JUSTICE RAJESH BINDAL<\/p>\n<p>Present:       Mr. Ritesh Pandey, Advocate<br \/>\n               for the petitioners.\n<\/p>\n<p id=\"p_1\">               Mr. Anter Singh Brar, DAG, Punjab.\n<\/p>\n<p id=\"p_2\">               Mr. G.P.Singh, Advocate<br \/>\n               for respondent no.2.\n<\/p>\n<p id=\"p_3\">RAJESH BINDAL J.\n<\/p>\n<p id=\"p_4\">               Prayer in the present petition is for quashing of FIR No. 22<br \/>\ndated 20.3.2007 registered under <a href=\"\/doc\/1540253\/\" id=\"a_1\">Sections 326<\/a>, <a href=\"\/doc\/724142\/\" id=\"a_1\">324<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_2\">323<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_3\">148<\/a>, <a href=\"\/doc\/999134\/\" id=\"a_4\">149<\/a> IPC at<br \/>\npolice station Dera Baba Nanak, Tehsil Batala, District Gurdaspur, on the<br \/>\nbasis of compromise arrived at between the parties.\n<\/p>\n<p id=\"p_5\">               Learned counsel for the petitioners submitted that the dispute<br \/>\nbetween the parties has been compromised with the intervention of the<br \/>\nrespectables of the village. A copy of compromise is placed on record as<br \/>\nAnnexure P-2. The prayer is that once the dispute between the parties has<br \/>\nbeen settled amicably, the FIR in question be quashed. Reliance has been<br \/>\nplaced upon a five Judge Bench judgment of this Court in              <a href=\"\/doc\/811682\/\" id=\"a_5\">Kulwinder<br \/>\nSingh v. State of Punjab<\/a>, 2007(3) Law Herald (P&amp;H) 2225.\n<\/p>\n<p id=\"p_6\">               The facts stated by the learned counsel for the petitioners have<br \/>\nnot been disputed by learned counsel for respondent no. 2. Original copy of<br \/>\nthe compromise deed duly signed by the parties in the presence of witnesses<br \/>\nhas been placed on record, wherein the factum of compromise between the<br \/>\nparties is admitted and it is further stated that he does not have any<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Criminal Misc. No. M-17642 of 2008                                  2<\/span><\/p>\n<p>objection in case, the FIR in question is quashed.\n<\/p>\n<p id=\"p_7\">               While dealing with issue of quashing of FIR on the basis of<br \/>\ncompromise a Bench consisting of five Hon&#8217;ble Judges of this Court in<br \/>\nKulwinder Singh&#8217;s case (supra) approving minority view in <a href=\"\/doc\/1239234\/\" id=\"a_6\">Dharambir<br \/>\nv. State of Haryana<\/a>, 2005(2) Law Herald (P&amp;H) (FB) 723, opined as<br \/>\nunder:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>               &#8220;27. To conclude, it can safely be said that there can never be<br \/>\n                       any hard and fast category which can be prescribed to<br \/>\n                       enable the Court to exercise its power under <a href=\"\/doc\/903398\/\" id=\"a_7\">Section 482<\/a>,<br \/>\n                       of the <a href=\"\/doc\/445276\/\" id=\"a_8\">Cr.P.C<\/a>. The only principle that can be laid down is<br \/>\n                       the one which has been incorporated in the Section itself,<br \/>\n                       i.e., &#8220;to prevent abuse of the process of any Court&#8221; or &#8220;to<br \/>\n                       secure the ends of justice&#8221;.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>               28.     In Mrs. Shakuntala Sawhney Versus Mrs. Kaushalya<br \/>\n                       Sawhney and others, (1980) 1 S.C.C. 63, Hon&#8217;ble<br \/>\n                       Krishna Iyer, J. aptly summoned up the essence of<br \/>\n                       compromise in the following words:-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>                       &#8220;The finest hour of justice arrives propitiously when<br \/>\n                       parties, despite falling apart, bury the hatchet and weave a<br \/>\n                       sense of fellowship of reunion.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>                       The power to do complete justice is the very essence of<br \/>\n                       every judicial justice dispensation system. It cannot be<br \/>\n                       diluted by distorted perceptions and is not a slave to<br \/>\n                       anything, except to the caution and circumspection, the<br \/>\n                       standards of which the Court sets before it, in exercise of<br \/>\n                       such plenary and unfettered power inherently vested in it<br \/>\n                       while donning the cloak of compassion to achieve the<br \/>\n                       ends of justice.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>               29.     No embargo, be in the shape of <a href=\"\/doc\/1058165\/\" id=\"a_9\">Section 320(9)<\/a> of the<br \/>\n                       Cr.P.C., or any other such curtailment, can whittle down<br \/>\n                       the power under <a href=\"\/doc\/1679850\/\" id=\"a_10\">Section 482<\/a> of the Cr.P.C.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>               30.     The compromise, in a modern society, is the sine qua non<br \/>\n                       of harmony and orderly behaviour.        It is the soul of<br \/>\n                       justice and if the power under <a href=\"\/doc\/1679850\/\" id=\"a_11\">Section 482<\/a> of the Cr.P.C<br \/>\n                       is used to enhance such a compromise which, in turn,<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Criminal Misc. No. M-17642 of 2008                                 3<\/span><\/p>\n<p>                       enhances the social amity and reduces friction, then it<br \/>\n                       truly is &#8220;finest hour of justice&#8221;. Disputes which have<br \/>\n                       their genesis in a matrimonial discord, landlord- tenant<br \/>\n                       matters, commercial transactions and other such matters<br \/>\n                       can safely be dealt with by the Court by exercising its<br \/>\n                       powers under <a href=\"\/doc\/1679850\/\" id=\"a_12\">Section 482<\/a> of the Cr.P.C in the event of a<br \/>\n                       compromise, but this is not to say that the power is<br \/>\n                       limited to such cases. There can never be any such rigid<br \/>\n                       rule to prescribe the exercise of such power, especially in<br \/>\n                       the absence of any premonitions to forecast and predict<br \/>\n                       eventualities which the cause of justice may throw up<br \/>\n                       during the course of a litigation.