Raval for petitioner and learned<br \/>\nadvocate Mr.N.A.Dave for respondent.\n<\/p>\n<p id=\"p_1\">2.\tThis<br \/>\nCourt has issued notice to the respondent by order dated 21.4.2010.\n<\/p>\n<p id=\"p_2\">3.\tThe<br \/>\npetitioner has challenged the order passed by the Metropolitan<br \/>\nMagistrate, Court No.8, Ahmedabad dated 2.2.2010 at Exh.1 in Misc.<br \/>\nApplication No.116 of 2009 (Annexure-A, Page-9).\n<\/p>\n<p id=\"p_3\">4.\tLearned<br \/>\nadvocate Mrs.Raval submitted that Metropolitan Magistrate has passed<br \/>\nan order in absence of petitioner and no reasonable opportunity of<br \/>\nhearing is given to Corporation before passing such order.\n<\/p>\n<p id=\"p_4\">5.\tLearned<br \/>\nadvocate Mr.Dave submitted that let this matter may be remanded back<br \/>\nto the  Metropolitan Magistrate, Court No.8, Ahmedabad and respondent<br \/>\nwill join the petitioner   Ahmedabad Municipal Corporation as party<br \/>\nrespondent  and also make the prayer to file amendment application<br \/>\nfor making change in name and surname.\n<\/p>\n<p id=\"p_5\">6.\tConsidering<br \/>\nthe submissions made by learned advocates appearing for the<br \/>\nrespective parties, the order passed by  Metropolitan Magistrate,<br \/>\nCourt No.8, Ahmedabad dated 2.2.2010 in Misc. Civil Application<br \/>\nNo.116 of 2009 at Exh.1 is hereby quashed and set aside while<br \/>\nremanding the matter back to  Metropolitan Magistrate, Court No.8,<br \/>\nAhmedabad.\n<\/p>\n<p id=\"p_6\">7.\tThe<br \/>\n Metropolitan Magistrate, Court No.8, Ahmedabad to issue notice to<br \/>\nAhmedabad Municipal Corporation and thereafter, to consider the<br \/>\namendment application which will be filed by respondent herein and<br \/>\nthereafter, to pass appropriate reasoned order in accordance with<br \/>\nlaw, after giving reasonable opportunity of hearing to respective<br \/>\nparties, as early as possible preferably within a period of one month<br \/>\nfrom the date of receiving copy of present order.\n<\/p>\n<p id=\"p_7\">8.\tLet<br \/>\nthe notice may be served immediately to Ahmedabad Municipal<br \/>\nCorporation by Metropolitan Magistrate Court No.8, Ahmedabad in<br \/>\nrespect to application which will be preferred by respondent herein.\n<\/p>\n<p id=\"p_8\">9.\tIn<br \/>\nview of aforesaid observations and directions, present petition is<br \/>\ndisposed of accordingly without expressing any opinion on merits.\n<\/p>\n<p id=\"p_9\">(H.K.RATHOD,J.)<\/p>\n<p>(vipul)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Ahmedabad vs Karan on 21 July, 2010 Author: H.K.Rathod,&amp;Nbsp;
