The information related to the number of employees in the rickshaw department,<br \/>\nnumber of illegal rickshaws caught etc.<\/p>\n<p>       The Complainant had filed a RTI application with the PIO, MCD, Shahadara<br \/>\nNorth Zone on 15\/10\/2009 asking for certain information. On having not received any<br \/>\ninformation within the mandated time period of 30 days, he filed a Complaint under<br \/>\n<a href=\"\/doc\/1083556\/\" id=\"a_1\">Section 18<\/a> of the RTI Act with the Commission.\n<\/p>\n<p id=\"p_2\">       On this basis, the Commission issued a notice directing the PIO, MCD, Shahadara<br \/>\nNorth Zone on 02\/01\/2010 to provide information to the Complainant and further sought<br \/>\nan explanation for not furnishing the information within the mandated time.\n<\/p>\n<p id=\"p_3\">Commission&#8217;s Order dated 22\/02\/2010<\/p>\n<p>        The Commission allowed the appeal. It was observed that since the Commission<br \/>\nneither received a copy of the information sent to the Complainant, nor did it receive any<br \/>\nexplanation from the PIO for not supplying the information to the Complainant.<br \/>\nTherefore, the only presumption that could be made was that the PIO has deliberately and<br \/>\nwithout any reasonable cause refused to give information as per the provisions of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI<br \/>\nAct<\/a>. Failure on the part of the PIO to respond to the Commission&#8217;s notice showed that<br \/>\nthere is no reasonable cause for the refusal of information. The Commission directed the<br \/>\nPIO to provide the complete information in regard to the RTI Application dated<br \/>\n15\/10\/2009 to the Complainant before 15\/03\/2010.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                              Page 1 of 3<\/span><\/p>\n<p id=\"p_4\"> Facts leading to the show cause hearing on 19\/03\/2010:\n<\/p>\n<p id=\"p_5\">        From the facts before the Commission, it appeared that the PIO has not provided<br \/>\nthe correct and complete information within the mandated time and has failed to comply<br \/>\nwith the provisions of the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a>. The delay and inaction on the PIO&#8217;s part in providing<br \/>\nthe information amounts to willful disobedience of the Commission&#8217;s direction as well as<br \/>\nraises a reasonable doubt that the denial of information may be malafide. It appeared that<br \/>\nthe PIO&#8217;s actions attract the penal provisions and disciplinary action of <a href=\"\/doc\/1369783\/\" id=\"a_3\">Section 20<\/a> (1) and<br \/>\n(2).A show cause notice was therefore issued to the PIO vide Commission&#8217;s decision<br \/>\ndated 22\/02\/2010 with a direction to serve the same to such person(s) who are responsible<br \/>\nfor this delay in providing the information, and direct them to be present before the<br \/>\nCommission along with the respondents.\n<\/p>\n<p id=\"p_6\">Relevant Facts During the Show Cause Hearing on 19\/03\/2010:<br \/>\nThe following were present:\n<\/p>\n<p id=\"p_7\">Respondent: Mr. Nawal Kishore, Deemed PIO &amp; Zonal Superintendent;\n<\/p>\n<p id=\"p_8\">              Mr. Mahesh Sharma, Deemed PIO &amp; Rickshaw Supervisor;\n<\/p>\n<p id=\"p_9\">       The RTI application was received on 15\/10\/2009 and the information has been<br \/>\nprovided on 18\/01\/2010 as per the respondent. The PIO had sought the assistance of Mr.<br \/>\nMahesh Sharma on 15\/10\/2009 since the information was held by him. Mr. Mahesh<br \/>\nSharma did not supply the information and only after the Commission&#8217;s notice on<br \/>\n02\/01\/2010 the information was provided by Mr. Mahesh Sharma on 18\/01\/2010.\n<\/p>\n<p id=\"p_10\">The Commission asked Mr. Mahesh Sharma to explain the reasons for the delay. He<br \/>\nstates that he is very busy and has to move in the filed to catch the illegal rickshaws. He<br \/>\nstates that he also has to deposit the files in the department. He states that he did not have<br \/>\nenough knowledge of how to manage his work. He also states that he had a shortage of<br \/>\nstaff and now the staff is adequate. These cannot be considered as reasons for not<br \/>\nproviding information under <a href=\"\/doc\/671631\/\" id=\"a_4\">RTI Act<\/a>. All officers have to do all the jobs which their duty<br \/>\nenjoins on them. Claiming shortage of staff and overload cannot be considered as excuses<br \/>\nand <a href=\"\/doc\/671631\/\" id=\"a_5\">RTI Act<\/a> has very clearly put the responsibility on the individual officers who are<br \/>\neither PIOs or deemed PIOs as per the provisions of <a href=\"\/doc\/1918101\/\" id=\"a_6\">Section 5(4)<\/a> and <a href=\"\/doc\/1115947\/\" id=\"a_7\">5(5)<\/a>. Mr. Mahesh<br \/>\nhas not advanced any reasonable cause for not providing the information. The<br \/>\nCommission accepts that a period of 15 days could have been taken by the Deemed PIO<br \/>\nMr. Mahesh Kumar to provide the information. Hence he should have provided<br \/>\ninformation latest by 03\/11\/2009. The Commission perused the information sent on<br \/>\n18\/01\/2010 and realized that information on query-5 &amp; 6 which sought information about<br \/>\nthe number of illegal rickshaws caught and its details have not been provided at all. This<br \/>\nappears to be clearly malafide. The PIO Mr. Ravi Deep Sigh Chahar is directed to ensure<br \/>\nthat the information on query-5 &amp; 6 is sent to the Complainant before 05 April 2010.\n<\/p>\n<p id=\"p_11\">The Commission sees this as a fit case for levy of penalty and imposes a penalty of Rs.<br \/>\n250\/- per day of delay under <a href=\"\/doc\/291269\/\" id=\"a_8\">Section 20(1)<\/a> of the RTI Act. Since the complete<br \/>\ninformation has not been provided so far the Commission imposes a penalty of<br \/>\nRs.25000\/- which is the maximum penalty leviable under the Act.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                                  Page 2 of 3<\/span><\/p>\n<p id=\"p_12\"> Decision:\n<\/p>\n<p id=\"p_13\">            As per the provisions of <a href=\"\/doc\/1369783\/\" id=\"a_9\">Section 20<\/a> (1) of the <a href=\"\/doc\/671631\/\" id=\"a_10\">RTI Act<\/a> 2005, the Commission<br \/>\nfinds this a fit case for levying penalty on Mr. Mahesh Sharma, Deemed PIO &amp; Rickshaw<br \/>\nSupervisor. Since the delay in providing the correct information has been over 100 days,<br \/>\nthe Commission is passing an order penalizing Mr. Mahesh Sharma for Rs. 25000\/ which<br \/>\nis the maximum penalty under the Act.\n<\/p>\n<p id=\"p_14\">        The Commissioner, Municipal Corporation of Delhi is directed to recover the<br \/>\namount of Rs.25000\/- from the salary of Mr. Mahesh Sharma and remit the same by a<br \/>\ndemand draft or a Banker&#8217;s Cheque in the name of the Pay &amp; Accounts Officer, CAT,<br \/>\npayable at New Delhi and send the same to Shri Pankaj K.P. Shreyaskar, Joint Registrar<br \/>\nand Deputy Secretary of the Central Information Commission, 2nd Floor, August Kranti<br \/>\nBhawan, New Delhi &#8211; 110066. The amount may be deducted at the rate of Rs.5000\/ per<br \/>\nmonth every month from the salary of Mr. Mahesh Sharma and remitted by the 10th of<br \/>\nevery month starting from April 2010.
