After investigation\nthe police submitted 'B summary' report. \nsaid report was opposed by the compla_iA\"nl*ant:i:'.i\u00a7\"'* ii\nby filing his objections to itpgon   V\nThereafter the learned  \nsworn statement of the coiinpil-ainanVt..\"_,on' _\n3\/7\/2003 and his rurlm\u00e9ggrttiit state-rn_e'nt_i'_=  i\n10\/8\/2005.     i\n\nb) On the baisisersihe agvt\u00e9rsmeims in\nthe said complaint   sltatelment of\nthe compI.a.ir:.:,anit:_,:i'::theipggarneq.\/JiMFC\"piassed the\ni1npugnedi.,V.o;\u20ac_dle:r   directing\nregistratiioindof  against all the\naccused  and issuing\n\nsummons\" again st ._thern \n.fr\u00b0~S;r.it:.A.tnil iKa'1\"e','l the learned counsel for the\n\npetiti_iot:e_r's\u00bbaccjusledi\"strongly contended that, the learned\n\n C0..Il11mVit.te'd--'lserious error in passing the impugned\n\n....;5v;@__er-'\u00bb\u00bbdated..1.3:'\/8\/2009 and inasmuch as, the said order does\n\n_di.s\"c\u00bblo.se for what offences process has been issued\n\n ag.:ai'n-\u00bbst-lithe petitioners-accused. 5) Per cointifya\u00bb,ivSr:i’-.,P\u00a7}\/iGuinjal,the learned counsel
\nfor the respoiri.de:nitj-_com’p<lai'riarit,i i\u00e9rhile supporting the<\/p>\n
impugned o,rde_r.ofith-erleairned,JMFC contends that, though<\/p>\n
the learned   niiopptiiispecifically stated in his
\nimvpugnedftioirder as what offences process has been<\/p>\n
issued1against\u00ab_the'"–accused therein, the facts alleged in the<\/p>\n
compia-i,nt\u00ab.i'anidisgtaitted in the sworn statement clearly make<\/p>\n
offences<\/p>\n
en,,U\/jse[eesi,409,, 420 and 120-A of IPC<\/a> and therefore the
\n order cannot be interfered with only on this<\/p>\n
ieefgtencihtnical ground. He further contended that, the averments<\/p>\n

\n*”rneasuring 8 acres
\nsituated  The father of the<\/p>\n
 conrplaiiinant,.iname_l_yv late Hasansab Bagawan,
\nii.io:w_,rii1i:Ved_.i :4-i\u00e9aeres and accused No.2 owned
\n in the said land. Acquisition
\npro.i;’eed.ings.–‘were initiated in respect of the
\n_i<._entire" Vvfii\u00a7'i'1.acres of the said land. Award also
\n  to be passed. The father of the
\n compilainant and accused No.2 were entitled<\/p>\n
  "to 50% of the award amount.\n<\/p>\n

attorney. Thought the records disclose that the comp’l”a,inant<\/p>\n
produced as many as six documents which _..h_a_V.\u20ac:’fibei\u20ac.n<\/p>\n
marked as Exs.P.l to 13.6, the said power   <\/p>\n

8) On careful reading._v:o-f_ the” .averim.:en~.ts”””in: the”?<\/p>\n
complaint and the sworn,.statevm*ein’t–.ptithei lic’ornp”i\u00a7ainant it
\ncould be seen that, no  assigned by
\nthe complainantgsaid power of
\nattorney.  atguntents, the learned
\ncounsel  submitted the said
\npower of attorney by late father of the
\nCOITlplE1iI”1:dI1t_A.iI]iil:\u00a3i”l_tgl;1l: of accused N0.i, but accused No.3
\n unconnected with the execution of the<\/p>\n
saidiip.o’w_er of”a.t_to~r’r’1’ey and therefore issuing process against<\/p>\n
acr;usediiil”i’~io;’-3′. and 4 on the allegation of the complainant<\/p>\n
.1 power of attorney came to be falsely created<\/p>\n
A”ii_”-.b_y’\u00ab\u00ab.acc\u00a7used No.1 in collusion with and in connivance of<\/p>\n
act-rused N0s.3 and 4 cannot be sustained in law. Therefore<\/p>\n

since the existence of power of attorney said to haxifegbeen<\/p>\n
executed by the father of the complainant <\/p>\n
accused No}. is not in dispute, I feel that non__pr~oVdtii.cti_onii ‘of, <\/p>\n
either original or copy of the said power of1att.o3′-nie*3_ztat’the<\/p>\n
stage of taking cognizance and’ issuin”g_procee.s’s”‘against theft\u00bb<\/p>\n
accused is not fatal to the case ofiiithe ctompilainant\ufb02i<\/p>\n
9) On careful  order it
\ncould be seen that  has ordered to
\nregister the case’   Register No.3 and to
\nissue sumrrions  not specified in the
\nimpugned  offences alleged in the
\ncomplaint\u00ab..th.eiipr*\u00abo9_ie’$’S  issued against the accused
\n   submitted by the learned counsel<\/p>\n
for the”petit’io’n,ers}accused, the learned Magistrate has not<\/p>\n
i”:fioibs_erved””‘  impugned order, anything about the<\/p>\n
4:.:if:iBisu:rnr;’:ary5i report submitted by the police after<\/p>\n
 of the investigation. Therefore I am of the<\/p>\n
ii”~..icorisidered opinion that since no case is made out by the<\/p>\n
.\u00bb…s”*w\u00bb~\u00bb–=–\n<\/p>\n

complainant against accused Nos.3 and 4 for any of\u00bb the<\/p>\n
offences alleged in the complaint issuing proceys’s’.agai.n’st<\/p>\n
