deal with him in accordance with law as<\/p>\n<p>if those directions were not issued at all;\n<\/p>\n<p id=\"p_8\">      iv)   If the petitioner were arrested prior to his surrender on<\/p>\n<p>21.04.08 as directed in clause (1) above, he shall be released<\/p>\n<p>from custody on his executing a bond for Rs.50,000\/- (Rupees<\/p>\n<p>Fifty thousand only) without any sureties undertaking to appear<\/p>\n<p>before the learned Magistrate on 21.04.08.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">                                              (R.BASANT, JUDGE)<br \/>\nrtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court S.
