Public Prosecutor for the State.\n<\/p>\n<p id=\"p_1\">                              Petitioner is in jail custody since 25.6.2010 in a case<\/p>\n<p>                    registered under <a href=\"\/doc\/1944660\/\" id=\"a_1\">section 384<\/a> of the IPC.\n<\/p>\n<p id=\"p_2\">                              Petitioner is not named in the first information report but in<\/p>\n<p>                    course of investigation, it came to light that mobile phone which had<\/p>\n<p>                    been used in committing the alleged crime belonged to the petitioner<\/p>\n<p>                    and subsequently, allegedly aforesaid mobile set was recovered from<\/p>\n<p>                    the possession of the petitioner.\n<\/p>\n<p id=\"p_3\">                              The contention of learned counsel for the petitioner is that<\/p>\n<p>                    mobile phone, which is said to have been recovered from the<\/p>\n<p>                    conscious possession of the petitioner, has not been used in<\/p>\n<p>                    committing the alleged crime and so far as mobile phone, which has<\/p>\n<p>                    been used in committing the alleged crime is concerned, the same<\/p>\n<p>                    stands in the name of one Vashishth Rai which is evident from<\/p>\n<p>                    annexure 3 to this petition.\n<\/p>\n<p id=\"p_4\">                              Considering the aforesaid facts and circumstances as well as<\/p>\n<p>                    submissions of the parties, let the petitioner, Jai Narayan Sah, be<\/p>\n<p>                    released on bail on furnishing bail bonds of Rs 10,000\/- with two<\/p>\n<p>                    sureties of the like amount each to the satisfaction of the Addl. Chief<\/p>\n<p>                    Judicial Magistrate, Dalsingsarai District Samastipur in Angarghat<\/p>\n<p>                    P.S.
