Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :19\/10\/2009\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN, J.\n                   -------------------------------------------\n                   W.P(C).No.29394 OF 2009\n                  -------------------------------------------\n             Dated this the 19th day of October, 2009\n\n\n                              JUDGMENT\n<\/pre>\n<p id=\"p_1\">      The petitioner is a trust created by a parent with the child<\/p>\n<p>or children as beneficiaries and appointing the grandfather as<\/p>\n<p>the trustee.   The trust holds title to a building in Cochin city.<\/p>\n<p>That is given to the 4th respondent for a commercial activity. It is<\/p>\n<p>pleaded by the petitioner that the said entrustment is only a<\/p>\n<p>licence and not a lease.          May be so; may not be so.           The<\/p>\n<p>Municipality Act, as interpreted by this Court, is not to be used<\/p>\n<p>in lieu of proceedings for eviction in accordance with law. I say<\/p>\n<p>this because once a person comes into occupation by the<\/p>\n<p>legitimate process of a lease or licence, continued requirement<\/p>\n<p>of the consent of the lessor or the licensor is not to be insisted<\/p>\n<p>upon for renewal of the municipal licence, including licence<\/p>\n<p>under D &amp; O Rules, PFA Rules etc.                    Otherwise, the owners,<\/p>\n<p>including landlords, could easily push all occupants, who are<\/p>\n<p>licensees or lessees, under the cover of objecting to the renewal<\/p>\n<p>WPC.29394\/09<\/p>\n<p>                            Page numbers<\/p>\n<p>of municipal licence.    Under such circumstances, I am not<\/p>\n<p>inclined to exercise the discretionary jurisdiction under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article<\/p>\n<p>226<\/a> of the Constitution in favour of the petitioner, who seeks<\/p>\n<p>issuance of an order, declaring that the licence granted to the 4th<\/p>\n<p>respondent is non est in law or even to issue a mandamus to the<\/p>\n<p>first respondent municipal authority to recall the said licence to<\/p>\n<p>run a restaurant.      The writ petition fails.     The same is<\/p>\n<p>accordingly dismissed.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       After having dictated this judgment, learned counsel for<\/p>\n<p>the petitioner seeks leave to withdraw this writ petition. I am<\/p>\n<p>not inclined to grant such leave.
