KRISHNAN, J.\n               = = = = = = = = = = = = = =\n                INS.APPEAL NO. 14 OF 2006\n             = = = = = = = = = = = = = = =\n       Dated this the 3rd day of October, 2008.\n\n                      J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      This appeal is preferred against the judgment of the<\/p>\n<p>Employees Insurance Court, Alappuzha in I.C.142\/03. As a<\/p>\n<p>result of an employment injury,     the applicant before the<\/p>\n<p>Court below sustained traumatic amputation of terminal<\/p>\n<p>phalanx of 5th and 3rd finger, terminal and middle phalanx of<\/p>\n<p>4th finger of left hand and other burn injuries.       He had<\/p>\n<p>undergone treatment in various hospitals including Medical<\/p>\n<p>College Hospital, Alappuzha and his disability has been<\/p>\n<p>assessed at 23%. The said finding by the Medical Board is<\/p>\n<p>under challenge in I.C.A.5\/03.        The grievance of the<\/p>\n<p>applicant is that he was to be on certified leave from 25.1.01<\/p>\n<p>to 11.6.03 as he was not declared fit by any of the concerned<\/p>\n<p>Medical Officers.   In spite of the same he had not been<\/p>\n<p>extended with the temporary disablement benefit on the<\/p>\n<p>INS.APPEAL NO. 14 OF 2006<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                -:2:-<\/span><\/p>\n<p>ground that the question of disability was finally decided by<\/p>\n<p>the Medical Board. The E.I. Court on an exhaustive<\/p>\n<p>consideration of the materials held that if there is no<\/p>\n<p>evidence to show that he can resume work he must be<\/p>\n<p>entitled to the temporary disablement benefit for the period<\/p>\n<p>for which he was on certified leave in connection with the<\/p>\n<p>employment injury.\n<\/p>\n<p id=\"p_1\">      2.   Learned counsel for the Corporation strongly<\/p>\n<p>contends and placed before me the manual, especially<\/p>\n<p>paragraph 5.63 which reads as follows.\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                 &#8220;In case where the Medical Board has<\/p>\n<p>           decided that the disablement of the insured<\/p>\n<p>           person is of a permanent nature and has<\/p>\n<p>           accordingly assessed the extent of loss of<\/p>\n<p>           earning capacity, the decision of the<\/p>\n<p>           Medical Board if accepted at Regional Office<\/p>\n<p>           will be followed. If the IMO\/IMP continues<\/p>\n<p>           to issue a certificate after the Medical<\/p>\n<p>           Board decision, the incapacity from the<\/p>\n<p>           date of examination by the Medical Board<\/p>\n<p>           should be treated as a fresh spell of<\/p>\n<p>INS.APPEAL NO. 14 OF 2006<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 -:3:-<\/span><\/p>\n<p>           sickness.    Sickness benefit, if due and<\/p>\n<p>           admissible   may    be     paid and,   where<\/p>\n<p>           required under the law, after deduction of 2<\/p>\n<p>           waiting   days.       However,    permanent<\/p>\n<p>           disablement benefit, if admissible, will also<\/p>\n<p>           be payable for the period of incapacity<\/p>\n<p>           treated as spell of sickness.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">\n<p id=\"p_3\">     3.    Learned    counsel     would    submit  when    the<\/p>\n<p>permanent disablement is assessed in view of this clause<\/p>\n<p>there cannot be any further extension of any other benefit<\/p>\n<p>and so the E.I. Court has gone wrong in coming to the<\/p>\n<p>conclusion that he is entitled to the temporary disablement<\/p>\n<p>benefit. It is true that such clause dealt with the fixation of<\/p>\n<p>permanent disablement and the entitlement as well as<\/p>\n<p>prevention of any benefit thereafter.        The fundamental<\/p>\n<p>underlying principle behind all these factors is that when the<\/p>\n<p>temporary     disablement   assumes      the  character  of  a<\/p>\n<p>permanent disablement to certain extend after a certain<\/p>\n<p>period it is that permanent disablement that will have to be<\/p>\n<p>calculated.   For example when one person suffers a very<\/p>\n<p>INS.APPEAL NO. 14 OF 2006<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                 -:4:-<\/span><\/p>\n<p>serious injury his incapacity to do any work will be there for<\/p>\n<p>a definite period of time and thereafter in the process of time<\/p>\n<p>it will get changed and ultimately a stage will come where he<\/p>\n<p>will have a certain specific percentage of permanent disability<\/p>\n<p>which means that his capacity to do the work is limited only<\/p>\n<p>to a certain percentage. So far as this case is concerned<\/p>\n<p>though the Medical Board has assessed the permanent<\/p>\n<p>disability, none of the Medical Officers attached to the<\/p>\n<p>institution has certified that he is fit to resume work. Unless<\/p>\n<p>he is certified to be fit to resume work one cannot deprive<\/p>\n<p>him of the temporary disablement benefit which is otherwise<\/p>\n<p>entitled to. So in a case of this nature where permanent<\/p>\n<p>disablement is assessed but there is nothing to prove that<\/p>\n<p>his temporary disablement of 100% has ceased to exist then<\/p>\n<p>it may not be proper to deprive him of a benefit which he is<\/p>\n<p>legally entitled to.\n<\/p>\n<p id=\"p_4\">       4.   What I mean to say is that unless the employee is<\/p>\n<p>declared to be fit to do some sort of work in connection with<\/p>\n<p>INS.APPEAL NO. 14 OF 2006<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                               -:5:-<\/span><\/p>\n<p>his employment injury, he cannot be deprived of the<\/p>\n<p>temporary disablement benefits. One should not read the<\/p>\n<p>office manual to arrive at a contra decision to deprive a<\/p>\n<p>person of the benefits which he is entitled to. So far as this<\/p>\n<p>case is concerned the applicant has to continue on medical<\/p>\n<p>leave from 25.1.01 to 11.6.03 and he has not been declared<\/p>\n<p>to be fit by any of the concerned Medical Officers. Therefore<\/p>\n<p>I find the approach made by the E.I. Court appears to be<\/p>\n<p>only proper which does not call for any interference.  Hence<\/p>\n<p>the appeal lacks merit and therefore is dismissed.<\/p>\n<p id=\"p_5\">                           M.N.