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>               31.     The only inevitable conclusion from the above discussion<br \/>\n                       is that there is no statutory bar under the <a href=\"\/doc\/445276\/\" id=\"a_13\">Cr.P.C<\/a> which<br \/>\n                       can affect the inherent power of this Court under Section\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>                       482. Further, the same cannot be limited to matrimonial<br \/>\n                       cases alone and the Court has the wide power to quash<br \/>\n                       the proceedings even in non-compoundable offences<br \/>\n                       notwithstanding the bar under <a href=\"\/doc\/91933\/\" id=\"a_14\">Section 320<\/a> of the Cr.P.C.,<br \/>\n                       in order to prevent the abuse of law and to secure the<br \/>\n                       ends of justice.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>               32.     The power under <a href=\"\/doc\/1679850\/\" id=\"a_15\">Section 482<\/a> of the Cr.P.C is to be<br \/>\n                       exercised Ex-Debitia Justitia to prevent an abuse of<br \/>\n                       process of Court. There can neither be an exhaustive list<br \/>\n                       nor the defined para-meters to enable a High Court to<br \/>\n                       invoke or exercise its inherent powers. It will always<br \/>\n                       depend upon the facts and circumstances of each case.<br \/>\n                       The power under <a href=\"\/doc\/1679850\/\" id=\"a_16\">Section 482<\/a> of the Cr.P.C has no limits.<br \/>\n                       However, the High Court will exercise it sparingly and<br \/>\n                       with utmost care and caution. The exercise of power has<br \/>\n                       to be with circumspection and restraint. The Court is<br \/>\n                       vital and an extra-ordinary effective instrument to<br \/>\n                       maintain and control social order. The Courts play role<br \/>\n                       of paramount importance in achieving peace, harmony<br \/>\n                       and ever-lasting congeniality in society. Resolution of a<br \/>\n<span class=\"hidden_text\" id=\"span_2\"> Criminal Misc. No. M-17642 of 2008                              4<\/span><\/p>\n<p>                       dispute by way of a compromise between two warring<br \/>\n                       groups, therefore, should attract the immediate and<br \/>\n                       prompt attention of a Court which should endeavour to<br \/>\n                       give full effect to the same unless such compromise is<br \/>\n                       abhorrent to lawful composition of the society or would<br \/>\n                       promote savagery.&#8221;<\/p><\/blockquote>\n<p id=\"p_8\">               Compromise in modern society is the sine qua non of harmony<br \/>\nand orderly behaviour. As observed by Krishna Iyer J., the finest hour of<br \/>\njustice arrives propitiously when parties despite falling apart, bury the<br \/>\nhatchet and weave a sense of fellowship of reunion. Inherent power of the<br \/>\nCourt under <a href=\"\/doc\/1679850\/\" id=\"a_17\">Section 482<\/a> Cr.P.C is not limited to matrimonial cases alone.<br \/>\nThe Court has wide powers to quash the proceedings even in non-<br \/>\ncompoundable offences in order to prevent abuse of process of law and to<br \/>\nsecure ends of justice, notwithstanding bar under <a href=\"\/doc\/91933\/\" id=\"a_18\">Section 320<\/a> Cr.P.C.<br \/>\nExercise of power in a given situation will depend on facts of each case.<br \/>\nThe duty of the Court is not only to decide a lis between the parties after a<br \/>\nprotracted litigation but it is a vital and extra-ordinary instrument to<br \/>\nmaintain and control social order.          Resolution of dispute by way of<br \/>\ncompromise between two warring groups should be encouraged unless such<br \/>\ncompromise is abhorrent to lawful composition of society or would promote<br \/>\nsavagery, as held in Kulwinder Singh&#8217;s case (supra).\n<\/p>\n<p id=\"p_9\">               Keeping in view the enunciation of law as referred to above<br \/>\nand applying the same to the facts and circumstances of the present case,<br \/>\nonce the matter has been compromised between the parties, no useful<br \/>\npurpose will be served by proceeding with the prosecution. Accordingly,<br \/>\nFIR No. 22 dated 20.3.2007 registered under <a href=\"\/doc\/1540253\/\" id=\"a_19\">Sections 326<\/a>, <a href=\"\/doc\/724142\/\" id=\"a_20\">324<\/a>, <a href=\"\/doc\/1011035\/\" id=\"a_21\">323<\/a>, <a href=\"\/doc\/763672\/\" id=\"a_22\">148<\/a>,<br \/>\n<a href=\"\/doc\/999134\/\" id=\"a_23\">149<\/a> IPC at police station Dera Baba Nanak, Tehsil Batala, District<br \/>\nGurdaspur and all subsequent proceedings arising therefrom are quashed.\n<\/p>\n<p id=\"p_10\">               The petition is disposed of accordingly.\n<\/p>\n<pre id=\"pre_1\">July 30, 2008                                        ( RAJESH BINDAL )\nritu-II                                                   JUDGE\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Sukha Singh And Others vs State Of Punjab And Another on 30 July, 2008 Criminal Misc.
